Ako je Filip Zavadlav osuđen za tri tzv. obična ubojstva radi se o maksimalno mogućoj kazni po našem zakonu. Raspon kazne za ubojstvo je od pet do 20 godina, a on je dobio po 15 za svako, najvjerojatnije jer je bio bitno smanjeno ubrojiv prilikom počinjenja.

Tužiteljstvo je ustrajavalo tijekom postupka da se radi o tri teška ubojstva tj. iz bezobzirne osvete za što se može dobiti dugotrajna kazna zatvora i maksimum od 50 godina. Međutim, izgleda kako je sudsko vijeće procijenilo da nije bilo dovoljno dokaza za proglašenje krivnje po takvoj optužnici.

Naime, za bezobzirnu osvetu su trebali postojati nesporni dokazi kako su ga trojica sada pokojnih iznuđivali, a o tome su tek iznesene spoznaje iz druge i treće ruke te sporadične izjave Filipa Zavadlava tijekom komunikacije s drugim osobama. O tome je u nekim izjavama govorio njegov mlađi brat Stanislav, ali je na suđenju odbio svjedočiti na što ima pravo kao tzv. privilegirani svjedok, član obitelji.

Istu privilegiju je iskoristio i otac optuženog Zavadlava. Nadalje, nisu izneseni dokazi da su pokojni: Jurica Torlak, Marin Boban i Marin Ožić Paić bili pripadnici narko miljea. Isto tako nije dokazano da je kuća u kojoj živi obitelj Jerka Malvasije bila mjesto na kojem se prodavala droga.

Znači nema dokaza da su prijetili Stanislavu ni da su iznuđivali Filipa. Nadalje, optuženi nikada nije policiji prijavio pokušaje iznude, a činjenica je da mu je brat Stanislav ovisnik o drogi koji se kretao u krugovima u kojima su bili i sada ubijeni.

Pred samo trostruko ubojstvo, tijekom 24 sata optuženi Zavadlav je svima s kim je kontaktirao govorio samo o prekidu s djevojkom koji je teško podnosio. Osim za ubojstva Zavadlav je osuđen i za općeopasnu radnju jer je hicima iz kalašnjikova umalo ranio više osoba te za nelegalno posjedovanje oružja.

Automatsku pušku je nabavio par mjeseci prije krvave subote te je s njom vježbao pucanje što je i dokumentirao video snimkom na mobitelu. Na presudu Filip Zavadlav i njegov branitelj Branko Šerić, ali i tužitelj Žarko Štrbac imaju pravo žalbe te o tome odlučuje Vrhovni sud.

Ako presuda postaje pravomoćna, Filip Zavadlav će tek nakon odsluženja polovine kazne moći zatražiti uvjetni otpust. Zbog visine kazne automatski ostaje u istražnom zatvoru do pravomoćnosti presude.

Ako je Filip Zavadlav osuđen za tri tzv. obična ubojstva radi se o maksimalno mogućoj kazni po našem zakonu. Raspon kazne za ubojstvo je od pet do 20 godina, a on je dobio po 15 za svako, najvjerojatnije jer je bio bitno smanjeno ubrojiv prilikom počinjenja.

Tužiteljstvo je ustrajavalo tijekom postupka da se radi o tri teška ubojstva tj. iz bezobzirne osvete za što se može dobiti dugotrajna kazna zatvora i maksimum od 50 godina. Međutim, izgleda kako je sudsko vijeće procijenilo da nije bilo dovoljno dokaza za proglašenje krivnje po takvoj optužnici.

Naime, za bezobzirnu osvetu su trebali postojati nesporni dokazi kako su ga trojica sada pokojnih iznuđivali, a o tome su tek iznesene spoznaje iz druge i treće ruke te sporadične izjave Filipa Zavadlava tijekom komunikacije s drugim osobama. O tome je u nekim izjavama govorio njegov mlađi brat Stanislav, ali je na suđenju odbio svjedočiti na što ima pravo kao tzv. privilegirani svjedok, član obitelji.

Istu privilegiju je iskoristio i otac optuženog Zavadlava. Nadalje, nisu izneseni dokazi da su pokojni: Jurica Torlak, Marin Boban i Marin Ožić Paić bili pripadnici narko miljea. Isto tako nije dokazano da je kuća u kojoj živi obitelj Jerka Malvasije bila mjesto na kojem se prodavala droga.

Znači nema dokaza da su prijetili Stanislavu ni da su iznuđivali Filipa. Nadalje, optuženi nikada nije policiji prijavio pokušaje iznude, a činjenica je da mu je brat Stanislav ovisnik o drogi koji se kretao u krugovima u kojima su bili i sada ubijeni.

Pred samo trostruko ubojstvo, tijekom 24 sata optuženi Zavadlav je svima s kim je kontaktirao govorio samo o prekidu s djevojkom koji je teško podnosio. Osim za ubojstva Zavadlav je osuđen i za općeopasnu radnju jer je hicima iz kalašnjikova umalo ranio više osoba te za nelegalno posjedovanje oružja.

Automatsku pušku je nabavio par mjeseci prije krvave subote te je s njom vježbao pucanje što je i dokumentirao video snimkom na mobitelu. Na presudu Filip Zavadlav i njegov branitelj Branko Šerić, ali i tužitelj Žarko Štrbac imaju pravo žalbe te o tome odlučuje Vrhovni sud.

Ako presuda postaje pravomoćna, Filip Zavadlav će tek nakon odsluženja polovine kazne moći zatražiti uvjetni otpust. Zbog visine kazne automatski ostaje u istražnom zatvoru do pravomoćnosti presude.

Ako je Filip Zavadlav osuđen za tri tzv. obična ubojstva radi se o maksimalno mogućoj kazni po našem zakonu. Raspon kazne za ubojstvo je od pet do 20 godina, a on je dobio po 15 za svako, najvjerojatnije jer je bio bitno smanjeno ubrojiv prilikom počinjenja.

Tužiteljstvo je ustrajavalo tijekom postupka da se radi o tri teška ubojstva tj. iz bezobzirne osvete za što se može dobiti dugotrajna kazna zatvora i maksimum od 50 godina. Međutim, izgleda kako je sudsko vijeće procijenilo da nije bilo dovoljno dokaza za proglašenje krivnje po takvoj optužnici.

Naime, za bezobzirnu osvetu su trebali postojati nesporni dokazi kako su ga trojica sada pokojnih iznuđivali, a o tome su tek iznesene spoznaje iz druge i treće ruke te sporadične izjave Filipa Zavadlava tijekom komunikacije...
