Nekadašnji vijećnik HDZ-a iz kvote srpske nacionalne manjine u Gradskom vijeću Zadra i maloljetni dragovoljac Domovinskog rata, 46-godišnji Milan Drača Lalo, dobio je spor protiv Republike Hrvatske na Europskom sudu za ljudska prava u Strasbourgu (ESLJP) zbog postupka u kojem je osuđen za prijetnje bivšem zadarskom županu Stipi Zriliću.
U presudi od 20. siječnja ESLJP je jednoglasno utvrdio da je Drači u Hrvatskoj povrijeđeno pravo na pošteno suđenje. Država mu zbog toga u roku od tri mjeseca od dana kad presuda postane pravomoćna mora isplatiti 1500 eura plus sav porez koji se može naplatiti, na ime nematerijalne štete.
Zbog prijetnje tadašnjem županu Zriliću Drača je 2017. godine na Općinskom sudu u Zadru osuđen na uvjetnu zatvorsku kaznu od šest mjeseci s rokom kušnje od dvije godine. Godinu dana kasnije Županijski sud u Splitu potvrdio mu je presudu održavši sjednicu bez pozivanja stranaka.
Drača, koji se u postupku zastupao sam, zbog toga se žalio, a ESLJP mu je dao za pravo utvrdivši da splitski sud nije dao nikakve razloge zbog kojih Draču nije pozvao da prisustvuje sjednici vijeća. Istaknuli su da ga je, sukladno mjerodavnom pravu, žalbeno vijeće moglo pozvati na tu sjednicu, iako on to nije zatražio, ako je smatralo da je njegova prisutnost korisna za razjašnjenje slučaja.
– Presuda je očekivana. Tema mi je bolna i ne bih otvarao stare rane – rekao je Drača, čiji je slučaj povezan s njegovim tadašnjim otkazom u Narodnom muzeju Zadra, koji je u vlasništvu Zadarske županije. Drača je zbog otkaza došao u sukob s ravnateljicom Renatom Peroš, a nakon toga i sa županom Zrilićem. Općinsko državno odvjetništvo u Zadru optužilo ga je 2014. godine za kazneno djelo prijetnje javnoj službenoj osobi nakon što je Zriliću poslao SMS prijeteći da će ga teško ozlijediti, s ciljem da se vrati na posao koji je prije imao u Narodnom muzeju, koji je u vlasništvu Županije.
Poruke su Zrilića uznemirile pa ih je ujutro prijavio policiji. Kasnije istog dana primio je još jednu poruku od Drače u kojoj je izražavao bijes zbog toga što je morao na policijsko ispitivanje. Sljedećeg dana, 18. siječnja 2014., u 23.30 Drača je Zriliću poslao još dva SMS-a, a optužen je za sljedeću:
"Da sam vam [stvarno] prijetio, ne bih to učinio javno. Ostavi me [na miru]. Zbog svoje majke, moje obitelji [i] [političke stranke] neću... neću. Sposoban sam učiniti tvoj život pakao – čak i milosrdno i brzo slomiti tvoj vrat, C3 kralježak – a sada idi i prijavi me opet", napisao je u poruci. Zrilić je na prvostupanjskom sudu iznio da su ga poruke uplašile pa je nakon nekoliko dana ponovno otišao u policiju. Na kraju je ustvrdio da nije želio nikoga kazniti, nego samo zaštititi sebe.
Tijekom postupka Drača je naveo da SMS nije poslao kao prijetnju kako bi vratio svoj stari posao u muzeju, nego kao ironičan i ciničan odgovor Zriliću nakon što ga je prethodnog dana neopravdano prijavio policiji. Stoga je, kako je rekao, SMS poslao u privatnom svojstvu, a ne u svjetlu Zrilićeva službenog statusa, te mu se ispričao.
Zadarski je sud, međutim, zaključio da je poruka bila objektivno sposobna prouzročiti strah.

