U stečaju tvrtke "Kerum" 20. srpnja ove godine Trgovački sud u Splitu donio je rješenje kojim se poslovni prostor površine 84 četvorna metra u prizemlju objekta u Zrinsko-frankopanskoj ulici 68, u Lori, dosuđuje Juri Kerumu.
Naime, stariji brat Željka Keruma, vlasnika tvrtke "Kerum", razlučni je vjerovnik tog propalog trgovačkog lanca. To znači da ima pravo odvojenog namirenja svojeg potraživanja od dijela stečajne mase tvrtke "Kerum". Ta je imovina, među ostalim, spomenuti prostor na adresi u Lori s koje je krenulo ozbiljnije širenje poslovnog carstva Željka Keruma i gdje je bilo sjedište trgovačkog lanca.

– Razlučni vjerovnik Jure Kerum kao kupac u cijelosti se oslobađa plaćanja kupovnine od 508.433 kune – stoji u rješenju Trgovačkog suda.

Potraživanje koje taj vjerovnik s pravom odvojenog namirenja ima prema tvrtki "Kerum" veće je od kupovnine, pa je došlo do prebijanja. Jure Kerum kratko je vrijeme bio na čelu te posrnule tvrtke, i to od 2. srpnja do 10. rujna 2012. godine. Na tom je mjestu naslijedio sestru Nevenku Bečić. Potom je "fotelju" prepustio svojoj kćeri Željki Kerum Topalušić. Nju Općinsko državno odvjetništvo u Splitu tereti za dva kaznena djela: prvo (ne)djelo je nepokretanje stečaja nad tvrtkom "Kerum", kojoj su računi dulje vrijeme bili u blokadi.

Što kažu zemljišne knjige

Drugo (ne)djelo je pogodovanje pojedinim vjerovnicima – dobavljačima, na način da ih je tvrtka namirivala preko redoslijeda iz Finina očevidnika. Tako je oštetila druge vjerovnike, kako to tvrdi Općinsko državno odvjetništvo, među kojima je država, koja je po očevidniku do otvaranja stečaja imala prioritet u naplati.

Zavirili smo u zemljišne knjige, gdje smo došli do dokumenta na temelju kojeg je Jure Kerum dobio založno pravo na "Kerumovu" poslovnom prostoru. Taj dokument otkriva da je Željka Kerum Topalušić, kao direktorica tvrtke "Kerum", 5. studenog 2012. godine – a riječ je o vremenu kad su računi tvrtke bili u blokadi teškoj 60,6 milijuna kuna – sa svojim djedom Josipom Kerumom potpisala sporazum kojim su utvrdili da mu trgovački lanac duguje 2,5 milijuna kuna, jer mu od 1990. godine nije plaćao 2000 njemačkih maraka mjesečne zakupnine za poslovni prostor u Mostarskoj ulici 83, gdje je Željko Kerum imao svoju prvu "butigu". Istim dokumentom iz studenog 2012. godine ugovoreno je da djed Kerum zbog toga dobiva založna prava na tri "Kerumove" nekretnine – poslovnom prostoru u Zrinko-frankopanskoj ulici, na poslovnom prostoru u prizemlju zgrade u Doverskoj ulici 33, gdje je također bila "Kerumova" trgovina, te na 527 četvornih metara bivšeg restorana na vrhu prodajnog centra "Koteks".

Na temelju rješenja o nasljeđivanju od 4. prosinca 2014. godine, pravo zaloga je s Josipa Keruma preneseno na njegova sina Juru, koji je na temelju toga potom već preuzeo vlasništvo nad bivšim restoranom na vrhu trgovačkog centra na Gripama, a sada će i vlasništvo nad poslovnim prostorom u Lori. Te 2012. godine moglo se samo nagađati koji su konkretni razlozi zbog kojih se Kerumovi bore da se stečaj nad propalim trgovačkim lancem otvori što kasnije, no sada znamo da su se u to vrijeme potpisivali dokumenti koji su članovima obitelji Kerum omogućili upisivanje založnih prava na dijelu imovine tvrtke radi preuzimanja tih nekretnina.

