Udruga Franak na konferenciji za medije u četvrtak je izvijestila što znači odluka Ustavnog suda RH kojom su 3. veljače 2021. odbačene ustavne tužbe sedam hrvatskih banaka podnesene protiv presuda Vrhovnog suda Republike Hrvatske i Visokog trgovačkog suda u kolektivnom sporu koji je pokrenula Udruga Potrošač zbog nepoštenih ugovornih odredbi vezanih uz švicarski franak. Na konferenciji su, između ostalih, govorili Goran Aleksić, koordinator Ekonomsko-pravnog tima udruge Franak i odvjetnik Branko Šerić.

Na početku je Goran Aleksić zahvalio svim aktivistima koji su volontirali u udruzi Franak zadnjih 10 godina te je čestitao sucu Radovanu Dobroniću i Ustavnome sudu na dosljednoj primjeni hrvatskoga prava i prava EU-a, što je dovelo do konačnog utvrđenja ništetnosti valutne klauzule CHF i kamatne stope koja se mijenja odlukom banke za sve kredite tuženih banaka.

Ukratko je objasnio što znači odluka Ustavnog suda za potrošače sa CHF kreditima, a to je sljedeće:

1. Ukupno 125.000 potrošača koji su imali CHF kredit bilo koje vrste, bilo stambeni, bilo za motorno vozilo, bilo hipotekarni, bilo nenamjenski kredit bez hipoteke, imaju pravo na temelju privatnih tužbi dobiti sve preplaćene anuitete zbog rasta kamata i rasta tečaja CHF u njihovim kreditima.

2. Ljudi, njih 70.000, koji nisu konvertirali CHF kredite trebaju bez ikakvih čekanja i kalkulacija tužiti banke i sudski zatražiti preplaćene iznose kredita. Sa zateznim kamatama banke im duguju oko 10 milijardi kuna.

3. Ipak, 55.000 ljudi koji su konvertirali kredite trebaju pričekati na odluku Suda EU po predmetu C-567/20, nakon čega će nedvojbeno biti utvrđena prava potrošača nakon konverzije CHF kredita.

4. Svakome tužitelju pripada između 50% i 80% kunskog iznosa realiziranog kredita.

5. Tijekom ove godine rješavat će se i pitanje ništetnosti CHF ugovora, jer ugovori s ništetnom valutom i kamatom prema stavu Suda EU ništetni su u potpunosti, dapače, i Vrhovni sud RH već je nekoliko puta presudio da su ugovori s ništetnom cijenom (kamatom) ništetni u cijelosti, a CHF ugovori imaju ništetan i predmet, i cijenu.

Goran Aleksić je istaknuo i kako udruga Franak nije završila svoju aktivističku borbu s bankama, te da sada mora afirmirati i dalje pravna shvaćanja koja još nisu donesena na Vrhovnome sudu RH, a to je prije svega pitanje ništetnosti CHF ugovora, koje nakon koprivničke pravomoćne presude Županijskoga suda u Varaždinu za ništetnost dvaju ugovora postaje sve realnija opcija.

Nadalje, osim ništetnih kamata i ništetne valute CHF, kako je naveo, banke su ugovarale i ništetne izlazne naknade za prijevremenu otplatu kredita, ali i ništetne ulazne naknade za obradu kredita, pa udruga Franak mora afirmirati i ta pitanja u javnosti. Pozvao je sve bivše i sadašnje dužnike u kreditima s valutnom klauzulom CHF da se jave udruzi Franak i zatraže savjet kako tužiti banku.

U svom obraćanju Aleksić je objavio kako je nakon DORH-ova odbijanja njegove kaznene prijave protiv banaka zbog više kaznenih djela, odlučio pokrenuti kaznenu istragu na Županijskome sudu u Zagrebu, gdje ga zastupa odvjetnik Branko Šerić. Prijedlog za provođenje istrage predan je na Županijski sud u Zagrebu 15. siječnja 2021. U istrazi će svjedočiti nekoliko aktivista udruge Franak, i više drugih bitnih svjedoka.

