Još uvijek aktualni sudac zagrebačkoga Trgovačkog suda Mihael Kovačić, prvoosumnjičeni u najnovijoj aferi vezanoj uz izvlačenje novca iz stečajeva, u USKOK-u je priznao sve za što ga terete.
Ovu informaciju jučer smo doznali iz nekoliko izvora, međutim nitko je službeno nije želio potvrditi. No, da su se stvari pred kamerama u sjedištu USKOK-a odvijale upravo tako, potvrđuje i jedan vrlo uočljiv pravni pokazatelj. Naime, za razliku od ostalih osumnjičenika, inače po optužbama nižerangiranih od Kovačića, za koje je USKOK tražio određivanje istražnoga zatvora i zbog opasnosti od utjecaja na svjedoke i opasnosti od ponavljanja djela, protiv njega su tražili pritvaranje samo zbog opasnosti od ponavljanja djela, piše Jutarnji list.
Ubrzo na slobodi
Prema dosadašnjoj sudskoj praksi, to se, u pravilu, događa kad osoba prizna djelo, odnosno smatra se da nakon priznanja više ne može zapravo utjecati na svjedoke da joj pogoduju svojim iskazima. Također, vrlo je važno reći, prema sadašnjem stanju spisa po pitanju istražnoga zatvora, Kovačić iz Remetinca izlazi za najdulje 70 dana, a njegovi bi suokrivljenici, stečajni upravitelji Iva i Branko Petanjek te suradnica Aleksandra Mažić, iza rešetaka mogli ostati puno dulje.
Naime, opasnost da bi mogao ponoviti djelo kod Kovačića se vezuje isključivo za njegovu sudačku dužnost, a budući da je on već dobio razrješenje koje stupa na snagu 29. travnja, do tada će mu trajati i ta pritvorska osnova. Štoviše, bude li pokrenut postupak hitnoga razrješenja, na kojemu će i sam Kovačić sada vjerojatno inzistirati, moguće da mu se pritvor ukine i prije.
S druge strane, njegovo priznanje, kao prvoosumnjičenoga u ovome predmetu, tektonski mijenja i odnos snaga po pitanju obrana drugih okrivljenika, jer su inkriminacije protiv njega i ostalih isprepletene, te njegovo priznanje ili direktno ili indirektno tereti i druge okrivljenike. Stoga nije nemoguće, a takve smo naznake i čuli, da bi se za Kovačićevim primjerom uskoro mogli povesti i ostali okrivljenici.
Inače, nadležni sudovi širom države jučer su počeli masovno upisivati blokade niza nekretnina čije se stjecanje inkriminira Kovačiću i ostalima, a nakon što je blokadu zatražio USKOK.
Riječ je, kako neslužbeno doznajemo, o desecima nekretnina, a da će do blokade doći, nije bilo teško zaključiti budući da je ilegalno stjecanje niza nekretnina dio optužbi protiv Kovačića i ostalih.
Inače, zanimljivo je, u tijeku tajne akcije protiv Kovačića i ostalih, odnosno u fazi tajnih predistražnih radnji, u mjere je u rujnu prošle godine upala i supruga bivšega ministra zdravlja Milana Kujundžića, Tatjana Kujundžić, i to zbog teme koja je u vrijeme mandata njezina supruga bila aktualna u medijima.
Ministrova supruga
Naime, kao što je objavljeno, 2010. godine Tatjana Kujundžić je iz svoje tvrtke Zidni vrt bila otkupila vrlo vrijednu nekretninu za oko 750.000 kuna. Ono što je tu priču činilo sumnjivom bila je ranija procjena banke koja je tu istu nekretninu procjenjivala na oko 2,3 milijuna kuna, pa se postavljalo pitanje je li nekretnina iz tvrtke kupljena ispod cijene. Tvrtka Zidni vrt likvidirana je 2015. godine, a likvidator je bio stečajni upravitelj Jure Marušić. Međutim, po svemu sudeći, pitanje jedne od nekretnina tvrtke nije bilo riješeno, a 2020. godine je Tatjana Kujundžić pokrenula postupak prijenosa te nekretnine na sebe.
Policija i USKOK su Marušića, po svemu sudeći, imali pod tajnim nadzorom i u izvidima protiv Kovačića i ostalih, jer je 23. rujna 2020. godine tajno snimljen njegov razgovor s Tatjanom Kujundžić u kojemu je ona tražila od stečajnoga upravitelja da se taj predmet požuri. Marušić je nakon toga zvao Aleksandru Mažić te je Mažić podnesak Tatjane Kujundžić dala u rad sucu Kovačiću, s kojim je bila bliska, te je poslije javljala Marušiću što se događa sa spisom. Međutim, spis je ubrzo preuzeo drugi sudac koji je zaključio stečaj.

