Sindikat policijskih službenika zatražio je od Ustavnog suda RH ocjenu suglasnosti odluke Stožera civilne zaštite s Ustavom i zakonom, putem odvjetničkog društva Tus & Gržić.

Propituju vjerodostojnost same COVID potvrde, kako navode, osobito jer se njom ne dokazuje da je netko zdrav, odnosno sposoban za posao, i da nije prenositelj zarazne bolesti.

Odluka Stožera stupila je na snagu u ponedjeljak, 16. studenog. Propisano je obvezno testiranje za sve zaposlenike MUP-a najmanje dva puta u sedam dana, prilikom dolaska na posao, osim za one koji su cijepljeni ili su preboljeli bolest. Oni se trebaju testirati samo ako imaju znakove respiratorne infekcije ili druge simptome koji mogu ukazivati na koronavirus.

Oni koji odbiju testiranje ili odbiju predočiti EU digitalnu COVID potvrdu ili drugi odgovarajući dokaz, ne mogu ući ili boraviti u službenim prostorijama.

Odluka se ne odnosi na osobe čija je prisutnost nužna u zakonom propisanim postupcima pred pravosudnim, državnim i drugim tijelima, kao i na osobe kod kojih postoje kontraindikacije za cijepljenje ili dovršetak cijepljenja bilo kojim cjepivom protiv COVID-19, a što se dokazuje liječničkom potvrdom, navodi se na web stranici Sindikata.

Članovi Sindikata policijskih službenika objasnili su na svojoj web stranici, ali i na Facebooku, zašto su podnijeli navedeni zahtjev te priložili sve službene dokumente.

"U ovom trenutku, budući da će poslodavac financirati testiranje za potrebe dolaska na posao, ne smatramo to izravnim ugrožavanjem prava na rad, koje spada u ljudska prava i temeljne slobode zajamčene Ustavom RH.

Međutim s najavom Stožera civilne zaštite RH da će s danom 4. 1. 2022. godine uvjetovati dolazak na posao samo osobama koje će posjedovati EU digitalnu COVID potvrdu, a koju će moći dobiti samo ako su preboljele bolest COVID-19 ili su cijepljene te da više neće prihvaćati testiranja, ozbiljno se dovodi u pitanje ustavnost i zakonitost takve odluke. Isto tako postavlja se pitanje je li EU digitalna COVID potvrda zapravo vjerodostojna isprava, jer s njom se, između ostaloga, ne dokazuje ni da je osoba zdrava.

Kao sindikat ne ulazimo i nećemo ulaziti u raspravu je li cijepljenje dobro ili loše, niti smo za ni protiv cijepljenja, jer svatko ima pravo samostalno odlučiti želi li se cijepiti ili ne, a odluku o prisilnom cijepljenju ne može definitivno donijeti Stožer civilne zaštite RH već isključivo Hrvatski sabor, budući da bi se tim činom izravno kršila ljudska prava i temeljne slobode zajamčene Ustavom RH.

Isto tako cijepljenje, kao i EU digitalna COVID potvrda, nisu 100% jamstvo sprečavanja širenja zaraze, što dokazuje i sam Stožer civilne zaštite RH u točci 3. navedene Odluke kojom propisuje da će se obvezno testirati osobe koje imaju znakove respiratorne infekcije, druge simptome ili znakove zarazne bolesti COVID-19 bez obzira što posjeduju EU digitalnu COVID potvrdu.

Samim time EU digitalna COVID potvrda gubi svoj smisao, osim što se njom čini segregacija određene skupine ljudi koje se prisilno tjera da prihvate imunizaciju putem cjepiva, a koja je u Hrvatskoj još uvijek dobrovoljna i prepuštena samostalnoj odluci svakoj pojedinca sukladno njegovom stavu i mišljenju.