Nakon toga je o prijedlogu govorio i njegov opunomoćeni zastupnik, odvjetnik Branko Šerić, koji je rekao da je njegov klijent podnio prijedlog za provođenje istrage na Županijskom sudu u Zagrebu protiv 88, što fizičkih, što pravnih osoba, zbog više kaznenih djela zlouporabe položaja i ovlasti, lihvarskog ugovaranja, obmanjivanja kupaca i još nekih drugih kaznenih djela.

Kako je DORH prethodno odbacio kaznenu prijavu, postupak se nastavlja u ulozi supsidijarnog tužitelja, na način da je sucu istrage podnijet prijedlog za istragu protiv tih osoba. U pitanju su, rečeno je, odgovorne osobe iz gotovo svih hrvatskih banaka koje su nudile kredite s valutnom klauzulom vezanom uz CHF. Reklamirajući siguran i stabilan financijski aranžman, bez upozorenja potrošača na rizik, obmanuli su ih, i tako su ostvarili značajnu imovinsku korist.

Aleksić je podsjetio kako je u Francuskoj državni tužitelj na kaznenom sudu dobio presudu protiv banke koja je ugovarala „švicarce“ s 15.000 Francuza, kojom je utvrđeno da je banka prevarila potrošače, da im mora vratiti novac, da im mora platiti naknadu za duševne boli, i da mora platiti kaznu u državni proračun.

Iz udruge Franak poručili su kako očekuju slično postupanje organa kaznenog progona i u Hrvatskoj, a očekuju isto tako da se udrugu Franak u svemu tome tijekom postupanja prihvati na sudu kao umješača.

Udruga Franak na konferenciji za medije u četvrtak je izvijestila što znači odluka Ustavnog suda RH kojom su 3. veljače 2021. odbačene ustavne tužbe sedam hrvatskih banaka podnesene protiv presuda Vrhovnog suda Republike Hrvatske i Visokog trgovačkog suda u kolektivnom sporu koji je pokrenula Udruga Potrošač zbog nepoštenih ugovornih odredbi vezanih uz švicarski franak. Na konferenciji su, između ostalih, govorili Goran Aleksić, koordinator Ekonomsko-pravnog tima udruge Franak i odvjetnik Branko Šerić.

Na početku je Goran Aleksić zahvalio svim aktivistima koji su volontirali u udruzi Franak zadnjih 10 godina te je čestitao sucu Radovanu Dobroniću i Ustavnome sudu na dosljednoj primjeni hrvatskoga prava i prava EU-a, što je dovelo do konačnog utvrđenja ništetnosti valutne klauzule CHF i kamatne stope koja se mijenja odlukom banke za sve kredite tuženih banaka.

Ukratko je objasnio što znači odluka Ustavnog suda za potrošače sa CHF kreditima, a to je sljedeće:

1. Ukupno 125.000 potrošača koji su imali CHF kredit bilo koje vrste, bilo stambeni, bilo za motorno vozilo, bilo hipotekarni, bilo nenamjenski kredit bez hipoteke, imaju pravo na temelju privatnih tužbi dobiti sve preplaćene anuitete zbog rasta kamata i rasta tečaja CHF u njihovim kreditima.

2. Ljudi, njih 70.000, koji nisu konvertirali CHF kredite trebaju bez ikakvih čekanja i kalkulacija tužiti banke i sudski zatražiti preplaćene iznose kredita. Sa zateznim kamatama banke im duguju oko 10 milijardi kuna.

3. Ipak, 55.000 ljudi koji su konvertirali kredite trebaju pričekati na odluku Suda EU po predmetu C-567/20, nakon čega će nedvojbeno biti utvrđena prava potrošača nakon konverzije CHF kredita.

