Županijski sud u Rijeci potvrdio je odluku Općinskog suda po kojoj se zbog zastare zaključuje postupak protiv umirovljenog riječkog kirurga Branka Popovića za nesavjesno liječenje iz nehaja Miroslava Maškarina, kojemu je kasnije morala biti amputirana noga.

Županijski sud je tu odluku potvrdio u drugostupanjskom postupku 30. siječnja, potvređeno je u petak, 8. veljače sa Županijskog suda.

Na prvostupanjsku presudu žalio se i Miroslav Maškarin, ali je njegova žalba odbačena jer tijekom postupka protiv Popovića nije imao svojstvo oštećenika tužitelja, nego je u svojstvu tužitelja djelovalo državno odvjetništvo.

Branko Popović bio je optužen da je u srpnju 2006. godine nedovoljno oprezno uvodio operativni instrument troakar pri laporoskopskoj operaciji uklanjanja slijepog crijeva tada 21-godišnjem Maškarinu te probio trbušnu aortu. Zbog gubitka krvi nepovrtano mu je oštećeno tkivo pa mu se morala amputirati noga. Oštećen mu je i dio unutarnjih organa.

Utvrđeno je da je, zbog promjene zakona, zastara u tom predmetu nastupila još 2014. godine. Naime, Popović je bio nepravomoćno osuđen sredinom rujna 2011. godine na Općinskom sudu u Rijeci na osam mjeseci zatvora uvjetno na dvije godine.

Temeljem žalbi je Županijski sud u Rijeci u listopadu 2012. godine ukinuo presudu i vratio predmet na novo suđenje, koje je počelo u svibnju 2013. 

 No, početkom te godine na snagu je stupio novi Kazneni zakon, po kojem se za ovakvu vrstu kažnjivih djela predviđa zatvorska kazna najdulje godine dana, za razliku od dotadašnjih kazni u rasponu od šest mjeseci do pet godina zatvora. U skladu s time, utvrđeno je da je zastara nastupila još u srpnju 2014. godine.

Županijski sud u Rijeci potvrdio je odluku Općinskog suda po kojoj se zbog zastare zaključuje postupak protiv umirovljenog riječkog kirurga Branka Popovića za nesavjesno liječenje iz nehaja Miroslava Maškarina, kojemu je kasnije morala biti amputirana noga.

Županijski sud je tu odluku potvrdio u drugostupanjskom postupku 30. siječnja, potvređeno je u petak, 8. veljače sa Županijskog suda.

Na prvostupanjsku presudu žalio se i Miroslav Maškarin, ali je njegova žalba odbačena jer tijekom postupka protiv Popovića nije imao svojstvo oštećenika tužitelja, nego je u svojstvu tužitelja djelovalo državno odvjetništvo.

Branko Popović bio je optužen da je u srpnju 2006. godine nedovoljno oprezno uvodio operativni instrument troakar pri laporoskopskoj operaciji uklanjanja slijepog crijeva tada 21-godišnjem Maškarinu te probio trbušnu aortu. Zbog gubitka krvi nepovrtano mu je oštećeno tkivo pa mu se morala amputirati noga. Oštećen mu je i dio unutarnjih organa.

Utvrđeno je da je, zbog promjene zakona, zastara u tom predmetu nastupila još 2014. godine. Naime, Popović je bio nepravomoćno osuđen sredinom rujna 2011. godine na Općinskom sudu u Rijeci na osam mjeseci zatvora uvjetno na dvije godine.

Temeljem žalbi je Županijski sud u Rijeci u listopadu 2012. godine ukinuo presudu i vratio predmet na novo suđenje, koje je počelo u svibnju 2013. 

 No, početkom te godine na snagu je stupio novi Kazneni zakon, po kojem se za ovakvu vrstu kažnjivih djela predviđa zatvorska kazna najdulje godine dana, za razliku od dotadašnjih kazni u rasponu od šest mjeseci do pet godina zatvora. U skladu s time, utvrđeno je da je zastara nastupila još u srpnju 2014. godine.
