Vrhovni sud Republike Hrvatske, kako je danas priopćeno, prihvatio je žalbu bivšeg državnog odvjetnika Dražena Jelenića te je ukinuo odluku Državnoodvjetničkog vijeća (DOV) kojom je Jeleniću produljeno privremeno udaljenje od obavljanja državnoodvjetničke dužnosti zamjeniku glavne državne odvjetnice na rok od daljnja tri mjeseca, piše Jutarnji.

- Vrhovni je sud postupao u okviru svoje mjerodavnosti kao drugostupanjsko tijelo u postupku za stegovnu odgovornost zamjenika državnih odvjetnika. Prihvatio je žalbu zamjenika glavne državne odvjetnice Republike Hrvatske i ukinuo prvostupanjsko rješenje Državnoodvjetničkog vijeća. Prvostupanjskim je rješenjem produljeno privremeno udaljenje od obavljanja državnoodvjetničke dužnosti zamjeniku glavne državne odvjetnice na rok od daljnja tri mjeseca", izvjestio je Vrhovni sud.

Podsjetimo, DOV je postupajući povodom zahtjeva glavne državne odvjetnice Republike Hrvatske Zlate Hrvoj Šipek 13. travnja odlučio privremeno udaljiti Jelenića od obavljanja državnoodvjetničke dužnosti zamjenika glavne državne odvjetnice na rok od tri mjeseca te je 28. travnja donijelo odluku o pokretanju stegovnog postupak protiv Jelenića.

Stegovni postupak je u tijeku

- Vrhovni sud smatra da sama činjenica da je glavna državna odvjetnica pokrenula stegovni postupak ne može biti razlog za odluku o produljenju privremenog udaljenja zamjeniku glavne državne odvjetnice. Stegovni postupak nije po automatizmu osnovan razlog koji uvjerljivo opravdava donesenu odluku o produljenju privremenog udaljenja. Zakon koji regulira takve situacije propisuje da zamjenik može biti privremeno udaljen od obavljanja dužnosti, ali to ujedno znači da to toga i ne mora doći. Po ocjeni Vrhovnoga suda odluka Državnoodvjetničkog vijeća ne sadrži valjano obrazloženje pa je nije moguće ispitati. Ako doista za vrijeme trajanja stegovnog postupka nije moguće redovno obavljanje dužnosti zamjeniku glavne državne odvjetnice, onda to treba jasno obrazložiti", ističe se u priopćenju Vrhovnog suda koji pritom daje jasnu uputu da DOV u ponovljenom postupku treba donijeti novu "na zakonu utemeljenu odluku koju će pravilno i potpuno obrazložiti i pritom otklonit uočene nedostatke".

Vrhovni sud Republike Hrvatske, kako je danas priopćeno, prihvatio je žalbu bivšeg državnog odvjetnika Dražena Jelenića te je ukinuo odluku Državnoodvjetničkog vijeća (DOV) kojom je Jeleniću produljeno privremeno udaljenje od obavljanja državnoodvjetničke dužnosti zamjeniku glavne državne odvjetnice na rok od daljnja tri mjeseca, piše Jutarnji.

- Vrhovni je sud postupao u okviru svoje mjerodavnosti kao drugostupanjsko tijelo u postupku za stegovnu odgovornost zamjenika državnih odvjetnika. Prihvatio je žalbu zamjenika glavne državne odvjetnice Republike Hrvatske i ukinuo prvostupanjsko rješenje Državnoodvjetničkog vijeća. Prvostupanjskim je rješenjem produljeno privremeno udaljenje od obavljanja državnoodvjetničke dužnosti zamjeniku glavne državne odvjetnice na rok od daljnja tri mjeseca", izvjestio je Vrhovni sud.

Podsjetimo, DOV je postupajući povodom zahtjeva glavne državne odvjetnice Republike Hrvatske Zlate Hrvoj Šipek 13. travnja odlučio privremeno udaljiti Jelenića od obavljanja državnoodvjetničke dužnosti zamjenika glavne državne odvjetnice na rok od tri mjeseca te je 28. travnja donijelo odluku o pokretanju stegovnog postupak protiv Jelenića.

Stegovni postupak je u tijeku

- Vrhovni sud smatra da sama činjenica da je glavna državna odvjetnica pokrenula stegovni postupak ne može biti razlog za odluku o produljenju privremenog udaljenja zamjeniku glavne državne odvjetnice. Stegovni postupak nije po automatizmu osnovan razlog koji uvjerljivo opravdava donesenu odluku o produljenju privremenog udaljenja. Zakon koji regulira takve situacije propisuje da zamjenik može biti privremeno udaljen od obavljanja dužnosti, ali to ujedno znači da to toga i ne mora doći. Po ocjeni Vrhovnoga suda odluka Državnoodvjetničkog vijeća ne sadrži valjano obrazloženje pa je nije moguće ispitati. Ako doista za vrijeme trajanja stegovnog postupka nije moguće redovno obavljanje dužnosti zamjeniku glavne državne odvjetnice, onda to treba jasno obrazložiti", ističe se u priopćenju Vrhovnog suda koji pritom daje jasnu uputu da DOV u ponovljenom postupku treba donijeti novu "na zakonu utemeljenu odluku koju će pravilno i potpuno obrazložiti i pritom otklonit uočene nedostatke".

Vrhovni sud Republike Hrvatske, kako je danas priopćeno, prihvatio je žalbu bivšeg državnog odvjetnika Dražena Jelenića te je ukinuo odluku Državnoodvjetničkog vijeća (DOV) kojom je Jeleniću produljeno privremeno udaljenje od obavljanja državnoodvjetničke dužnosti zamjeniku glavne državne odvjetnice na rok od daljnja tri mjeseca, piše Jutarnji.

- Vrhovni je sud postupao u okviru svoje mjerodavnosti kao drugostupanjsko tijelo u postupku za stegovnu odgovornost zamjenika državnih odvjetnika. Prihvatio je žalbu zamjenika glavne državne odvjetnice Republike Hrvatske i ukinuo prvostupanjsko rješenje Državnoodvjetničkog vijeća. Prvostupanjskim je rješenjem produljeno privremeno udaljenje od obavljanja državnoodvjetničke dužnosti zamjeniku glavne državne odvjetnice...