4. Svakome tužitelju pripada između 50% i 80% kunskog iznosa realiziranog kredita.

5. Tijekom ove godine rješavat će se i pitanje ništetnosti CHF ugovora, jer ugovori s ništetnom valutom i kamatom prema stavu Suda EU ništetni su u potpunosti, dapače, i Vrhovni sud RH već je nekoliko puta presudio da su ugovori s ništetnom cijenom (kamatom) ništetni u cijelosti, a CHF ugovori imaju ništetan i predmet, i cijenu.

Goran Aleksić je istaknuo i kako udruga Franak nije završila svoju aktivističku borbu s bankama, te da sada mora afirmirati i dalje pravna shvaćanja koja još nisu donesena na Vrhovnome sudu RH, a to je prije svega pitanje ništetnosti CHF ugovora, koje nakon koprivničke pravomoćne presude Županijskoga suda u Varaždinu za ništetnost dvaju ugovora postaje sve realnija opcija.

Nadalje, osim ništetnih kamata i ništetne valute CHF, kako je naveo, banke su ugovarale i ništetne izlazne naknade za prijevremenu otplatu kredita, ali i ništetne ulazne naknade za obradu kredita, pa udruga Franak mora afirmirati i ta pitanja u javnosti. Pozvao je sve bivše i sadašnje dužnike u kreditima s valutnom klauzulom CHF da se jave udruzi Franak i zatraže savjet kako tužiti banku.

U svom obraćanju Aleksić je objavio kako je nakon DORH-ova odbijanja njegove kaznene prijave protiv banaka zbog više kaznenih djela, odlučio pokrenuti kaznenu istragu na Županijskome sudu u Zagrebu, gdje ga zastupa odvjetnik Branko Šerić. Prijedlog za provođenje istrage predan je na Županijski sud u Zagrebu 15. siječnja 2021. U istrazi će svjedočiti nekoliko aktivista udruge Franak, i više drugih bitnih svjedoka.

Nakon toga je o prijedlogu govorio i njegov opunomoćeni zastupnik, odvjetnik Branko Šerić, koji je rekao da je njegov klijent podnio prijedlog za provođenje istrage na Županijskom sudu u Zagrebu protiv 88, što fizičkih, što pravnih osoba, zbog više kaznenih djela zlouporabe položaja i ovlasti, lihvarskog ugovaranja, obmanjivanja kupaca i još nekih drugih kaznenih djela.

Kako je DORH prethodno odbacio kaznenu prijavu, postupak se nastavlja u ulozi supsidijarnog tužitelja, na način da je sucu istrage podnijet prijedlog za istragu protiv tih osoba. U pitanju su, rečeno je, odgovorne osobe iz gotovo svih hrvatskih banaka koje su nudile kredite s valutnom klauzulom vezanom uz CHF. Reklamirajući siguran i stabilan financijski aranžman, bez upozorenja potrošača na rizik, obmanuli su ih, i tako su ostvarili značajnu imovinsku korist.

Aleksić je podsjetio kako je u Francuskoj državni tužitelj na kaznenom sudu dobio presudu protiv banke koja je ugovarala „švicarce“ s 15.000 Francuza, kojom je utvrđeno da je banka prevarila potrošače, da im mora vratiti novac, da im mora platiti naknadu za duševne boli, i da mora platiti kaznu u državni proračun.

Iz udruge Franak poručili su kako očekuju slično postupanje organa kaznenog progona i u Hrvatskoj, a očekuju isto tako da se udrugu Franak u svemu tome tijekom postupanja prihvati na sudu kao umješača.

Udruga Franak na konferenciji za medije u četvrtak je izvijestila što znači odluka Ustavnog suda RH kojom su 3. veljače 2021. odbačene ustavne tužbe sedam hrvatskih banaka podnesene protiv presuda Vrhovnog suda Republike Hrvatske i Visokog trgovačkog suda u kolektivnom sporu koji je pokrenula Udruga Potrošač zbog nepoštenih ugovornih odredbi vezanih uz švicarski franak. Na konferenciji su, između ostalih, govorili Goran Aleksić, koordinator Ekonomsko-pravnog tima udruge Franak i odvjetnik Branko Šerić.