Stožer civilne zaštite RH najavio je da će se 4. 1. 2022. godine prestati prihvaćati test kao dokaz da ste zdravi i da možete doći na posao, čime će prekršiti pravo na rad kao ljudsko pravo i temeljna sloboda zajamčena Ustavom RH, a samim time dovest će u pitanje egzistenciju zaposlenika MUP-a koji iz bilo kojeg razloga ne mogu ili ne žele primiti cjepivo, a nisu preboljeli bolest COVID-19 ili su cijepljeni.

Stožer civilne zaštite RH tom najavom na mala vrata gura indirektni poziv na cijepljenje svih što je nekorektno i krajnje neprofesionalno od takvog tijela u koje bi građani trebali imati apsolutno povjerenje s obzirom na okolnosti u kojima se država nalazi.

Zna se tko može mijenjati Ustav RH i donositi odluke o obveznom cijepljenju i krajnje je licemjerno od političara da na ovakav način pokušavaju ljude zastrašiti i natjerati na nešto što inače ne bi učinili, čine jer im se nameće ugrožavanjem njihove egzistencije i egzistencije njihovih obitelji. Neka ti isti političari, ako to žele, učine to na legitiman i zakonit način u Hrvatskom saboru. Naravno da to neće učiniti jer niti imaju većinu za donošenje takve odluke, a niti to neki od njih žele, iako su i u vladajućoj koaliciji, budući da nakon takve odluke zasigurno više neće dobiti glasove od svojih birača s obzirom na činjenicu da je javnost podijeljena po ovom pitanju. Smatramo da je Vlada RH odnosno Stožer civilne zaštite RH trebao puno više poraditi na komunikaciji i edukaciji građana", navodi se na web stranici Sindikata policijskih službenika.

Sindikat policijskih službenika zatražio je od Ustavnog suda RH ocjenu suglasnosti odluke Stožera civilne zaštite s Ustavom i zakonom, putem odvjetničkog društva Tus & Gržić.

Propituju vjerodostojnost same COVID potvrde, kako navode, osobito jer se njom ne dokazuje da je netko zdrav, odnosno sposoban za posao, i da nije prenositelj zarazne bolesti.

Odluka Stožera stupila je na snagu u ponedjeljak, 16. studenog. Propisano je obvezno testiranje za sve zaposlenike MUP-a najmanje dva puta u sedam dana, prilikom dolaska na posao, osim za one koji su cijepljeni ili su preboljeli bolest. Oni se trebaju testirati samo ako imaju znakove respiratorne infekcije ili druge simptome koji mogu ukazivati na koronavirus.

Oni koji odbiju testiranje ili odbiju predočiti EU digitalnu COVID potvrdu ili drugi odgovarajući dokaz, ne mogu ući ili boraviti u službenim prostorijama.

Odluka se ne odnosi na osobe čija je prisutnost nužna u zakonom propisanim postupcima pred pravosudnim, državnim i drugim tijelima, kao i na osobe kod kojih postoje kontraindikacije za cijepljenje ili dovršetak cijepljenja bilo kojim cjepivom protiv COVID-19, a što se dokazuje liječničkom potvrdom, navodi se na web stranici Sindikata.

Članovi Sindikata policijskih službenika objasnili su na svojoj web stranici, ali i na Facebooku, zašto su podnijeli navedeni zahtjev te priložili sve službene dokumente.

"U ovom trenutku, budući da će poslodavac financirati testiranje za potrebe dolaska na posao, ne smatramo to izravnim ugrožavanjem prava na rad, koje spada u ljudska prava i temeljne slobode zajamčene Ustavom RH.

Međutim s najavom Stožera civilne zaštite RH da će s danom 4. 1. 2022. godine uvjetovati dolazak na posao samo osobama koje će posjedovati EU digitalnu COVID potvrdu, a koju će moći dobiti samo ako su preboljele bolest COVID-19 ili su cijepljene te da više neće prihvaćati testiranja, ozbiljno se dovodi u pitanje ustavnost i zakonitost takve odluke. Isto tako postavlja se pitanje je li EU digitalna COVID potvrda zapravo vjerodostojna isprava, jer s njom se, između ostaloga, ne dokazuje ni da je osoba zdrava.

