Vrhovni sud Hrvatske održao je u utorak javnu sjednicu povodom žalbe Smiljane Srnec na presudu kojom je 30. lipnja ove godine osuđena na maksimalnih 15 godina zatvora zbog ubojstva sestre Jasmine u ljeto 2000. godine, piše jutarnji.hr.

Ročištem je predsjedao sudac Damir Kos. Vrhovni sud može potvrditi kaznu, preinačiti je, ali i vratiti suđenje na početak pa čak i pustiti Smiljanu Srnec na slobodu.

Smiljana Srnec je nakon što je njezin žalitelj iznio žalbu kazala da prihvaća sve što je rekao njezin odvjetnik te da nema ništa za dodati.

Sjednica vijeća Vrhovnog suda završila je u 9:32 sati. Odvjetnik Krešimir Golubić, branitelj Smiljane Srnec, po završetku sjednice nam je samo kratko rekao: - Očekujem ukidajuću presudu. Ona je jedino moguća jer je u svakoj rečenici ove žalbe izneseno proturječje u presudi koju je donio prvostupanjski sud. 

Zločin koji je potresao Hrvatsku

Zločin koji je potresao Hrvatsku otkriven je 16. veljače 2019. godine, a tijelo pokojne Jasmine bilo je gotovo 19 godina skriveno u škrinji u obiteljskoj kući u Palovcu u Novoj 29 u kojoj je Smiljana živjela s obitelji i majkom, koja je uglavnom boravila na radu u inozemstvu, a povremeno je dolazila u Palovec.

Djelo je bilo kvalificirano kao obično ubojstvo i to je tada bila maksimalna kazna, a njezin branitelj, čakovečki odvjetnik Krešimir Golubić, žalbu na 77 stranica podnio je u zakonskom roku 14. rujna ove godine. Vrhovni sud je zaprimio cijeli spis i nakon što ga je proučio, zakazao je javnu sjednicu. Kao i drugi optuženici, Smiljana Srnec dobila je priliku obratiti se sudskom vijeću videolinkom iz zatvora u Varaždinu gdje je trenutno još uvijek u istražnom zatvoru.

Obrani je jedan od bitnih dijelova žalbe to što postoji proturječje između sadržaja obrazloženja i presude u odnosu na ono što piše u zapisnicima sa suđenja koje je počelo 15. listopada prošle, a okončano je 30. lipnja ove godine. Prema stavu obrane, došlo je do bitnih povreda odredbi Zakona o kaznenom postupku, i to je jedini i temeljni razlog zbog kojeg treba ukinuti presudu, tako da se obrana nije niti bavila visinom kazne.

Za odvjetnika sporno pitanje točnog vremena ubojstva

Po njemu je sporno, i to je opširno naveo u žalbi, i pitanje točnog vremena kad se dogodilo ubojstvo i u žalbi se argumentima tvrdi da uopće nije ustanovljeno kad se to dogodilo, a kamoli da se dogodilo u ljeto 2000. godine. U slučaju bitnih povreda odredaba zakona o kaznenom postupku, ako Vrhovni sud usvoji žalbu branitelja Smiljane Srnec ne bi se raspravljalo o kazni i primjeni zakona već bi se presuda ukinula, a postupak bi možda dobio drugi sudac.

U svakom slučaju, tada bi "slučaj škrinja" i jedan od najintrigantnijih slučajeva hrvatskog pravosuđa jer je tijelo žrtve otkriveno u zamrzivaču nakon gotovo 19 godina, 16. veljače 2019. godine, bio opet na početku. Sasvim je izvjesno da bi Smiljana Srnec ponovljeno suđenje tada čekala na slobodi. Ako pak Vrhovni sud odbije žalbu njezine obrane i potvrdi joj presudu, preostaje joj još nepunih 13 godina zatvora koji sve teže podnosi.

Vrhovni sud Hrvatske održao je u utorak javnu sjednicu povodom žalbe Smiljane Srnec na presudu kojom je 30. lipnja ove godine osuđena na maksimalnih 15 godina zatvora zbog ubojstva sestre Jasmine u ljeto 2000. godine, piše jutarnji.hr.

Ročištem je predsjedao sudac Damir Kos. Vrhovni sud može potvrditi kaznu, preinačiti je, ali i vratiti suđenje na početak pa čak i pustiti Smiljanu Srnec na slobodu.

