Europski sud za ljudska prava zaključio je da je Hrvatska diskriminirala trudnicu kojoj je Hrvatski zavod za zdravstveno osiguranje (HZZO) odbio u punom iznosu isplatiti naknadu za čuvanje trudnoće te porodiljinu i rodiljinu naknadu.

Sud u Strasbourgu je podnositeljici dosudio naknadu za povredu prava od 7500 eura te još 1150 eura na ime troškova postupka.

Radi se o Riječanki koja je bila kontinuirano zaposlena od 1993. do 2009. kada je započela postupak umjetne oplodnje i zaposlila se u privatnoj tvrtki u Splitu, a u prosincu iste godine je saznala da je trudna.

Zatim je otvorila bolovanje radi čuvanja trudnoće koje ide na teret HZZO-a, no zavod je proveo internu istragu i zaključio da je sklopila fiktivni ugovor o radu, "znajući da je moguće da je u trenutku sklapanja ugovora trudna jer je već započela postupak oplodnje".

HZZO je smatrao da je taj ugovor sklopljen isključivo radi naknade pa je ukinuo osiguranje čime je ostala bez naknade za vrijeme trudnoće, a za vrijeme porodništva joj je bila bitno smanjena. Iako je pokrenula postupke na Visokom upravnom sudu i Ustavnom sudu njene su tužbe odbijene.

Odlučujući u ovom predmetu sud u Strasbourgu je primijetio kako je odlukama domaćih tijela "došlo do razlike u tretmanu prema trudnici koja je sklopila (fiktivni) ugovor o radu u odnosu na ostale osobe koje su također sklopile (fiktivni) ugovor o radu radi ostvarivanja prava iz osiguranja". Sud je napomenuo kako je stoga očito da takav različiti tretman trudnica predstavlja diskriminaciju na osnovi spola, izvijestio je ured hrvatske predstavnice pred Europskim sudom za ljudska prava.

Stav osiguravajućeg društva (HZZO-a) ali i domaćih sudova, da podnositeljica nije bila sposobna zaključiti ugovor o radu zbog toga što je u tom trenutku mogla znati da je trudna te da za vrijeme trudnoće zbog komplikacija neće moći raditi također predstavlja diskriminaciju trudnica te ih obeshrabruje da traže zaposlenje tijekom trudnoće ili planiranja trudnoće, ustvrdio je sud.

U presudi se upozorava i da rodna stereotipizacija koja se dogodila u ovom slučaju predstavlja ozbiljnu prepreku postizanju stvarne suštinske ravnopravnosti spolova, a što je jedan od glavnih ciljeva država članica Vijeća Europe.

Presuda još nije konačna, a to će postat ukoliko ni jedna stranka u roku od tri mjeseca ne podnese zahtjev velikom vijeću suda.

Europski sud za ljudska prava zaključio je da je Hrvatska diskriminirala trudnicu kojoj je Hrvatski zavod za zdravstveno osiguranje (HZZO) odbio u punom iznosu isplatiti naknadu za čuvanje trudnoće te porodiljinu i rodiljinu naknadu.

Sud u Strasbourgu je podnositeljici dosudio naknadu za povredu prava od 7500 eura te još 1150 eura na ime troškova postupka.

Radi se o Riječanki koja je bila kontinuirano zaposlena od 1993. do 2009. kada je započela postupak umjetne oplodnje i zaposlila se u privatnoj tvrtki u Splitu, a u prosincu iste godine je saznala da je trudna.

Zatim je otvorila bolovanje radi čuvanja trudnoće koje ide na teret HZZO-a, no zavod je proveo internu istragu i zaključio da je sklopila fiktivni ugovor o radu, "znajući da je moguće da je u trenutku sklapanja ugovora trudna jer je već započela postupak oplodnje".

HZZO je smatrao da je taj ugovor sklopljen isključivo radi naknade pa je ukinuo osiguranje čime je ostala bez naknade za vrijeme trudnoće, a za vrijeme porodništva joj je bila bitno smanjena. Iako je pokrenula postupke na Visokom upravnom sudu i Ustavnom sudu njene su tužbe odbijene.

Odlučujući u ovom predmetu sud u Strasbourgu je primijetio kako je odlukama domaćih tijela "došlo do razlike u tretmanu prema trudnici koja je sklopila (fiktivni) ugovor o radu u odnosu na ostale osobe koje su također sklopile (fiktivni) ugovor o radu radi ostvarivanja prava iz osiguranja". Sud je napomenuo kako je stoga očito da takav različiti tretman trudnica predstavlja diskriminaciju na osnovi spola, izvijestio je ured hrvatske predstavnice pred Europskim sudom za ljudska prava.

Stav osiguravajućeg društva (HZZO-a) ali i domaćih sudova, da podnositeljica nije bila sposobna zaključiti ugovor o radu zbog toga što je u tom trenutku mogla znati da je trudna te da za vrijeme trudnoće zbog komplikacija neće moći raditi također predstavlja diskriminaciju trudnica te ih obeshrabruje da traže zaposlenje tijekom trudnoće ili planiranja trudnoće, ustvrdio je sud.

U presudi se upozorava i da rodna stereotipizacija koja se dogodila u ovom slučaju predstavlja ozbiljnu prepreku postizanju stvarne suštinske ravnopravnosti spolova, a što je jedan od glavnih ciljeva država članica Vijeća Europe.

Presuda još nije konačna, a to će postat ukoliko ni jedna stranka u roku od tri mjeseca ne podnese zahtjev velikom vijeću suda.

Europski sud za ljudska prava zaključio je da je Hrvatska diskriminirala trudnicu kojoj je Hrvatski zavod za zdravstveno osiguranje (HZZO) odbio u punom iznosu isplatiti naknadu za čuvanje trudnoće te porodiljinu i rodiljinu naknadu.

Sud u Strasbourgu je podnositeljici dosudio naknadu za povredu prava od 7500 eura te još 1150 eura na ime troškova postupka.

Radi se o Riječanki koja je bila kontinuirano zaposlena od 1993. do 2009. kada je započela postupak umjetne oplodnje i zaposlila se u privatnoj tvrtki u Splitu, a u prosincu iste godine je saznala da je trudna.

Zatim je otvorila bolovanje radi čuvanja trudnoće koje ide na teret HZZO-a, no zavod je proveo internu istragu i zaključio da je sklopila fiktivni ugovor o radu, "znajući da je moguće da je u trenutku sklapanja...
