Danas je u Važadinu nastvaljeno suđenje Smiljani Srnec zbog ubojstva njezine sestre Jasmine Dominić.

Predsjednik sudskog vijeća Tomislav Brđanović odbio je dokazne prijedloge obrane. Prvo je odbio prijedlog o tome da se pribavi dokumentacija o otkupu otpada, a riječ je bila o odvozu škrinje u kojoj je bilo tijelo Jasmine Dominić. S obzirom na to da je kćerka Smiljane Srnec rekla da su škrinju trebali odvesti iz Sancta Domenice ustanovljeno je da se ta tvrtka ne bavi prikupljanjem otpada, piše Jutarnji list.

Odbijen je i prijedlog za strojarskim vještačenjem da se eventualno vidi do kuda se mogao otvoriti poklopac škrinje. Sudac Brđanović smatra da je i to nevažan dokaz te primijetio kako je pitanje je li zamrzivač bio u vrijeme ubojstva na istom mjestu na mjestu na kojem je bio kad je otkriveno tijelo Jasmine Dominić. Sudsko vijeće je nakon toga odlučilo izdvojiti iz spisa službene bilješke koje je policija sastavila tijekom postupka traganja za Jasminom Dominić, ali je izdvojeno još dosta službenih policijskih bilješki među kojima su i bilješke o razgovorima sa Smiljanom Srnec i njezinim suprugom Ivicom, majkom Katarinom, njezinim ujnama i ujacima, sa svjedokom Draženom Palfijem i još nekima. Izdvojen je i dio službene bilješke s policijskom službenicom Ljubicom Farkaš koja je radila na slučaju nestanka Jasmine Dominić, a sudac Brđanović je pročitao i dio njezina iskaza.

Nakon što je pročitao dio iskaza Ljubice Farkaš sudac Tomislav Brđanović pitao je Irmu Bagarić, zamjenicu županijskog državnog odvjetnika ima li ona novih dokaznih prijedloga.

- Ne - odgovorila je tužiteljica.

Na isto pitanje branitelju Krešimiru Golubiću on je odgovorio:

- Obrana predlaže ispitivanje svjedoka Petra Furdić i Eme Kovačić Matić na okolnost je li 15. veljače bio naručen odvoz škrinje za 18. veljače. Radi se o osobama iz Flora VTC i Duma elektronike. Želim istaknuti da je u ovom postupku ukupno ispitano 29 svjedoka, 17 na prijedlog tužiteljstva, a 12 na prijedlog suda, dok su svi dokazi obrane za ispitivanjem svjedoka odbijeni - rekao je odvjetnik Golubić, a sudac ga je u tom trenutku prekinuo:

- Ovo sada komentirate - rekao mu je sudac Brđanović.

- Molim Vas da mi dozvolite - rekao je odvjetnik Golubić.

- Neću Vam dozvoliti - odgovorio mu je sudac Brđanović, nakon čega je odvjetnik optužene Smiljane Srnec nastavio:

- Moja branjenica je u pritvoru danas 495. dan i njoj je najmanje u interesu odugovlačenje postupka i da on traje dulje. Ali, podsjećam da je sud dužan s jednakom pažnjom utvrđivati one dokaze koji idu u prilog optuženom. Ako smo se složili da je utvrđivanje činjenice je li bilo naručeno odvoženje škrinje važna za ovaj postupak onda to treba ustanoviti. Optuženoj se nakon gotovo 500 dana provedenih u pritvoru teško sjetiti imena osoba i brojeva koje je zvala, ali ja sam razgovarao s određenim osobama koje su mi se tako predstavile i rekle da o tome postoji dokumentacija ali da ju mogu dati samo na zahtjev suda zbog zaštite osobnih podataka. Zašto bi tjedan dana duljeg trajanja postupka bilo odugovlačenje postupka - rekao je odvjetnik Golubić.

Tužiteljica Irma Bagarić ponovila je, kako prenosi Jutarnji list, da se iz istih razloga koje je navela i jučer protivi da se izvode novi dokazi. Sudsko vijeće se opet povuklo kako bi odlučilo o prijedlogu obrane da se ispita još dvoje svjedoka je li Smiljana Srnec 15. veljače prošle godine za 18. veljače naručila odvoz zamrzivača.

Objava presude bit će 30. lipnja u 14 sati, rečeno je na kraju.

