Siniša Dodoja godinama je poznat kao osoba koju se povezuje s domaćim krim-miljeom. Pravomoćno je prije desetak godina osuđen zbog šverca 100 kilograma heroina, a i sada mu se sudi zbog optužbi da je pripadao zločinačkoj grupi koja je početkom prošle godine švercala drogu iz BiH i Albanije. Međutim, sada je na Europskom sudu za ljudska prava u Strasbourgu dokazao da je 2013. u Hrvatskoj nepravedno kažnjen s osam godina zatvora zbog zlouporabe narkotika. Od dosuđenih osam godina odležao je sedam, piše Telegram.

Suđenje mu, kaže Europski sud, nije bilo pravedno jer je presuda donesena na temelju iskaza suokrivljenog Samija Bajramija. Njegovo priznanje, koje je dao tijekom policijskog ispitivanja u nazočnosti odvjetnika, Dodoja nije uspio propitati u nastavku procesa. Naime, Bajrami je kasnije priznanje povukao, a nakon što je pušten iz istražnog zatvora izgubio mu se svaki trag.

Priznanje kao važan dokaz

No Bajramijevo priznanje iz policije uzeto je u obzir kao relevantan dokaz. Sada Europski sud za ljudska prava kaže da to nije bilo OK, pa će Dodoji Hrvatska platiti nešto više od 26 tisuća kuna naknade zbog nepravednog suđenja. Dodoji se sudilo na Županijskom sudu u Zagrebu još 2010., a 2013. osuđujuća presuda skupini kojoj je pripadao potvrđena je na Vrhovnom sudu RH. Iako se žalio i Ustavnom sudu, tužba mu je odbijena. Dakle i za Ustavni sud proces je bio pravedan.

Dodoja je tvrdio da nije bilo u skladu s načelom pravičnosti suđenja to što je prihvaćen Bajramijev iskaz kojeg je dao nakon uhićenja policijskim istražiteljima.

Detalji spornog iskaza

Bajrami je tada potvrdio da je, nakon što je policija u Italiji uhitila vozača koji je prevozio drogu koju je on nabavljao, i dalje bio u novčanim problemima. Tada su ga u Makedoniji posjetila dva čovjeka iz Srbije, koji su mu se predstavili kao Veton i Čamilj. Ponudili su mu prijevoz heroina do Splita, na što je on pristao. Uslijedili su telefonski dogovori i sastanak nedaleko granice sa Srbijom.

Veton i Čamilj utrpali su mu drogu u automobil, a on je prema Hrvatskoj nastavio preko Bajakova. Vozio je dalje do Zagreba, pa preko Knina do Klisa. Veton i Čamilj su ga cijelo vrijeme slijedili. Kod Knina ili Vrlike kontaktirao je Šekija, što je nadimak Siniše Dodoje. Šeki je drogu preuzeo od Bajramija. Kao nagradu je Bajrami dobio 500 eura po kilogramu heroina, piše Telegram.

Susret sa Šekijem u Split

Dodoja se u svojoj obrani prisjetio tog susreta. “Rekao mi je da će doći k meni u Split kako bi mi prenio poruku jednog mog prijatelja Albanca. Kad smo se sastali tražio je da mu posudim dvije tisuće eura, te da mu pomognem naći kupca za dva-tri kilograma heroina”, pričao je Dodoja na suđenju 2010. godine. Priznao je da je doista i pronašao kupca, no Bajrami nije kod sebe imao drogu, pa je otišao iz Splita.

Nakon par dana ipak je donio heroin koji su prodali. “Kupac me ubrzo zvao i pitao me što sam mu to uvalio. Naime, umjesto heroina dobio je paracetamol”, pričao je Dodoja. I u drugom pokušaju Bajrami je navodno donio nešto što nije bila prava droga.

Zašto iskaz nije dokaz?

Europski sud za ljudska prava utvrdio je kako je Bajramijev iskaz iz policije bio vrlo značajan za donošenje osuđujuće presude iako nije bio jedini dokaz. Kako ga je on nakon početka suđenja povukao, njegove tvrdnje nisu propitane, odnosno obrana mu nije imala priliku postavljati pitanja. Zbog toga je Dodoji povrijeđeno pravo na jednakost oružja, te u konačnici sud zaključuje da mu je cijelo suđenje bilo nepravedno.

Nakon ovakve odluke Europskog suda za ljudska prava Siniša Dodoja ima mogućnost u Hrvatskoj zatražiti obnovu postupka zbog krijumčarenja heroina između listopada 2004. i listopada 2005. za što je bio pravomoćno osuđen. Njegov odvjetnik Ljubo Pavasović Visković potvrdio je za Telegram da će to i učiniti.

Siniša Dodoja godinama je poznat kao osoba koju se povezuje s domaćim krim-miljeom. Pravomoćno je prije desetak godina osuđen zbog šverca 100 kilograma heroina, a i sada mu se sudi zbog optužbi da je pripadao zločinačkoj grupi koja je početkom prošle godine švercala drogu iz BiH i Albanije. Međutim, sada je na Europskom sudu za ljudska prava u Strasbourgu dokazao da je 2013. u Hrvatskoj nepravedno kažnjen s osam godina zatvora zbog zlouporabe narkotika. Od dosuđenih osam godina odležao je sedam, piše Telegram.