Beznačajno kazneno djelo?

U međuvremenu je Općinski sud u Splitu prošle godine zaključio da to što Željka Kerum Topalušić nije pokrenula stečaj nad svojedobno jednom od najvećih tvrtki u regiji zapravo – beznačajno kazneno djelo, te ju je nepravomoćnom presudom oslobodilo krivnje. Sud je nije proglasio krivom ni za pogodovanje određenim vjerovnicima na štetu države.
Po žalbi Općinskog državnog odvjetništva, takvu oslobađajuću presudu ukinuo je Županijski sud u Osijeku, koji je to ovako obrazložio:
– Viši sud smatra da je okrivljena postupala s visokim stupnjem krivnje, imajući pritom u vidu iznos dospjelih, a neplaćenih obveza za koji je tvrtka "Kerum" bila blokirana...


Početkom ove godine održano je ponovljeno suđenje.
– U veljači 2020. godine donesena je presuda kojom je okrivljenica oslobođena optužbe, a protiv koje je odluke Općinsko državno odvjetništvo u Splitu izjavilo žalbu, pa je spis dostavljen Županijskom sudu u Osijeku, koji još nije donio odluku – kazao nam je Vuko Adžić Katalinić, glasnogovornik Kaznenog odjela Općinskog suda.

Naslijeđe pokojnoga oca

– Potraživanje sam naslijedio od pokojnog ćaće 2014. godine. Ne znam što se prije toga događalo – kazao nam je Jure Kerum kad smo ga upitali kako mu je dosuđen prostor tvrtke "Kerum", i to na temelju založnog prava koje je njegova kći Željka Kerum Topalušić, kao direktorica tvrtke, priznala njegovu ocu i svome djedu Josipu u vrijeme kad je račun tvrtke bio blokiran, zbog čega bi to netko mogao smatrati oštećivanjem ostalih vjerovnika.
Izbjegao je odgovor kada smo ga par puta zamolili da nam pomogne stupiti u kontakt s njegovom kćeri koja je potpisala predmetni sporazum o založnom pravu.

U stečaju tvrtke "Kerum" 20. srpnja ove godine Trgovački sud u Splitu donio je rješenje kojim se poslovni prostor površine 84 četvorna metra u prizemlju objekta u Zrinsko-frankopanskoj ulici 68, u Lori, dosuđuje Juri Kerumu.
Naime, stariji brat Željka Keruma, vlasnika tvrtke "Kerum", razlučni je vjerovnik tog propalog trgovačkog lanca. To znači da ima pravo odvojenog namirenja svojeg potraživanja od dijela stečajne mase tvrtke "Kerum". Ta je imovina, među ostalim, spomenuti prostor na adresi u Lori s koje je krenulo ozbiljnije širenje poslovnog carstva Željka Keruma i gdje je bilo sjedište trgovačkog lanca.

– Razlučni vjerovnik Jure Kerum kao kupac u cijelosti se oslobađa plaćanja kupovnine od 508.433 kune – stoji u rješenju Trgovačkog suda.

Potraživanje koje taj vjerovnik s pravom odvojenog namirenja ima prema tvrtki "Kerum" veće je od kupovnine, pa je došlo do prebijanja. Jure Kerum kratko je vrijeme bio na čelu te posrnule tvrtke, i to od 2. srpnja do 10. rujna 2012. godine. Na tom je mjestu naslijedio sestru Nevenku Bečić. Potom je "fotelju" prepustio svojoj kćeri Željki Kerum Topalušić. Nju Općinsko državno odvjetništvo u Splitu tereti za dva kaznena djela: prvo (ne)djelo je nepokretanje stečaja nad tvrtkom "Kerum", kojoj su računi dulje vrijeme bili u blokadi.

Što kažu zemljišne knjige

Drugo (ne)djelo je pogodovanje pojedinim vjerovnicima – dobavljačima, na način da ih je tvrtka namirivala preko redoslijeda iz Finina očevidnika. Tako je oštetila druge vjerovnike, kako to tvrdi Općinsko državno odvjetništvo, među kojima je država, koja je po očevidniku do otvaranja stečaja imala prioritet u naplati.