Smiljana Srnec je nakon što je njezin žalitelj iznio žalbu kazala da prihvaća sve što je rekao njezin odvjetnik te da nema ništa za dodati.

Sjednica vijeća Vrhovnog suda završila je u 9:32 sati. Odvjetnik Krešimir Golubić, branitelj Smiljane Srnec, po završetku sjednice nam je samo kratko rekao: - Očekujem ukidajuću presudu. Ona je jedino moguća jer je u svakoj rečenici ove žalbe izneseno proturječje u presudi koju je donio prvostupanjski sud. 

Zločin koji je potresao Hrvatsku

Zločin koji je potresao Hrvatsku otkriven je 16. veljače 2019. godine, a tijelo pokojne Jasmine bilo je gotovo 19 godina skriveno u škrinji u obiteljskoj kući u Palovcu u Novoj 29 u kojoj je Smiljana živjela s obitelji i majkom, koja je uglavnom boravila na radu u inozemstvu, a povremeno je dolazila u Palovec.

Djelo je bilo kvalificirano kao obično ubojstvo i to je tada bila maksimalna kazna, a njezin branitelj, čakovečki odvjetnik Krešimir Golubić, žalbu na 77 stranica podnio je u zakonskom roku 14. rujna ove godine. Vrhovni sud je zaprimio cijeli spis i nakon što ga je proučio, zakazao je javnu sjednicu. Kao i drugi optuženici, Smiljana Srnec dobila je priliku obratiti se sudskom vijeću videolinkom iz zatvora u Varaždinu gdje je trenutno još uvijek u istražnom zatvoru.

Obrani je jedan od bitnih dijelova žalbe to što postoji proturječje između sadržaja obrazloženja i presude u odnosu na ono što piše u zapisnicima sa suđenja koje je počelo 15. listopada prošle, a okončano je 30. lipnja ove godine. Prema stavu obrane, došlo je do bitnih povreda odredbi Zakona o kaznenom postupku, i to je jedini i temeljni razlog zbog kojeg treba ukinuti presudu, tako da se obrana nije niti bavila visinom kazne.

Za odvjetnika sporno pitanje točnog vremena ubojstva

Po njemu je sporno, i to je opširno naveo u žalbi, i pitanje točnog vremena kad se dogodilo ubojstvo i u žalbi se argumentima tvrdi da uopće nije ustanovljeno kad se to dogodilo, a kamoli da se dogodilo u ljeto 2000. godine. U slučaju bitnih povreda odredaba zakona o kaznenom postupku, ako Vrhovni sud usvoji žalbu branitelja Smiljane Srnec ne bi se raspravljalo o kazni i primjeni zakona već bi se presuda ukinula, a postupak bi možda dobio drugi sudac.

U svakom slučaju, tada bi "slučaj škrinja" i jedan od najintrigantnijih slučajeva hrvatskog pravosuđa jer je tijelo žrtve otkriveno u zamrzivaču nakon gotovo 19 godina, 16. veljače 2019. godine, bio opet na početku. Sasvim je izvjesno da bi Smiljana Srnec ponovljeno suđenje tada čekala na slobodi. Ako pak Vrhovni sud odbije žalbu njezine obrane i potvrdi joj presudu, preostaje joj još nepunih 13 godina zatvora koji sve teže podnosi.

Okončano ročište na Vrhovnom sudu, odvjetnik Smiljane Srnec očekuje ukidanje presude

Vrhovni sud Hrvatske održao je u utorak javnu sjednicu povodom žalbe Smiljane Srnec na presudu kojom je 30. lipnja ove godine osuđena na maksimalnih 15 godina zatvora zbog ubojstva sestre Jasmine u ljeto 2000. godine, piše jutarnji.hr.

Ročištem je predsjedao sudac Damir Kos. Vrhovni sud može potvrditi kaznu, preinačiti je, ali i vratiti suđenje na početak pa čak i pustiti Smiljanu Srnec na slobodu.

Smiljana Srnec je nakon što je njezin žalitelj iznio žalbu kazala da prihvaća sve što je rekao njezin odvjetnik te da nema ništa za dodati.

Sjednica vijeća Vrhovnog suda završila je u 9:32 sati. Odvjetnik Krešimir Golubić, branitelj Smiljane Srnec, po završetku sjednice nam je samo kratko rekao: - Očekujem ukidajuću presudu. Ona je jedino moguća jer je u svakoj...
