Uskok je u srijedu pred Županijskim sudom u Zagrebu podigao optužnicu protiv desetero okrivljenika i četiri trgovačka društva zbog utaje poreza pri uvozu 98 vozila iz EU čime su državni proračun navodno oštetili za gotovo 17 milijuna kuna.

Uskok je izvijestio da su optuženi M. I. (41), T. S. (49), M. Č. (30), M. B. (34), K. F. (69), A. M. S. (33), V. A. (60), J. P. (41), M. K. (32), I. P. (47) i četiri tvrtke zbog zločinačkog udruženja, utaje poreza ili carine, krivotvorenja službene ili poslovne isprve te pomaganja u utaji poreza ili carine u sastavu zločinačkog udruženja.

Optužnicom se M. I. i T. S. stavlja na teret da su, od prosinca 2016. do 16. siječnja 2019., u Hrvatskoj, Sloveniji i drugim državama članicama EU povezali ostale okrivljenike radi pribavljanja znatne imovinske koristi izbjegavanjem obračunavanja i plaćanja propisanih poreza i drugih naknada prilikom uvoza i daljnje prodaje osobnih vozila iz država članica EU u Hrvatsku.

Uskok je pojasnio da su okrivljenici u EU kupovali vozila visoke klase za koje su izrađivali lažne račune neistinito prikazujući promjene vlasništva. Uz to, u računima nisu iskazivali PDV, već su neosnovano prikazivali da je primijenjen posebni postupak oporezivanja marže pa u prilikom prodaje u Hrvatskoj krajnjim kupcima izdavali lažne račune okrivljenih i drugih tvrtki.

Okrivljenici su prilikom registracije u Hrvatskoj za 90 vozila prilagali krivotvorenu dokumentaciju čime su omogućili izbjegavanje plaćanja posebnog poreza na motorna vozila i naknade za gospodarenje otpadnim vozilima, dodao je Uskok.

Prema optužnici, M. I. je bio zadužen za kupovinu vozila iz inozemstva, izradu krivotvorenih računa i osiguravanje dovoljnog broja trgovačkih društava pod njihovom kontrolom, dok je T. S. kupovao vozila, osiguravao novac za njihovu kupovinu, organizirao transport i daljnju prodaju te raspolagao dobivenim novcem.

Uskok je nadodao da su M. I., T. S., M. Č. i M. B. pronalazili osobe lošeg imovinskog ili zdravstvenog stanja koje su osnivale ili preuzimale trgovačka društva nakon čega su okrivljenici preuzimali upravljanje tim tvrtkama. Okrivljenici su zatim dogovarali kupnju vozila u državama EU i organizirali njihov prijevoz do Slovenije, a potom i oglašavali prodaju vozila, izdavali ponude i predračune te preuzimali akontacije.

Nakon dogovora s kupcima, šestero okrivljenika su za vozila izrađivali lažne račune na kojima nisu iskazivali PDV te su navodili da je primijenjen poseban postupak oporezivanja marže. Lažne račune i ostalu dokumentaciju su zatim dostavljali knjigovodstvenim uredima radi izrade prijava PDV-a čime su omogućili da u njima budu navedeni neistiniti podaci o stjecanju i isporukama vozila.

Ujedno je I. P. izrađivao krivotvorena porezna rješenja i rješenja o plaćenoj naknadi za gospodarenje otpadnim vozilima na okrivljenih trgovačkih društava u kojima je lažno navedeno da su porez i naknada plaćeni, čime je omogućeno da ta društva uvezu i registriraju vozila bez prijave i plaćanja poreza i naknada. Nakon toga su M. Č., V. A., J. P. i M. K. u Hrvatskoj obavljali postupke homologacije i prve registracije vozila, pri čemu su prilagali krivotvorene punomoći i lažne račune.

Okrivljenici su na taj način oštetili državni proračun za 16,9 milijuna kuna, a Fond za zaštitu okoliša i energetsku učinkovitost s osnova naknade za gospodarenje otpadnim vozilima za 97.384 kuna, pribavivši za sebe i svoja trgovačka društva nepripadnu dobit od 11 milijuna kuna.

Uskok je u srijedu pred Županijskim sudom u Zagrebu podigao optužnicu protiv desetero okrivljenika i četiri trgovačka društva zbog utaje poreza pri uvozu 98 vozila iz EU čime su državni proračun navodno oštetili za gotovo 17 milijuna kuna.

