Za dva dana na splitskom Županijskom sudu trebalo je biti nastavljeno suđenje Filipu Zavadlavu (25) koje se sudi za trostruko ubojstvo u Splitu iz siječnja ove godine kada je hicima iz kalašnjikova ubio Juricu Torlaka (38), Marina Ožića Paića (25) i Marina Bobana (25). No, iako je bilo plairano, suđenje se neće održati i to zato jer je Branko Šerić, Zavadlavov odvjetnik sutkinji Višnji Strinić, predsjednici peteročlanog sudskog vijeća, u ponedjeljak poslao obavijest da je pozitivan na COVID 19 te da ne može pronaći adekvatnu zamjenu.
- Točno je, pozitivan sam na koronu, imamo malo fibru i malo glavobolje. U petak navečer sam saznao za nalaz testa. Da se ovo nije dogodilo, mislim da je vrlo vjerojatno da bi Filip iznio svoju obranu, no postupak vjerojatno ne bi završio jer ja nisam bio spreman za iznošenje završnih riječi, a to sam sutkinji i kazao. Naime, u potresu mi je stradao ured i tek sam ga uspio osposobiti prije dva dana. Ali, kako su ročišta odgođena, bit će vremena - kazao nam je jučer odvjetnik Šerić dodajući da ga je, taman prije novinara, kontaktirao i sam Zavadlav iz zatvora u Gospiću.
Kazao mu je, prenio nam je Šerić, da je najvažnije da on bude dobro, a da je manje bitno kad će suđenje biti nastavljeno.
- Mogu vam još samo reći da nismo definitivno još gotovi s vještačenjem. To znači da sam se dobro pripremio - uz smješak je odgovorio Šerić, ne želeći ništa više otkriti.
Sutkinja Strinić zakazala je, obzirom na nove okolnosti, nastavak suđenja 18. prosinca i za očekivati je da će tada dokazni postupak biti i okončan.
Podsjetimo, tijekom suđenja četveročlani forenzički tim s Klinike za psihijatriju Vrapče, koji je u ožujku ove godine vještačio Zavadlava, ostao je pri stavu da je on, u vrijeme počinjenja djela bio smanjeno ubrojiv, ali ne i neubrojiv.
Ostali su i pri tvrdnji da optuženi za trostruko ubojstvo u trenutku učina nije imao akutni psihotični poremećaj, nego samo akutnu reakciju na stres, koji je kulminirao događajima prije ubojstva kao što su nespavanje, gubljenje težine, nesuvisao govor, površan pristup okolini i problemima, dezorijentiranost u vremenu i prostoru i slično.
– On je imao poremećaj prilagodbe i mješoviti poremećaj ličnosti, što nas je nagnalo da ga proglasimo smanjeno ubrojivim, ali sve ovo nabrojeno ne spada pod neubrojivost. Čak mislimo da on nije u stanju ponoviti djelo te mu se nije izrekla ni mjera obveznog pohađanja psihosocijalnog tretmana, a kamoli psihijatrijskog liječenja – rekao je na suđenju psihijatar dr. sc. Goran Arbanas.
Naravno, za konačnu odluku o kazni vrlo je bitno stanje u kojem je Zavadlav bio u trenutku kad je krenuo u ubilački pohod i tijekom njega, jer ukoliko bi bio proglašen neubrojivim onda ne bi dobio zatvorsku kaznu i ne bi veći dio svog života proveo iza zatvorskih rešetaka već bi mu bilo određeno liječenje.
Optužnica ŽDO-a Split tereti Zavadlava da je 11. siječnja ove godine u Varošu, s 37 metaka iz automatske puške, ubio Marina Bobana (24), Juricu Torlaka (38) i Marina Ožića Paića (25), koji su se u vrijeme ubojstva nalazili na dvama motorima. Osim za trostruko teško ubojstvo, tereti ga se za nedopušteno držanje oružja i za općeopasnu radnju.
Za ta kaznena djela zakonodavac predviđa maksimalnu zatvorsku kaznu u trajanju od 50 godina. Ako Zavadlava proglase neubrojivim, onda ne ide u zatvor, nego može dobiti psihijatrijsko liječenje u ustanovi zatvorenog tipa ne dulje od pet godina.

