Godinu dana nakon što je covid proglašen globalnom pandemijom, a svjetske farmaceutske kompanije krenule u utrku za pronalazak cjepiva protiv smrtonosne bolesti, iskrsnuo je prijepor o zaštiti njihova intelektualnog vlasništva. Pošto to poskupljuje cjepivo i može mu ograničiti pristup, sve su glasniji pozivi da se kompanije privremeno odreknu toga prava.
Jonasa Salka, izumitelja cjepiva protiv dječje paralize, novinari su 1955. pitali tko je vlasnik patenta na spasonosno cjepivo.
"Narod, rekao bih. Nema patenta. Tko može patentirati Sunce?", odgovorio je.
I premda će povjesničari reći da Salkov "dar svijetu" možda i nije tako altruističan kako se čini, jer bi po ondašnjim kriterijima teško ispunio uvjete za patentiranje, činjenica je da je američki virolog spasio živote milijuna djece. Djelomično zahvaljujući i tomu što nije bilo zaštite intelektualnog vlasništva.
Danas, kad je broj žrtava covida dosegao tri milijuna, pitanje patenta na cjepivo pretvorilo se u jednu od najžešćih rasprava na planetu.
Čelnik Svjetske zdravstvene organizacije (WHO) Tedros Ghebreyesus pozvao je države i farmaceutske kompanije da se odreknu zaštite intelektualnog vlasništva kako bi se cijeli svijet jednako borio protiv covida. "Većina cjepiva dosad je primijenjena u šačici bogatih zemalja dok većina država niskih i srednjih prihoda promatra i čeka", kazao je u ožujku.
Po nedavnom izvještaju AFP-a, 49 posto dosad proizvedenih doza cjepiva aplicirano je na Zapadu, u kojemu živi samo 16 posto svjetske populacije.
Problem je u tomu, tvrdi šef WHO-a, što se u svijetu neće moći postići dovoljna procijepljenost sve dok bogate zemlje svoje doze, tehnološki know-how u proizvodnji cjepiva i prava na intelektualno vlasništvo, drže pod ključem.
Besplatna cjepiva za sve?
Južna Afrika i Indija prve su države koje su pozvale na odricanje na patente na cjepiva, a od tada im se pridružilo osamdesetak zemalja u razvoju i skupine poput Liječnika bez granica i Amnesty Internationala.
Zemlje koje proizvode cjepiva poput Britanije, zemalja EU-a, Švicarske, SAD-a blokiraju takva nastojanja jer plaćanje intelektualnog vlasništva omogućuje istraživanja i inovacije i štiti od duplikata loše kvalitete.
Liječnica Anne Sénéquier, istraživačica na Francuskom institutu za međunarodna i strateška pitanja, kaže da bi odricanje od patenata nesumnjivo cjepivo učinilo dostupnijim, no to istodobno može biti i riskantno. "Privatni laboratoriji uvijek su bolje financirani od državnih", kazala je i dodala da patenti pomažu da se tvrtkama vrate njihova ulaganja.
"Ako laboratorijima ne možete jamčiti da će im ulaganja u istraživanja biti vraćena, vjerojatno će prestati s ulaganjem. Primjerice, velika većina lijekova koji se danas razvijaju na Zapadu namijenjena su liječenju bolesti poput dijabetesa i visokoga krvnog tlaka. Dakle, riječ je o lijekovima koji se mogu unovčiti", objasnila je.
Iako bi se tomu u normalnim okolnostima teško moglo bilo što prigovoriti, istraživači cjepiva protiv covida dobili su oko 10 milijarda dolara od poreznih obveznika, što znači da cjepiva na mnoge načine već pripadaju narodu.
Recept bez uputa
No čak i ako neke kompanije odluče da neće primjenjivati patente na svoja cjepiva tijekom pandemije, poput Moderne, nemoguće je reproducirati cjepivo ako tvrtke ne podijele i svoj know-how.
"To što Moderna neće primjenjivati svoje pravo na patent tijekom akutne faze pandemije neće mnogo značiti ako ne podijeli svoje znanje s ostalima kako bi mogli proizvesti cjepivo", kaže Olivier Wouters, profesor u londonskoj školi javnoga zdravlja.
On tvrdi da su bogate zemlje koje su financirale razvoj cjepiva mogle tražiti i više od kompanija s kojima su sklapale ugovore.
"Puno bi više smisla imalo da su rekli: 'Pomoći ćemo financirati razvoj i proizvodnju vašeg cjepiva, ali pod uvjetom da surađujete s kolegama iz Indije, Brazila i s ostalim proizvođačima iz svijeta", rekao je Wouters.
Graham Dutfield, profesor na Sveučilištu u Leedsu i autor knjige o pravu na intelektualno vlasništvo i trgovinu, slaže se s Woutersom. Odricanje od patenata bez podjele znanja uspoređuje s receptom bez omjera i uputa.
"Ono što nam stvarno treba su regionalni centri diljem svijeta, u Africi, Latinskoj Americi i Oceaniji, koji će proizvoditi za globalne potrebe", zaključio je.