Uskok je izvijestio da su optuženi M. I. (41), T. S. (49), M. Č. (30), M. B. (34), K. F. (69), A. M. S. (33), V. A. (60), J. P. (41), M. K. (32), I. P. (47) i četiri tvrtke zbog zločinačkog udruženja, utaje poreza ili carine, krivotvorenja službene ili poslovne isprve te pomaganja u utaji poreza ili carine u sastavu zločinačkog udruženja.

Optužnicom se M. I. i T. S. stavlja na teret da su, od prosinca 2016. do 16. siječnja 2019., u Hrvatskoj, Sloveniji i drugim državama članicama EU povezali ostale okrivljenike radi pribavljanja znatne imovinske koristi izbjegavanjem obračunavanja i plaćanja propisanih poreza i drugih naknada prilikom uvoza i daljnje prodaje osobnih vozila iz država članica EU u Hrvatsku.

Uskok je pojasnio da su okrivljenici u EU kupovali vozila visoke klase za koje su izrađivali lažne račune neistinito prikazujući promjene vlasništva. Uz to, u računima nisu iskazivali PDV, već su neosnovano prikazivali da je primijenjen posebni postupak oporezivanja marže pa u prilikom prodaje u Hrvatskoj krajnjim kupcima izdavali lažne račune okrivljenih i drugih tvrtki.

Okrivljenici su prilikom registracije u Hrvatskoj za 90 vozila prilagali krivotvorenu dokumentaciju čime su omogućili izbjegavanje plaćanja posebnog poreza na motorna vozila i naknade za gospodarenje otpadnim vozilima, dodao je Uskok.

Prema optužnici, M. I. je bio zadužen za kupovinu vozila iz inozemstva, izradu krivotvorenih računa i osiguravanje dovoljnog broja trgovačkih društava pod njihovom kontrolom, dok je T. S. kupovao vozila, osiguravao novac za njihovu kupovinu, organizirao transport i daljnju prodaju te raspolagao dobivenim novcem.

Uskok je nadodao da su M. I., T. S., M. Č. i M. B. pronalazili osobe lošeg imovinskog ili zdravstvenog stanja koje su osnivale ili preuzimale trgovačka društva nakon čega su okrivljenici preuzimali upravljanje tim tvrtkama. Okrivljenici su zatim dogovarali kupnju vozila u državama EU i organizirali njihov prijevoz do Slovenije, a potom i oglašavali prodaju vozila, izdavali ponude i predračune te preuzimali akontacije.

Nakon dogovora s kupcima, šestero okrivljenika su za vozila izrađivali lažne račune na kojima nisu iskazivali PDV te su navodili da je primijenjen poseban postupak oporezivanja marže. Lažne račune i ostalu dokumentaciju su zatim dostavljali knjigovodstvenim uredima radi izrade prijava PDV-a čime su omogućili da u njima budu navedeni neistiniti podaci o stjecanju i isporukama vozila.

Ujedno je I. P. izrađivao krivotvorena porezna rješenja i rješenja o plaćenoj naknadi za gospodarenje otpadnim vozilima na okrivljenih trgovačkih društava u kojima je lažno navedeno da su porez i naknada plaćeni, čime je omogućeno da ta društva uvezu i registriraju vozila bez prijave i plaćanja poreza i naknada. Nakon toga su M. Č., V. A., J. P. i M. K. u Hrvatskoj obavljali postupke homologacije i prve registracije vozila, pri čemu su prilagali krivotvorene punomoći i lažne račune.

Okrivljenici su na taj način oštetili državni proračun za 16,9 milijuna kuna, a Fond za zaštitu okoliša i energetsku učinkovitost s osnova naknade za gospodarenje otpadnim vozilima za 97.384 kuna, pribavivši za sebe i svoja trgovačka društva nepripadnu dobit od 11 milijuna kuna.

Uskok je u srijedu pred Županijskim sudom u Zagrebu podigao optužnicu protiv desetero okrivljenika i četiri trgovačka društva zbog utaje poreza pri uvozu 98 vozila iz EU čime su državni proračun navodno oštetili za gotovo 17 milijuna kuna.

Uskok je izvijestio da su optuženi M. I. (41), T. S. (49), M. Č. (30), M. B. (34), K. F. (69), A. M. S. (33), V. A. (60), J. P. (41), M. K. (32), I. P. (47) i četiri tvrtke zbog zločinačkog udruženja, utaje poreza ili carine, krivotvorenja službene ili poslovne isprve te pomaganja u utaji poreza ili carine u sastavu zločinačkog udruženja.

Optužnicom se M. I. i T. S. stavlja na teret da su, od prosinca 2016. do 16. siječnja 2019., u Hrvatskoj, Sloveniji i drugim državama članicama EU povezali ostale okrivljenike...
