Europski sud za ljudska prava presudio je da će zbog kršenja prava na pošteno suđenje u razumnom roku, država Hrvatska morati Milenku Vidaku, 62-godišnjem nepravomoćno osuđenom pripadniku milicije tzv. SAO Krajine isplatiti nešto više od pet tisuća eura naknade i troškova postupka.

Vidak je u prosincu prošle godine na Županijskom sudu u Zagrebu osuđen na sedam godina zatvora jer je kao pripadnik srpskih paravojnih postrojbi 29. kolovoza 1993. u Gredi Sunjskoj, tijekom oružanog sukoba između regularnih oružanih snaga Republike Hrvatske s jedne strane i srpskih paravojnih postrojbi s druge strane, usmrtio civila Stjepana Sučića iz Grede Sunjske.

Vidak je, pisalo se, za vrijeme "Oluje" pobjegao u Srbiju, a zatim se skrivao po Rusiji i Turskoj. Temeljem međunarodne tjeralice uhićen je 2009. u turskoj luci Trabzon nakon što je sišao s broda koji je doplovio iz Sočija. Godinu dana kasnije osuđen je zbog drugog zločina, također na sedam godina zatvora, zbog ubojstva Branka Runjaića u srpnju 1992. u selu Brđani, jer mu je ovaj navodno vrijeđao suprugu. Nakon što ga je Runjaić udario i prijetio mu, Vidak je u njega ispalio rafal iz automatske puške.

Dvaput osuđivan

Što se tiče ubojstva Sučića, Vidak je već dva puta bio nepravomoćno osuđivan za ovaj zločin. U prosincu 2010. godine vijeće za ratne zločine Županijskog suda u Sisku osudilo ga je na osam godina. No, Vrhovni sud je ukinuo presudu zbog bitne povrede odredaba kaznenog postupka. Na drugom suđenju dobio je šest godina zatvora, no i tu je presudu ukinuo Vrhovni sud.

Europski sud za ljudska prava ocijenio je da se ne može zanemariti da je "Vrhovni sud dva puta vratio predmet na ponovno suđenje jer prvostupanjski sud nije uspio utvrditi djelo ili djela za koja je podnositelj zahtjeva izručen, što je izazvalo kašnjenje od oko tri godine". Problem je bio u tome što u spisu nije postojao dokument zbog čega je Turska izručila Vidaka, ubojstva ili ratnog zločina. A po zakonu mu se može suditi samo za djelo ili djela za koja je izručen.

'Nakon što je Vrhovni sud 12. studenoga 2013. godine po drugi put vratio predmet, a prvostupanjski sud je 18. veljače 2014. pripremio zahtjev turskim vlastima za davanje suglasnosti da se podnositelju zahtjeva sudi za ratni zločin, trebalo je više od sedam mjeseci da se taj zahtjev i popratni dokumenti prevedu i proslijede Ministarstvu pravosuđa 15. rujna 2014. godine. Čini se da taj zahtjev nikada nije priopćen turskim vlastima', stoji, uz ostalo, u presudi Europskog suda u Strasbourgu.

Ubojstvo ili zločin?

Navode dalje da je Ministarstvo pravosuđa, nakon više od tri godine, 11. srpnja 2017. godine zatražilo od Ministarstva vanjskih i europskih poslova da se raspitaju kod turskih vlasti zašto je zahtjev za izručenjem Ministarstva pravosuđa od 20. srpnja 2009. samo djelomično odobren. Pozvali su se na odluku suda u Trabzonu od 4. kolovoza 2009., u kojoj se sugerira da je podnositelj zahtjeva izručen samo zbog ubojstva. Sredinom kolovoza 2017. godine turski MVP odgovorio je diplomatskom notom, iz čijeg je teksta ostalo nejasno jesu li turske vlasti izručile Vidaka za ratni zločin.

Potom u siječnju 2018. godine Ministarstvo pravosuđa izravno kontaktira tursko veleposlanstvo u Zagrebu, a oni krajem listopada 2018. godine prilažu odluku Pomoćnog suda u Trabzonu od 25. travnja 2018., u kojoj se pojašnjava da su se odluka od 4. kolovoza 2009. i odluka turske vlade od 19. listopada 2009. za ekstradiciju odnosile i na ubojstvo i na ratni zločin protiv civilnog stanovništva te da je izručenje odobreno za oba kaznena djela.

Zbog svega navedenog je EU sud utvrdio da se "kašnjenja ne mogu pripisati podnositelju zahtjeva" te da je duljina postupka u ovom predmetu bila pretjerana i nije bila u "razumnom roku".

Europski sud za ljudska prava presudio je da će zbog kršenja prava na pošteno suđenje u razumnom roku, država Hrvatska morati Milenku Vidaku, 62-godišnjem nepravomoćno osuđenom pripadniku milicije tzv. SAO Krajine isplatiti nešto više od pet tisuća eura naknade i troškova postupka.

