Radnici započinju i dovršavaju putovanja s mjesta svog boravišta zbog odluke njihova poslodavca o ukidanju regionalnih ureda, a ne jer oni tako žele, piše poslovni.hr. 

Sud Europske unije je u odluci C-266/2014 zauzeo stav da kada radnici koji se nalaze u situaciji kao što je ona iz glavnog postupka koriste službeno vozilo tijekom radnog dana za put od mjesta njihova boravišta do klijenta kojeg je odredio njihov poslodavac ili za povratak na mjesto njihova boravišta od mjesta gdje se nalazi takav klijent te za odlazak od mjesta gdje se nalazi jedan klijent na mjesto gdje se nalazi drugi klijent, za te se radnike prilikom putovanja mora smatrati da “rade” u smislu članka 2. točke 1. iste direktive.

Takav bi ishod također bio suprotan cilju zaštite sigurnosti i zdravlja radnika iz Direktive 2003/88, koji obuhvaća potrebu da se radnicima jamči minimalno vrijeme odmora.

Bilo bi, u stvari, suprotno toj direktivi da vrijeme odmora radnika bez uobičajenog ili stalnog mjesta rada bude smanjeno zbog isključenja vremena njihova putovanja između njihova boravišta i klijenata iz pojma “radnog vremena” u smislu članka 2. točke 1. navedene direktive.

Radnici započinju i dovršavaju takva putovanja s mjesta svog boravišta, s obzirom na to da ta okolnost proizlazi iz odluke njihova poslodavca o ukidanju regionalnih ureda, a ne iz odluke tih radnika.

S obzirom na to da su radnici izgubili mogućnost slobodno utvrđivati udaljenost koja dijeli njihovo mjesto boravišta od uobičajenog mjesta početka i kraja njihova radnog dana, ne može se smatrati da su pristali na izbor svojeg poslodavca o ukidanju ureda, zaključuje poslovni.hr.

Radnici započinju i dovršavaju putovanja s mjesta svog boravišta zbog odluke njihova poslodavca o ukidanju regionalnih ureda, a ne jer oni tako žele, piše poslovni.hr. 

Sud Europske unije je u odluci C-266/2014 zauzeo stav da kada radnici koji se nalaze u situaciji kao što je ona iz glavnog postupka koriste službeno vozilo tijekom radnog dana za put od mjesta njihova boravišta do klijenta kojeg je odredio njihov poslodavac ili za povratak na mjesto njihova boravišta od mjesta gdje se nalazi takav klijent te za odlazak od mjesta gdje se nalazi jedan klijent na mjesto gdje se nalazi drugi klijent, za te se radnike prilikom putovanja mora smatrati da “rade” u smislu članka 2. točke 1. iste direktive.

Takav bi ishod također bio suprotan cilju zaštite sigurnosti i zdravlja radnika iz Direktive 2003/88, koji obuhvaća potrebu da se radnicima jamči minimalno vrijeme odmora.

Bilo bi, u stvari, suprotno toj direktivi da vrijeme odmora radnika bez uobičajenog ili stalnog mjesta rada bude smanjeno zbog isključenja vremena njihova putovanja između njihova boravišta i klijenata iz pojma “radnog vremena” u smislu članka 2. točke 1. navedene direktive.

Radnici započinju i dovršavaju takva putovanja s mjesta svog boravišta, s obzirom na to da ta okolnost proizlazi iz odluke njihova poslodavca o ukidanju regionalnih ureda, a ne iz odluke tih radnika.

S obzirom na to da su radnici izgubili mogućnost slobodno utvrđivati udaljenost koja dijeli njihovo mjesto boravišta od uobičajenog mjesta početka i kraja njihova radnog dana, ne može se smatrati da su pristali na izbor svojeg poslodavca o ukidanju ureda, zaključuje poslovni.hr.

Odluka suda Europske unije: radnicima se putovanje na posao mora uračunati u radno vrijeme, evo po kojim uvjetima

Radnici započinju i dovršavaju putovanja s mjesta svog boravišta zbog odluke njihova poslodavca o ukidanju regionalnih ureda, a ne jer oni tako žele, piše poslovni.hr. 

Sud Europske unije je u odluci C-266/2014 zauzeo stav da kada radnici koji se nalaze u situaciji kao što je ona iz glavnog postupka koriste službeno vozilo tijekom radnog dana za put od mjesta njihova boravišta do klijenta kojeg je odredio njihov poslodavac ili za povratak na mjesto njihova boravišta od mjesta gdje se nalazi takav klijent te za odlazak od mjesta gdje se nalazi jedan klijent na mjesto gdje se nalazi drugi klijent, za te se radnike prilikom putovanja mora smatrati da “rade” u smislu članka 2. točke 1. iste direktive.

Takav bi ishod također bio suprotan cilju zaštite sigurnosti i zdravlja...