Suđenje mu, kaže Europski sud, nije bilo pravedno jer je presuda donesena na temelju iskaza suokrivljenog Samija Bajramija. Njegovo priznanje, koje je dao tijekom policijskog ispitivanja u nazočnosti odvjetnika, Dodoja nije uspio propitati u nastavku procesa. Naime, Bajrami je kasnije priznanje povukao, a nakon što je pušten iz istražnog zatvora izgubio mu se svaki trag.

Priznanje kao važan dokaz

No Bajramijevo priznanje iz policije uzeto je u obzir kao relevantan dokaz. Sada Europski sud za ljudska prava kaže da to nije bilo OK, pa će Dodoji Hrvatska platiti nešto više od 26 tisuća kuna naknade zbog nepravednog suđenja. Dodoji se sudilo na Županijskom sudu u Zagrebu još 2010., a 2013. osuđujuća presuda skupini kojoj je pripadao potvrđena je na Vrhovnom sudu RH. Iako se žalio i Ustavnom sudu, tužba mu je odbijena. Dakle i za Ustavni sud proces je bio pravedan.

Dodoja je tvrdio da nije bilo u skladu s načelom pravičnosti suđenja to što je prihvaćen Bajramijev iskaz kojeg je dao nakon uhićenja policijskim istražiteljima.

Detalji spornog iskaza

Bajrami je tada potvrdio da je, nakon što je policija u Italiji uhitila vozača koji je prevozio drogu koju je on nabavljao, i dalje bio u novčanim problemima. Tada su ga u Makedoniji posjetila dva čovjeka iz Srbije, koji su mu se predstavili kao Veton i Čamilj. Ponudili su mu prijevoz heroina do Splita, na što je on pristao. Uslijedili su telefonski dogovori i sastanak nedaleko granice sa Srbijom.

Veton i Čamilj utrpali su mu drogu u automobil, a on je prema Hrvatskoj nastavio preko Bajakova. Vozio je dalje do Zagreba, pa preko Knina do Klisa. Veton i Čamilj su ga cijelo vrijeme slijedili. Kod Knina ili Vrlike kontaktirao je Šekija, što je nadimak Siniše Dodoje. Šeki je drogu preuzeo od Bajramija. Kao nagradu je Bajrami dobio 500 eura po kilogramu heroina, piše Telegram.

Susret sa Šekijem u Split

Dodoja se u svojoj obrani prisjetio tog susreta. “Rekao mi je da će doći k meni u Split kako bi mi prenio poruku jednog mog prijatelja Albanca. Kad smo se sastali tražio je da mu posudim dvije tisuće eura, te da mu pomognem naći kupca za dva-tri kilograma heroina”, pričao je Dodoja na suđenju 2010. godine. Priznao je da je doista i pronašao kupca, no Bajrami nije kod sebe imao drogu, pa je otišao iz Splita.

Nakon par dana ipak je donio heroin koji su prodali. “Kupac me ubrzo zvao i pitao me što sam mu to uvalio. Naime, umjesto heroina dobio je paracetamol”, pričao je Dodoja. I u drugom pokušaju Bajrami je navodno donio nešto što nije bila prava droga.

Zašto iskaz nije dokaz?

Europski sud za ljudska prava utvrdio je kako je Bajramijev iskaz iz policije bio vrlo značajan za donošenje osuđujuće presude iako nije bio jedini dokaz. Kako ga je on nakon početka suđenja povukao, njegove tvrdnje nisu propitane, odnosno obrana mu nije imala priliku postavljati pitanja. Zbog toga je Dodoji povrijeđeno pravo na jednakost oružja, te u konačnici sud zaključuje da mu je cijelo suđenje bilo nepravedno.

Nakon ovakve odluke Europskog suda za ljudska prava Siniša Dodoja ima mogućnost u Hrvatskoj zatražiti obnovu postupka zbog krijumčarenja heroina između listopada 2004. i listopada 2005. za što je bio pravomoćno osuđen. Njegov odvjetnik Ljubo Pavasović Visković potvrdio je za Telegram da će to i učiniti.

Siniša Dodoja godinama je poznat kao osoba koju se povezuje s domaćim krim-miljeom. Pravomoćno je prije desetak godina osuđen zbog šverca 100 kilograma heroina, a i sada mu se sudi zbog optužbi da je pripadao zločinačkoj grupi koja je početkom prošle godine švercala drogu iz BiH i Albanije. Međutim, sada je na Europskom sudu za ljudska prava u Strasbourgu dokazao da je 2013. u Hrvatskoj nepravedno kažnjen s osam godina zatvora zbog zlouporabe narkotika. Od dosuđenih osam godina odležao je sedam, piše Telegram.

Suđenje mu, kaže Europski sud, nije bilo pravedno jer je presuda donesena na temelju iskaza suokrivljenog Samija Bajramija. Njegovo priznanje, koje je dao tijekom policijskog ispitivanja u nazočnosti odvjetnika, Dodoja nije uspio propitati u nastavku...