Vidak je u prosincu prošle godine na Županijskom sudu u Zagrebu osuđen na sedam godina zatvora jer je kao pripadnik srpskih paravojnih postrojbi 29. kolovoza 1993. u Gredi Sunjskoj, tijekom oružanog sukoba između regularnih oružanih snaga Republike Hrvatske s jedne strane i srpskih paravojnih postrojbi s druge strane, usmrtio civila Stjepana Sučića iz Grede Sunjske.

Vidak je, pisalo se, za vrijeme "Oluje" pobjegao u Srbiju, a zatim se skrivao po Rusiji i Turskoj. Temeljem međunarodne tjeralice uhićen je 2009. u turskoj luci Trabzon nakon što je sišao s broda koji je doplovio iz Sočija. Godinu dana kasnije osuđen je zbog drugog zločina, također na sedam godina zatvora, zbog ubojstva Branka Runjaića u srpnju 1992. u selu Brđani, jer mu je ovaj navodno vrijeđao suprugu. Nakon što ga je Runjaić udario i prijetio mu, Vidak je u njega ispalio rafal iz automatske puške.

Dvaput osuđivan

Što se tiče ubojstva Sučića, Vidak je već dva puta bio nepravomoćno osuđivan za ovaj zločin. U prosincu 2010. godine vijeće za ratne zločine Županijskog suda u Sisku osudilo ga je na osam godina. No, Vrhovni sud je ukinuo presudu zbog bitne povrede odredaba kaznenog postupka. Na drugom suđenju dobio je šest godina zatvora, no i tu je presudu ukinuo Vrhovni sud.

Europski sud za ljudska prava ocijenio je da se ne može zanemariti da je "Vrhovni sud dva puta vratio predmet na ponovno suđenje jer prvostupanjski sud nije uspio utvrditi djelo ili djela za koja je podnositelj zahtjeva izručen, što je izazvalo kašnjenje od oko tri godine". Problem je bio u tome što u spisu nije postojao dokument zbog čega je Turska izručila Vidaka, ubojstva ili ratnog zločina. A po zakonu mu se može suditi samo za djelo ili djela za koja je izručen.

'Nakon što je Vrhovni sud 12. studenoga 2013. godine po drugi put vratio predmet, a prvostupanjski sud je 18. veljače 2014. pripremio zahtjev turskim vlastima za davanje suglasnosti da se podnositelju zahtjeva sudi za ratni zločin, trebalo je više od sedam mjeseci da se taj zahtjev i popratni dokumenti prevedu i proslijede Ministarstvu pravosuđa 15. rujna 2014. godine. Čini se da taj zahtjev nikada nije priopćen turskim vlastima', stoji, uz ostalo, u presudi Europskog suda u Strasbourgu.

Ubojstvo ili zločin?

Navode dalje da je Ministarstvo pravosuđa, nakon više od tri godine, 11. srpnja 2017. godine zatražilo od Ministarstva vanjskih i europskih poslova da se raspitaju kod turskih vlasti zašto je zahtjev za izručenjem Ministarstva pravosuđa od 20. srpnja 2009. samo djelomično odobren. Pozvali su se na odluku suda u Trabzonu od 4. kolovoza 2009., u kojoj se sugerira da je podnositelj zahtjeva izručen samo zbog ubojstva. Sredinom kolovoza 2017. godine turski MVP odgovorio je diplomatskom notom, iz čijeg je teksta ostalo nejasno jesu li turske vlasti izručile Vidaka za ratni zločin.

Potom u siječnju 2018. godine Ministarstvo pravosuđa izravno kontaktira tursko veleposlanstvo u Zagrebu, a oni krajem listopada 2018. godine prilažu odluku Pomoćnog suda u Trabzonu od 25. travnja 2018., u kojoj se pojašnjava da su se odluka od 4. kolovoza 2009. i odluka turske vlade od 19. listopada 2009. za ekstradiciju odnosile i na ubojstvo i na ratni zločin protiv civilnog stanovništva te da je izručenje odobreno za oba kaznena djela.

Zbog svega navedenog je EU sud utvrdio da se "kašnjenja ne mogu pripisati podnositelju zahtjeva" te da je duljina postupka u ovom predmetu bila pretjerana i nije bila u "razumnom roku".

Europski sud za ljudska prava presudio: milicajcu iz ‘Krajine‘ koji je suđen zbog ubojstva dvojice civila pet tisuća eura odštete zbog propusta hrvatskog pravosuđa

Europski sud za ljudska prava presudio je da će zbog kršenja prava na pošteno suđenje u razumnom roku, država Hrvatska morati Milenku Vidaku, 62-godišnjem nepravomoćno osuđenom pripadniku milicije tzv. SAO Krajine isplatiti nešto više od pet tisuća eura naknade i troškova postupka.

Vidak je u prosincu prošle godine na Županijskom sudu u Zagrebu osuđen na sedam godina zatvora jer je kao pripadnik srpskih paravojnih postrojbi 29. kolovoza 1993. u Gredi Sunjskoj, tijekom oružanog sukoba između regularnih oružanih snaga Republike Hrvatske s jedne strane i srpskih paravojnih postrojbi s druge strane, usmrtio civila Stjepana Sučića iz Grede Sunjske.