Godinu dana nakon što je covid proglašen globalnom pandemijom, a svjetske farmaceutske kompanije krenule u utrku za pronalazak cjepiva protiv smrtonosne bolesti, iskrsnuo je prijepor o zaštiti njihova intelektualnog vlasništva. Pošto to poskupljuje cjepivo i može mu ograničiti pristup, sve su glasniji pozivi da se kompanije privremeno odreknu toga prava.
Jonasa Salka, izumitelja cjepiva protiv dječje paralize, novinari su 1955. pitali tko je vlasnik patenta na spasonosno cjepivo.
"Narod, rekao bih. Nema patenta. Tko može patentirati Sunce?", odgovorio je.
I premda će povjesničari reći da Salkov "dar svijetu" možda i nije tako altruističan kako se čini, jer bi po ondašnjim kriterijima teško ispunio uvjete za patentiranje, činjenica je da je američki virolog spasio živote milijuna djece. Djelomično zahvaljujući i tomu što nije bilo zaštite intelektualnog vlasništva.
Danas, kad je broj žrtava covida dosegao tri milijuna, pitanje patenta na cjepivo pretvorilo se u jednu od najžešćih rasprava na planetu.
Čelnik Svjetske zdravstvene organizacije (WHO) Tedros Ghebreyesus pozvao je države i farmaceutske kompanije da se odreknu zaštite intelektualnog vlasništva kako bi se cijeli svijet jednako borio protiv covida. "Većina cjepiva dosad je primijenjena u šačici bogatih zemalja dok većina država niskih i srednjih prihoda promatra i čeka", kazao je u ožujku.
Po nedavnom izvještaju AFP-a, 49 posto dosad proizvedenih doza cjepiva aplicirano je na Zapadu, u kojemu živi samo 16 posto svjetske populacije.
Problem je u tomu, tvrdi šef WHO-a, što se u svijetu neće moći postići dovoljna procijepljenost sve dok bogate zemlje svoje doze, tehnološki know-how u proizvodnji cjepiva i prava na intelektualno vlasništvo, drže pod ključem.
Besplatna cjepiva za sve?
Južna Afrika i Indija prve su države koje su pozvale na odricanje na patente na cjepiva, a od tada im se pridružilo osamdesetak zemalja u razvoju i skupine poput Liječnika bez granica i Amnesty Internationala.
Zemlje koje proizvode cjepiva poput Britanije, zemalja EU-a, Švicarske, SAD-a blokiraju takva nastojanja jer plaćanje intelektualnog vlasništva omogućuje istraživanja i inovacije i štiti od duplikata loše kvalitete.
Liječnica Anne Sénéquier, istraživačica na Francuskom institutu za međunarodna i strateška pitanja, kaže da bi odricanje od patenata nesumnjivo cjepivo učinilo dostupnijim, no to istodobno može biti i riskantno. "Privatni laboratoriji uvijek su bolje financirani od državnih", kazala je i dodala da patenti pomažu da se tvrtkama vrate njihova ulaganja.
"Ako laboratorijima ne možete jamčiti da će im ulaganja u istraživanja biti vraćena, vjerojatno će prestati s ulaganjem. Primjerice, velika većina lijekova koji se danas razvijaju na Zapadu namijenjena su liječenju bolesti poput dijabetesa i visokoga krvnog tlaka. Dakle, riječ je o lijekovima koji se mogu unovčiti", objasnila je.
Iako bi se tomu u normalnim okolnostima teško moglo bilo što prigovoriti, istraživači cjepiva protiv covida dobili su oko 10 milijarda dolara od poreznih obveznika, što znači da cjepiva na mnoge načine već pripadaju narodu.
Recept bez uputa
No čak i ako neke kompanije odluče da neće primjenjivati patente na svoja cjepiva tijekom pandemije, poput Moderne, nemoguće je reproducirati cjepivo ako tvrtke ne podijele i svoj know-how.
"To što Moderna neće primjenjivati svoje pravo na patent tijekom akutne faze pandemije neće mnogo značiti ako ne podijeli svoje znanje s ostalima kako bi mogli proizvesti cjepivo", kaže Olivier Wouters, profesor u londonskoj školi javnoga zdravlja.
On tvrdi da su bogate zemlje koje su financirale razvoj cjepiva mogle tražiti i više od kompanija s kojima su sklapale ugovore.
"Puno bi više smisla imalo da su rekli: 'Pomoći ćemo financirati razvoj i proizvodnju vašeg cjepiva, ali pod uvjetom da surađujete s kolegama iz Indije, Brazila i s ostalim proizvođačima iz svijeta", rekao je Wouters.
Graham Dutfield, profesor na Sveučilištu u Leedsu i autor knjige o pravu na intelektualno vlasništvo i trgovinu, slaže se s Woutersom. Odricanje od patenata bez podjele znanja uspoređuje s receptom bez omjera i uputa.
"Ono što nam stvarno treba su regionalni centri diljem svijeta, u Africi, Latinskoj Americi i Oceaniji, koji će proizvoditi za globalne potrebe", zaključio je.