Za dva dana na splitskom Županijskom sudu trebalo je biti nastavljeno suđenje Filipu Zavadlavu (25) koje se sudi za trostruko ubojstvo u Splitu iz siječnja ove godine kada je hicima iz kalašnjikova ubio Juricu Torlaka (38), Marina Ožića Paića (25) i Marina Bobana (25). No, iako je bilo plairano, suđenje se neće održati i to zato jer je Branko Šerić, Zavadlavov odvjetnik sutkinji Višnji Strinić, predsjednici peteročlanog sudskog vijeća, u ponedjeljak poslao obavijest da je pozitivan na COVID 19 te da ne može pronaći adekvatnu zamjenu.
- Točno je, pozitivan sam na koronu, imamo malo fibru i malo glavobolje. U petak navečer sam saznao za nalaz testa. Da se ovo nije dogodilo, mislim da je vrlo vjerojatno da bi Filip iznio svoju obranu, no postupak vjerojatno ne bi završio jer ja nisam bio spreman za iznošenje završnih riječi, a to sam sutkinji i kazao. Naime, u potresu mi je stradao ured i tek sam ga uspio osposobiti prije dva dana. Ali, kako su ročišta odgođena, bit će vremena - kazao nam je jučer odvjetnik Šerić dodajući da ga je, taman prije novinara, kontaktirao i sam Zavadlav iz zatvora u Gospiću.
Kazao mu je, prenio nam je Šerić, da je najvažnije da on bude dobro, a da je manje bitno kad će suđenje biti nastavljeno.
- Mogu vam još samo reći da nismo definitivno još gotovi s vještačenjem. To znači da sam se dobro pripremio - uz smješak je odgovorio Šerić, ne želeći ništa više otkriti.
Sutkinja Strinić zakazala je, obzirom na nove okolnosti, nastavak suđenja 18. prosinca i za očekivati je da će tada dokazni postupak biti i okončan.
Podsjetimo, tijekom suđenja četveročlani forenzički tim s Klinike za psihijatriju Vrapče, koji je u ožujku ove godine vještačio Zavadlava, ostao je pri stavu da je on, u vrijeme počinjenja djela bio smanjeno ubrojiv, ali ne i neubrojiv.
Ostali su i pri tvrdnji da optuženi za trostruko ubojstvo u trenutku učina nije imao akutni psihotični poremećaj, nego samo akutnu reakciju na stres, koji je kulminirao događajima prije ubojstva kao što su nespavanje, gubljenje težine, nesuvisao govor, površan pristup okolini i problemima, dezorijentiranost u vremenu i prostoru i slično.
– On je imao poremećaj prilagodbe i mješoviti poremećaj ličnosti, što nas je nagnalo da ga proglasimo smanjeno ubrojivim, ali sve ovo nabrojeno ne spada pod neubrojivost. Čak mislimo da on nije u stanju ponoviti djelo te mu se nije izrekla ni mjera obveznog pohađanja psihosocijalnog tretmana, a kamoli psihijatrijskog liječenja – rekao je na suđenju psihijatar dr. sc. Goran Arbanas.
Naravno, za konačnu odluku o kazni vrlo je bitno stanje u kojem je Zavadlav bio u trenutku kad je krenuo u ubilački pohod i tijekom njega, jer ukoliko bi bio proglašen neubrojivim onda ne bi dobio zatvorsku kaznu i ne bi veći dio svog života proveo iza zatvorskih rešetaka već bi mu bilo određeno liječenje.
Optužnica ŽDO-a Split tereti Zavadlava da je 11. siječnja ove godine u Varošu, s 37 metaka iz automatske puške, ubio Marina Bobana (24), Juricu Torlaka (38) i Marina Ožića Paića (25), koji su se u vrijeme ubojstva nalazili na dvama motorima. Osim za trostruko teško ubojstvo, tereti ga se za nedopušteno držanje oružja i za općeopasnu radnju.
Za ta kaznena djela zakonodavac predviđa maksimalnu zatvorsku kaznu u trajanju od 50 godina. Ako Zavadlava proglase neubrojivim, onda ne ide u zatvor, nego može dobiti psihijatrijsko liječenje u ustanovi zatvorenog tipa ne dulje od pet godina.