Kao sindikat ne ulazimo i nećemo ulaziti u raspravu je li cijepljenje dobro ili loše, niti smo za ni protiv cijepljenja, jer svatko ima pravo samostalno odlučiti želi li se cijepiti ili ne, a odluku o prisilnom cijepljenju ne može definitivno donijeti Stožer civilne zaštite RH već isključivo Hrvatski sabor, budući da bi se tim činom izravno kršila ljudska prava i temeljne slobode zajamčene Ustavom RH.

Isto tako cijepljenje, kao i EU digitalna COVID potvrda, nisu 100% jamstvo sprečavanja širenja zaraze, što dokazuje i sam Stožer civilne zaštite RH u točci 3. navedene Odluke kojom propisuje da će se obvezno testirati osobe koje imaju znakove respiratorne infekcije, druge simptome ili znakove zarazne bolesti COVID-19 bez obzira što posjeduju EU digitalnu COVID potvrdu.

Samim time EU digitalna COVID potvrda gubi svoj smisao, osim što se njom čini segregacija određene skupine ljudi koje se prisilno tjera da prihvate imunizaciju putem cjepiva, a koja je u Hrvatskoj još uvijek dobrovoljna i prepuštena samostalnoj odluci svakoj pojedinca sukladno njegovom stavu i mišljenju.

Stožer civilne zaštite RH najavio je da će se 4. 1. 2022. godine prestati prihvaćati test kao dokaz da ste zdravi i da možete doći na posao, čime će prekršiti pravo na rad kao ljudsko pravo i temeljna sloboda zajamčena Ustavom RH, a samim time dovest će u pitanje egzistenciju zaposlenika MUP-a koji iz bilo kojeg razloga ne mogu ili ne žele primiti cjepivo, a nisu preboljeli bolest COVID-19 ili su cijepljeni.

Stožer civilne zaštite RH tom najavom na mala vrata gura indirektni poziv na cijepljenje svih što je nekorektno i krajnje neprofesionalno od takvog tijela u koje bi građani trebali imati apsolutno povjerenje s obzirom na okolnosti u kojima se država nalazi.

Zna se tko može mijenjati Ustav RH i donositi odluke o obveznom cijepljenju i krajnje je licemjerno od političara da na ovakav način pokušavaju ljude zastrašiti i natjerati na nešto što inače ne bi učinili, čine jer im se nameće ugrožavanjem njihove egzistencije i egzistencije njihovih obitelji. Neka ti isti političari, ako to žele, učine to na legitiman i zakonit način u Hrvatskom saboru. Naravno da to neće učiniti jer niti imaju većinu za donošenje takve odluke, a niti to neki od njih žele, iako su i u vladajućoj koaliciji, budući da nakon takve odluke zasigurno više neće dobiti glasove od svojih birača s obzirom na činjenicu da je javnost podijeljena po ovom pitanju. Smatramo da je Vlada RH odnosno Stožer civilne zaštite RH trebao puno više poraditi na komunikaciji i edukaciji građana", navodi se na web stranici Sindikata policijskih službenika.

Sindikat policijskih službenika zatražio je od Ustavnog suda RH ocjenu suglasnosti odluke Stožera civilne zaštite s Ustavom i zakonom, putem odvjetničkog društva Tus & Gržić.

Propituju vjerodostojnost same COVID potvrde, kako navode, osobito jer se njom ne dokazuje da je netko zdrav, odnosno sposoban za posao, i da nije prenositelj zarazne bolesti.

Odluka Stožera stupila je na snagu u ponedjeljak, 16. studenog. Propisano je obvezno testiranje za sve zaposlenike MUP-a najmanje dva puta u sedam dana, prilikom dolaska na posao, osim za one koji su cijepljeni ili su preboljeli bolest. Oni se trebaju testirati samo ako imaju znakove respiratorne infekcije ili druge simptome koji mogu ukazivati na koronavirus.