Nekadašnji vijećnik HDZ-a iz kvote srpske nacionalne manjine u Gradskom vijeću Zadra i maloljetni dragovoljac Domovinskog rata, 46-godišnji Milan Drača Lalo, dobio je spor protiv Republike Hrvatske na Europskom sudu za ljudska prava u Strasbourgu (ESLJP) zbog postupka u kojem je osuđen za prijetnje bivšem zadarskom županu Stipi Zriliću.
U presudi od 20. siječnja ESLJP je jednoglasno utvrdio da je Drači u Hrvatskoj povrijeđeno pravo na pošteno suđenje. Država mu zbog toga u roku od tri mjeseca od dana kad presuda postane pravomoćna mora isplatiti 1500 eura plus sav porez koji se može naplatiti, na ime nematerijalne štete.
Zbog prijetnje tadašnjem županu Zriliću Drača je 2017. godine na Općinskom sudu u Zadru osuđen na uvjetnu zatvorsku kaznu od šest mjeseci s rokom kušnje od dvije godine. Godinu dana kasnije Županijski sud u Splitu potvrdio mu je presudu održavši sjednicu bez pozivanja stranaka.
Drača, koji se u postupku zastupao sam, zbog toga se žalio, a ESLJP mu je dao za pravo utvrdivši da splitski sud nije dao nikakve razloge zbog kojih Draču nije pozvao da prisustvuje sjednici vijeća. Istaknuli su da ga je, sukladno mjerodavnom pravu, žalbeno vijeće moglo pozvati na tu sjednicu, iako on to nije zatražio, ako je smatralo da je njegova prisutnost korisna za razjašnjenje slučaja.
– Presuda je očekivana. Tema mi je bolna i ne bih otvarao stare rane – rekao je Drača, čiji je slučaj povezan s njegovim tadašnjim otkazom u Narodnom muzeju Zadra, koji je u vlasništvu Zadarske županije. Drača je zbog otkaza došao u sukob s ravnateljicom Renatom Peroš, a nakon toga i sa županom Zrilićem. Općinsko državno odvjetništvo u Zadru optužilo ga je 2014. godine za kazneno djelo prijetnje javnoj službenoj osobi nakon što je Zriliću poslao SMS prijeteći da će ga teško ozlijediti, s ciljem da se vrati na posao koji je prije imao u Narodnom muzeju, koji je u vlasništvu Županije.
Poruke su Zrilića uznemirile pa ih je ujutro prijavio policiji. Kasnije istog dana primio je još jednu poruku od Drače u kojoj je izražavao bijes zbog toga što je morao na policijsko ispitivanje. Sljedećeg dana, 18. siječnja 2014., u 23.30 Drača je Zriliću poslao još dva SMS-a, a optužen je za sljedeću:
"Da sam vam [stvarno] prijetio, ne bih to učinio javno. Ostavi me [na miru]. Zbog svoje majke, moje obitelji [i] [političke stranke] neću... neću. Sposoban sam učiniti tvoj život pakao – čak i milosrdno i brzo slomiti tvoj vrat, C3 kralježak – a sada idi i prijavi me opet", napisao je u poruci. Zrilić je na prvostupanjskom sudu iznio da su ga poruke uplašile pa je nakon nekoliko dana ponovno otišao u policiju. Na kraju je ustvrdio da nije želio nikoga kazniti, nego samo zaštititi sebe.
Tijekom postupka Drača je naveo da SMS nije poslao kao prijetnju kako bi vratio svoj stari posao u muzeju, nego kao ironičan i ciničan odgovor Zriliću nakon što ga je prethodnog dana neopravdano prijavio policiji. Stoga je, kako je rekao, SMS poslao u privatnom svojstvu, a ne u svjetlu Zrilićeva službenog statusa, te mu se ispričao.
Zadarski je sud, međutim, zaključio da je poruka bila objektivno sposobna prouzročiti strah.
