Europski sud za ljudska prava (ESLJP) zaključio je da srpske tvrtke nemaju pravo na povrat njihove prijeratne imovine, odbacivši kao neosnovanu tužbu beogradskog Mladost Turista koji je od Hrvatske tražio povrat nekretnina u Tisnom na otoku Murteru.

Ured hrvatske zastupnice pred ESLJP-om izvijestio je u petak da je presuda, koja je konačna te protiv nje nije dopušteno ni jedno pravno sredstvo, donesena 30. siječnja.

Tvrtka Mladost Turist u bivšoj državi koristila je zemljište u Tisnom na kojem je upravljala dječjim odmaralištem 'Beograd', a sada se tamo nalazi osnovna škola.

U tužbi su isticali da je država nekretnine eksproprirala nakon početka Domovinskog rata, ali i da je Hrvatska 2004. ratificirala Ugovor o pitanima sukcesije, kojim se obvezala vratiti tu imovinu vlasnicima što nikada nije učinila. Zbog toga je tvrtka tužiteljica smatrala da joj je povrijeđeno pravo na mirno uživanje prava vlasništva, zaštićeno Konvencijom za zaštitu ljudskih prava i temeljnih sloboda, izvijestio je Ured.

"Europski sud je, međutim, prihvatio pravno tumačenje hrvatskih sudova da sam Ugovor o pitanjima sukcesije (točnije, njegov Anex G), ne daje pojedinim fizičkim i pravnim osobama pravnu osnovu za povrat njihove prijeratne imovine, već da će takav povrat eventualno biti moguć tek kada bude sklopljen dodatni bilateralni ugovor između Republike Hrvatske i Republike Srbije, kojim bi se konkretizirale odredbe Anexa G. Stoga je Europski sud utvrdio da je zahtjev tvrtke podnositelja očigledno neosnovan", objavio je Ured.

Europski sud za ljudska prava (ESLJP) zaključio je da srpske tvrtke nemaju pravo na povrat njihove prijeratne imovine, odbacivši kao neosnovanu tužbu beogradskog Mladost Turista koji je od Hrvatske tražio povrat nekretnina u Tisnom na otoku Murteru.

Ured hrvatske zastupnice pred ESLJP-om izvijestio je u petak da je presuda, koja je konačna te protiv nje nije dopušteno ni jedno pravno sredstvo, donesena 30. siječnja.

Tvrtka Mladost Turist u bivšoj državi koristila je zemljište u Tisnom na kojem je upravljala dječjim odmaralištem 'Beograd', a sada se tamo nalazi osnovna škola.

U tužbi su isticali da je država nekretnine eksproprirala nakon početka Domovinskog rata, ali i da je Hrvatska 2004. ratificirala Ugovor o pitanima sukcesije, kojim se obvezala vratiti tu imovinu vlasnicima što nikada nije učinila. Zbog toga je tvrtka tužiteljica smatrala da joj je povrijeđeno pravo na mirno uživanje prava vlasništva, zaštićeno Konvencijom za zaštitu ljudskih prava i temeljnih sloboda, izvijestio je Ured.

"Europski sud je, međutim, prihvatio pravno tumačenje hrvatskih sudova da sam Ugovor o pitanjima sukcesije (točnije, njegov Anex G), ne daje pojedinim fizičkim i pravnim osobama pravnu osnovu za povrat njihove prijeratne imovine, već da će takav povrat eventualno biti moguć tek kada bude sklopljen dodatni bilateralni ugovor između Republike Hrvatske i Republike Srbije, kojim bi se konkretizirale odredbe Anexa G. Stoga je Europski sud utvrdio da je zahtjev tvrtke podnositelja očigledno neosnovan", objavio je Ured.

Europski sud donio konačan zaključak: srpske tvrtke nemaju pravo na povrat prijeratne imovine u Hrvatskoj!

Europski sud za ljudska prava (ESLJP) zaključio je da srpske tvrtke nemaju pravo na povrat njihove prijeratne imovine, odbacivši kao neosnovanu tužbu beogradskog Mladost Turista koji je od Hrvatske tražio povrat nekretnina u Tisnom na otoku Murteru.