Još uvijek aktualni sudac zagrebačkoga Trgovačkog suda Mihael Kovačić, prvoosumnjičeni u najnovijoj aferi vezanoj uz izvlačenje novca iz stečajeva, u USKOK-u je priznao sve za što ga terete.
Ovu informaciju jučer smo doznali iz nekoliko izvora, međutim nitko je službeno nije želio potvrditi. No, da su se stvari pred kamerama u sjedištu USKOK-a odvijale upravo tako, potvrđuje i jedan vrlo uočljiv pravni pokazatelj. Naime, za razliku od ostalih osumnjičenika, inače po optužbama nižerangiranih od Kovačića, za koje je USKOK tražio određivanje istražnoga zatvora i zbog opasnosti od utjecaja na svjedoke i opasnosti od ponavljanja djela, protiv njega su tražili pritvaranje samo zbog opasnosti od ponavljanja djela, piše Jutarnji list.
Ubrzo na slobodi
Prema dosadašnjoj sudskoj praksi, to se, u pravilu, događa kad osoba prizna djelo, odnosno smatra se da nakon priznanja više ne može zapravo utjecati na svjedoke da joj pogoduju svojim iskazima. Također, vrlo je važno reći, prema sadašnjem stanju spisa po pitanju istražnoga zatvora, Kovačić iz Remetinca izlazi za najdulje 70 dana, a njegovi bi suokrivljenici, stečajni upravitelji Iva i Branko Petanjek te suradnica Aleksandra Mažić, iza rešetaka mogli ostati puno dulje.
Naime, opasnost da bi mogao ponoviti djelo kod Kovačića se vezuje isključivo za njegovu sudačku dužnost, a budući da je on već dobio razrješenje koje stupa na snagu 29. travnja, do tada će mu trajati i ta pritvorska osnova. Štoviše, bude li pokrenut postupak hitnoga razrješenja, na kojemu će i sam Kovačić sada vjerojatno inzistirati, moguće da mu se pritvor ukine i prije.
S druge strane, njegovo priznanje, kao prvoosumnjičenoga u ovome predmetu, tektonski mijenja i odnos snaga po pitanju obrana drugih okrivljenika, jer su inkriminacije protiv njega i ostalih isprepletene, te njegovo priznanje ili direktno ili indirektno tereti i druge okrivljenike. Stoga nije nemoguće, a takve smo naznake i čuli, da bi se za Kovačićevim primjerom uskoro mogli povesti i ostali okrivljenici.
Inače, nadležni sudovi širom države jučer su počeli masovno upisivati blokade niza nekretnina čije se stjecanje inkriminira Kovačiću i ostalima, a nakon što je blokadu zatražio USKOK.
Riječ je, kako neslužbeno doznajemo, o desecima nekretnina, a da će do blokade doći, nije bilo teško zaključiti budući da je ilegalno stjecanje niza nekretnina dio optužbi protiv Kovačića i ostalih.
Inače, zanimljivo je, u tijeku tajne akcije protiv Kovačića i ostalih, odnosno u fazi tajnih predistražnih radnji, u mjere je u rujnu prošle godine upala i supruga bivšega ministra zdravlja Milana Kujundžića, Tatjana Kujundžić, i to zbog teme koja je u vrijeme mandata njezina supruga bila aktualna u medijima.
Ministrova supruga
Naime, kao što je objavljeno, 2010. godine Tatjana Kujundžić je iz svoje tvrtke Zidni vrt bila otkupila vrlo vrijednu nekretninu za oko 750.000 kuna. Ono što je tu priču činilo sumnjivom bila je ranija procjena banke koja je tu istu nekretninu procjenjivala na oko 2,3 milijuna kuna, pa se postavljalo pitanje je li nekretnina iz tvrtke kupljena ispod cijene. Tvrtka Zidni vrt likvidirana je 2015. godine, a likvidator je bio stečajni upravitelj Jure Marušić. Međutim, po svemu sudeći, pitanje jedne od nekretnina tvrtke nije bilo riješeno, a 2020. godine je Tatjana Kujundžić pokrenula postupak prijenosa te nekretnine na sebe.
Policija i USKOK su Marušića, po svemu sudeći, imali pod tajnim nadzorom i u izvidima protiv Kovačića i ostalih, jer je 23. rujna 2020. godine tajno snimljen njegov razgovor s Tatjanom Kujundžić u kojemu je ona tražila od stečajnoga upravitelja da se taj predmet požuri. Marušić je nakon toga zvao Aleksandru Mažić te je Mažić podnesak Tatjane Kujundžić dala u rad sucu Kovačiću, s kojim je bila bliska, te je poslije javljala Marušiću što se događa sa spisom. Međutim, spis je ubrzo preuzeo drugi sudac koji je zaključio stečaj.