Danas je u Važadinu nastvaljeno suđenje Smiljani Srnec zbog ubojstva njezine sestre Jasmine Dominić.

Predsjednik sudskog vijeća Tomislav Brđanović odbio je dokazne prijedloge obrane. Prvo je odbio prijedlog o tome da se pribavi dokumentacija o otkupu otpada, a riječ je bila o odvozu škrinje u kojoj je bilo tijelo Jasmine Dominić. S obzirom na to da je kćerka Smiljane Srnec rekla da su škrinju trebali odvesti iz Sancta Domenice ustanovljeno je da se ta tvrtka ne bavi prikupljanjem otpada, piše Jutarnji list.

Odbijen je i prijedlog za strojarskim vještačenjem da se eventualno vidi do kuda se mogao otvoriti poklopac škrinje. Sudac Brđanović smatra da je i to nevažan dokaz te primijetio kako je pitanje je li zamrzivač bio u vrijeme ubojstva na istom mjestu na mjestu na kojem je bio kad je otkriveno tijelo Jasmine Dominić. Sudsko vijeće je nakon toga odlučilo izdvojiti iz spisa službene bilješke koje je policija sastavila tijekom postupka traganja za Jasminom Dominić, ali je izdvojeno još dosta službenih policijskih bilješki među kojima su i bilješke o razgovorima sa Smiljanom Srnec i njezinim suprugom Ivicom, majkom Katarinom, njezinim ujnama i ujacima, sa svjedokom Draženom Palfijem i još nekima. Izdvojen je i dio službene bilješke s policijskom službenicom Ljubicom Farkaš koja je radila na slučaju nestanka Jasmine Dominić, a sudac Brđanović je pročitao i dio njezina iskaza.

Nakon što je pročitao dio iskaza Ljubice Farkaš sudac Tomislav Brđanović pitao je Irmu Bagarić, zamjenicu županijskog državnog odvjetnika ima li ona novih dokaznih prijedloga.

- Ne - odgovorila je tužiteljica.

Na isto pitanje branitelju Krešimiru Golubiću on je odgovorio:

- Obrana predlaže ispitivanje svjedoka Petra Furdić i Eme Kovačić Matić na okolnost je li 15. veljače bio naručen odvoz škrinje za 18. veljače. Radi se o osobama iz Flora VTC i Duma elektronike. Želim istaknuti da je u ovom postupku ukupno ispitano 29 svjedoka, 17 na prijedlog tužiteljstva, a 12 na prijedlog suda, dok su svi dokazi obrane za ispitivanjem svjedoka odbijeni - rekao je odvjetnik Golubić, a sudac ga je u tom trenutku prekinuo:

- Ovo sada komentirate - rekao mu je sudac Brđanović.

- Molim Vas da mi dozvolite - rekao je odvjetnik Golubić.

- Neću Vam dozvoliti - odgovorio mu je sudac Brđanović, nakon čega je odvjetnik optužene Smiljane Srnec nastavio:

- Moja branjenica je u pritvoru danas 495. dan i njoj je najmanje u interesu odugovlačenje postupka i da on traje dulje. Ali, podsjećam da je sud dužan s jednakom pažnjom utvrđivati one dokaze koji idu u prilog optuženom. Ako smo se složili da je utvrđivanje činjenice je li bilo naručeno odvoženje škrinje važna za ovaj postupak onda to treba ustanoviti. Optuženoj se nakon gotovo 500 dana provedenih u pritvoru teško sjetiti imena osoba i brojeva koje je zvala, ali ja sam razgovarao s određenim osobama koje su mi se tako predstavile i rekle da o tome postoji dokumentacija ali da ju mogu dati samo na zahtjev suda zbog zaštite osobnih podataka. Zašto bi tjedan dana duljeg trajanja postupka bilo odugovlačenje postupka - rekao je odvjetnik Golubić.

Tužiteljica Irma Bagarić ponovila je, kako prenosi Jutarnji list, da se iz istih razloga koje je navela i jučer protivi da se izvode novi dokazi. Sudsko vijeće se opet povuklo kako bi odlučilo o prijedlogu obrane da se ispita još dvoje svjedoka je li Smiljana Srnec 15. veljače prošle godine za 18. veljače naručila odvoz zamrzivača.

Objava presude bit će 30. lipnja u 14 sati, rečeno je na kraju.