Zavirili smo u zemljišne knjige, gdje smo došli do dokumenta na temelju kojeg je Jure Kerum dobio založno pravo na "Kerumovu" poslovnom prostoru. Taj dokument otkriva da je Željka Kerum Topalušić, kao direktorica tvrtke "Kerum", 5. studenog 2012. godine – a riječ je o vremenu kad su računi tvrtke bili u blokadi teškoj 60,6 milijuna kuna – sa svojim djedom Josipom Kerumom potpisala sporazum kojim su utvrdili da mu trgovački lanac duguje 2,5 milijuna kuna, jer mu od 1990. godine nije plaćao 2000 njemačkih maraka mjesečne zakupnine za poslovni prostor u Mostarskoj ulici 83, gdje je Željko Kerum imao svoju prvu "butigu". Istim dokumentom iz studenog 2012. godine ugovoreno je da djed Kerum zbog toga dobiva založna prava na tri "Kerumove" nekretnine – poslovnom prostoru u Zrinko-frankopanskoj ulici, na poslovnom prostoru u prizemlju zgrade u Doverskoj ulici 33, gdje je također bila "Kerumova" trgovina, te na 527 četvornih metara bivšeg restorana na vrhu prodajnog centra "Koteks".

Na temelju rješenja o nasljeđivanju od 4. prosinca 2014. godine, pravo zaloga je s Josipa Keruma preneseno na njegova sina Juru, koji je na temelju toga potom već preuzeo vlasništvo nad bivšim restoranom na vrhu trgovačkog centra na Gripama, a sada će i vlasništvo nad poslovnim prostorom u Lori. Te 2012. godine moglo se samo nagađati koji su konkretni razlozi zbog kojih se Kerumovi bore da se stečaj nad propalim trgovačkim lancem otvori što kasnije, no sada znamo da su se u to vrijeme potpisivali dokumenti koji su članovima obitelji Kerum omogućili upisivanje založnih prava na dijelu imovine tvrtke radi preuzimanja tih nekretnina.

Beznačajno kazneno djelo?

U međuvremenu je Općinski sud u Splitu prošle godine zaključio da to što Željka Kerum Topalušić nije pokrenula stečaj nad svojedobno jednom od najvećih tvrtki u regiji zapravo – beznačajno kazneno djelo, te ju je nepravomoćnom presudom oslobodilo krivnje. Sud je nije proglasio krivom ni za pogodovanje određenim vjerovnicima na štetu države.
Po žalbi Općinskog državnog odvjetništva, takvu oslobađajuću presudu ukinuo je Županijski sud u Osijeku, koji je to ovako obrazložio:
– Viši sud smatra da je okrivljena postupala s visokim stupnjem krivnje, imajući pritom u vidu iznos dospjelih, a neplaćenih obveza za koji je tvrtka "Kerum" bila blokirana...


Početkom ove godine održano je ponovljeno suđenje.
– U veljači 2020. godine donesena je presuda kojom je okrivljenica oslobođena optužbe, a protiv koje je odluke Općinsko državno odvjetništvo u Splitu izjavilo žalbu, pa je spis dostavljen Županijskom sudu u Osijeku, koji još nije donio odluku – kazao nam je Vuko Adžić Katalinić, glasnogovornik Kaznenog odjela Općinskog suda.

Naslijeđe pokojnoga oca

– Potraživanje sam naslijedio od pokojnog ćaće 2014. godine. Ne znam što se prije toga događalo – kazao nam je Jure Kerum kad smo ga upitali kako mu je dosuđen prostor tvrtke "Kerum", i to na temelju založnog prava koje je njegova kći Željka Kerum Topalušić, kao direktorica tvrtke, priznala njegovu ocu i svome djedu Josipu u vrijeme kad je račun tvrtke bio blokiran, zbog čega bi to netko mogao smatrati oštećivanjem ostalih vjerovnika.
Izbjegao je odgovor kada smo ga par puta zamolili da nam pomogne stupiti u kontakt s njegovom kćeri koja je potpisala predmetni sporazum o založnom pravu.
