Europski sud za ljudska prava (ESLJP) prihvatio je stajalište Češke o obveznom cijepljenju djece, stoji u povijesnoj presudi objavljenoj u četvrtak koja odbacuje tužbe roditelja o kršenju njihovih roditeljskih prava. 

To je prva presuda Europskog suda za ljudska prava donesena po tužbi protiv obveznog cijepljenja djece od dječjih bolesti i na nju se nije moguće žaliti.

Odluka ESLJP-a donesena je po tužbama podnesenima prije pandemije covida-19, u razdoblju od 2013. do 2015. no one bi mogle biti aktualizirane ako se povede rasprava o cijepljenju djece protiv te zarazne bolesti koja je izazvala globalnu pandemiju.

Češke obitelji žalile su se ESLJP-u na odluke nacionalnih sudova jer im je upis djece u pripremni razred za osnovnu školu bio uvjetovan cijepljenjem ili su bile novčano kažnjene jer su odbile cijepiti svoju djecu protiv dječjih bolesti.

ESLJP u svom pravorijeku navodi da nije bilo kršenja Europske konvencije o ljudskim pravima.

"Sud je utvrdio da su mjere, na koje su žalili tužitelji, a koje su procijenjene u nacionalnom kontekstu, uravnotežene s ciljevima češke države, to jest zaštitom od bolesti koje predstavljaju veliku ugrozu za ljudsko zdravlje", navodi ESLJP.

Prema češkom zakonu, djeca moraju biti cijepljena protiv devet opće poznatih bolesti, kao što su poliomijelitis (dječja paraliza), hepatitis B, tetanus, ospice, hripavac, osim u slučaju medicinski opravdanih razloga. 

Češke vlasti provodile su politiku "legitimnih ciljeve zaštite zdravlja kao i prava navodeći da cijepljenje štiti i one koji primaju cjepivo i onih koji ne mogu biti cijepljeni iz medicinskih razloga" i ovise o kolektivnom imunitetu.

Češke vlasti "težile su postići legitimne ciljeve zaštite zdravlja i prava drugih", navodi ESLJP. "Češka zdravstvena politika prema tome dosljedna je u najboljem interesu djece", dodaje se.

Novčana kazna izrečena podnositeljima tužbe nije bila pretjerana, navodi sud u Strasbourgu.

Ocjenjuje da je odbijanje upisa djece u pripremni razred za osnovnu školu "više preventivna, a manje kaznena mjera".

Presuda "jača mogućnost obveznog cijepljenja u uvjetima sadašnje pandemije covida-19", kazao je za agenciju AFP  Nicolas Hervieu, pravni stručnjak specijalist za ESLJP.

Presuda podupire "načelo društvene solidarnosti koja može opravdati obvezno cijepljenje za svakoga, čak i za one koji su manje ugroženi bolešću, kako bi se zaštitili najranjiviji", dodaje Hervieu.

Potreba za stjecanje kolektivnog imuniteta kako bi se suzbila pandemija covida-19 potaknula je raspravu o potrebi obveznog cijepljenja u vrijeme kada bujaju sumnje u cjepivo.

Europski sud za ljudska prava (ESLJP) prihvatio je stajalište Češke o obveznom cijepljenju djece, stoji u povijesnoj presudi objavljenoj u četvrtak koja odbacuje tužbe roditelja o kršenju njihovih roditeljskih prava. 

To je prva presuda Europskog suda za ljudska prava donesena po tužbi protiv obveznog cijepljenja djece od dječjih bolesti i na nju se nije moguće žaliti.

Odluka ESLJP-a donesena je po tužbama podnesenima prije pandemije covida-19, u razdoblju od 2013. do 2015. no one bi mogle biti aktualizirane ako se povede rasprava o cijepljenju djece protiv te zarazne bolesti koja je izazvala globalnu pandemiju.

Češke obitelji žalile su se ESLJP-u na odluke nacionalnih sudova jer im je upis djece u pripremni razred za osnovnu školu bio uvjetovan cijepljenjem ili su bile novčano kažnjene jer su odbile cijepiti svoju djecu protiv dječjih bolesti.

ESLJP u svom pravorijeku navodi da nije bilo kršenja Europske konvencije o ljudskim pravima.

"Sud je utvrdio da su mjere, na koje su žalili tužitelji, a koje su procijenjene u nacionalnom kontekstu, uravnotežene s ciljevima češke države, to jest zaštitom od bolesti koje predstavljaju veliku ugrozu za ljudsko zdravlje", navodi ESLJP.

Prema češkom zakonu, djeca moraju biti cijepljena protiv devet opće poznatih bolesti, kao što su poliomijelitis (dječja paraliza), hepatitis B, tetanus, ospice, hripavac, osim u slučaju medicinski opravdanih razloga. 

Češke vlasti provodile su politiku "legitimnih ciljeve zaštite zdravlja kao i prava navodeći da cijepljenje štiti i one koji primaju cjepivo i onih koji ne mogu biti cijepljeni iz medicinskih razloga" i ovise o kolektivnom imunitetu.

Češke vlasti "težile su postići legitimne ciljeve zaštite zdravlja i prava drugih", navodi ESLJP. "Češka zdravstvena politika prema tome dosljedna je u najboljem interesu djece", dodaje se.

Novčana kazna izrečena podnositeljima tužbe nije bila pretjerana, navodi sud u Strasbourgu.

Ocjenjuje da je odbijanje upisa djece u pripremni razred za osnovnu školu "više preventivna, a manje kaznena mjera".

Presuda "jača mogućnost obveznog cijepljenja u uvjetima sadašnje pandemije covida-19", kazao je za agenciju AFP  Nicolas Hervieu, pravni stručnjak specijalist za ESLJP.

Presuda podupire "načelo društvene solidarnosti koja može opravdati obvezno cijepljenje za svakoga, čak i za one koji su manje ugroženi bolešću, kako bi se zaštitili najranjiviji", dodaje Hervieu.

Potreba za stjecanje kolektivnog imuniteta kako bi se suzbila pandemija covida-19 potaknula je raspravu o potrebi obveznog cijepljenja u vrijeme kada bujaju sumnje u cjepivo.

Antivakseri na aparatima zbog povijesne presude Europskog suda za ljudska prava: obavezno cijepljenje djece u Češkoj ne krši roditeljska prava

Europski sud za ljudska prava (ESLJP) prihvatio je stajalište Češke o obveznom cijepljenju djece, stoji u povijesnoj presudi objavljenoj u četvrtak koja odbacuje tužbe roditelja o kršenju njihovih roditeljskih prava. 

To je prva presuda Europskog suda za ljudska prava donesena po tužbi protiv obveznog cijepljenja djece od dječjih bolesti i na nju se nije moguće žaliti.

Odluka ESLJP-a donesena je po tužbama podnesenima prije pandemije covida-19, u razdoblju od 2013. do 2015. no one bi mogle biti aktualizirane ako se povede rasprava o cijepljenju djece protiv te zarazne bolesti koja je izazvala globalnu pandemiju.

Češke obitelji žalile su se ESLJP-u na odluke nacionalnih sudova jer im je upis djece u pripremni razred za osnovnu školu bio uvjetovan cijepljenjem ili su...
