Još od 2017. godine hrvatski poreznici redovito izvještavaju javnost o tome tko im ne plaća porez pa onda u pravilnim razmacima objave takozvanu listu srama koja, kako ju je zamislio nekadašnji ministar financija Slavko Linić, funkcionira kao neka vrsta drugarske kritike dužnicima.

Očekuje se valjda da će dio poreznih neplatiša, suočen s teškom blamažom kad mu znatiželjna svjetina uoči ime i prezime na tome spisku, odmah nahrupiti na šalter i podmiriti dug. Aha, hoće... Evo svi lete, crveni od stida i srama!

Istina, i ove godine, kad se čovjek dobro zabulji u ovogodišnju "top listu", uoči i da su neki izbjegli biti navedeni na popisu. Naime, kako je priopćila Porezna uprava, 1541 dužnik s pojedinačnim dugom većim od 39.816,84 eura ukupno je nabio 550,34 milijuna eura duga.

No, na listi je objavljeno samo 1519 imena s dugom od 543 milijuna eura, što znači da je Porezna uprava, iz samo njima poznatih razloga, neka imena "izgubila u prijevodu", njih 22 koji su ukupno dužni 7,33 milijuna eura. Nikakvo objašnjenje poreznici nisu objavili vezano uz ovaj "previd" pa se čovjek zdravo zapita – čemu uopće služi ovakva lista ako na njoj nisu baš svi, svi do jednoga?

S druge strane, iza svakog od objavljenih imena postoji neka priča, a ta priča je često i pravosudna, odnosno mnoge od navedenih pravnih i fizičkih osoba u sudskome su sporu s državom vezano upravo uz porezna dugovanja, pa je lista srama zapravo tek izvansudski pritisak na jednu od strana u postupku.

Da se razumijemo, nemam ni najmanje simpatije spram onih koji svoje zakonom propisane obveze na bilo koji način izbjegavaju, ali... Porezni sustav ne može biti utemeljen na simpatijama, niti na individualnim osobinama bilo koga od nas, porezni sustav ne smije ovisiti o volji obveznika da obvezu poštuje ili ne poštuje.

Da upotrijebimo već otrcanu stilsku figuru – Al Capone je svršio u zatvor ne zbog svojih mafijaških poslova, nego zbog trivijalnih poreznih eskivaža. On je, znat će ljubitelji povijesne kriminalističke literature, 24. listopada 1931., u sudskom postupku koji je trajao samo tjedan dana, osuđen na 11 godina zatvora. Osim toga, kažnjen je s 50 tisuća dolara globe i naloženo mu je da plati zaostali porez od 215 tisuća dolara, koji bi sada vrijedili nešto manje od tri i pol milijuna dolara.

Kod nas, međutim, porezni dug glatko zastari u roku od šest godina. Tijekom šest godina država – jer ovdje je riječ o državi! – nije u stanju naplatiti dugovanja brojnim Al Caponeima iz našeg sokaka pa dugovanja odlaze u vjetar.

Tko je jamio, jamio je! Samo ove godine, u zastaru je otišlo ukupno 80.065.302 eura, odnosno 603.252.017 kuna. Preko osamdeset milijuna eura! Divotica... I, da se ne lažemo, tako je iz godine u godinu.

Iz godine u godinu milijuni eura ostanu trajno nenaplaćeni i nenaplativi jer je dugovanjima "istekao rok", a na tu otužnu činjenicu nije, čini se, nimalo utjecala činjenica što je Porezna uprava uz veliku pompu još 2017. godine počela paziti na zastaru po službenoj dužnosti, a da unutar Uprave postoji i služba koju su od milja kolokvijalno nazvali "porezni Uskok". S takvom službom Al Capone bi, da slučajno uskrsne u Hrvatskoj, naprosto procvjetao...

Još od 2017. godine hrvatski poreznici redovito izvještavaju javnost o tome tko im ne plaća porez pa onda u pravilnim razmacima objave takozvanu listu srama koja, kako ju je zamislio nekadašnji ministar financija Slavko Linić, funkcionira kao neka vrsta drugarske kritike dužnicima.

Očekuje se valjda da će dio poreznih neplatiša, suočen s teškom blamažom kad mu znatiželjna svjetina uoči ime i prezime na tome spisku, odmah nahrupiti na šalter i podmiriti dug. Aha, hoće... Evo svi lete, crveni od stida i srama!

Istina, i ove godine, kad se čovjek dobro zabulji u ovogodišnju "top listu", uoči i da su neki izbjegli biti navedeni na popisu. Naime, kako je priopćila Porezna uprava, 1541 dužnik s pojedinačnim dugom većim od 39.816,84 eura ukupno je nabio 550,34 milijuna eura duga.

No, na listi je objavljeno samo 1519 imena s dugom od 543 milijuna eura, što znači da je Porezna uprava, iz samo njima poznatih razloga, neka imena "izgubila u prijevodu", njih 22 koji su ukupno dužni 7,33 milijuna eura. Nikakvo objašnjenje poreznici nisu objavili vezano uz ovaj "previd" pa se čovjek zdravo zapita – čemu uopće služi ovakva lista ako na njoj nisu baš svi, svi do jednoga?

S druge strane, iza svakog od objavljenih imena postoji neka priča, a ta priča je često i pravosudna, odnosno mnoge od navedenih pravnih i fizičkih osoba u sudskome su sporu s državom vezano upravo uz porezna dugovanja, pa je lista srama zapravo tek izvansudski pritisak na jednu od strana u postupku.

Da se razumijemo, nemam ni najmanje simpatije spram onih koji svoje zakonom propisane obveze na bilo koji način izbjegavaju, ali... Porezni sustav ne može biti utemeljen na simpatijama, niti na individualnim osobinama bilo koga od nas, porezni sustav ne smije ovisiti o volji obveznika da obvezu poštuje ili ne poštuje.

Da upotrijebimo već otrcanu stilsku figuru – Al Capone je svršio u zatvor ne zbog svojih mafijaških poslova, nego zbog trivijalnih poreznih eskivaža. On je, znat će ljubitelji povijesne kriminalističke literature, 24. listopada 1931., u sudskom postupku koji je trajao samo tjedan dana, osuđen na 11 godina zatvora. Osim toga, kažnjen je s 50 tisuća dolara globe i naloženo mu je da plati zaostali porez od 215 tisuća dolara, koji bi sada vrijedili nešto manje od tri i pol milijuna dolara.

Kod nas, međutim, porezni dug glatko zastari u roku od šest godina. Tijekom šest godina država – jer ovdje je riječ o državi! – nije u stanju naplatiti dugovanja brojnim Al Caponeima iz našeg sokaka pa dugovanja odlaze u vjetar.

Tko je jamio, jamio je! Samo ove godine, u zastaru je otišlo ukupno 80.065.302 eura, odnosno 603.252.017 kuna. Preko osamdeset milijuna eura! Divotica... I, da se ne lažemo, tako je iz godine u godinu.

Iz godine u godinu milijuni eura ostanu trajno nenaplaćeni i nenaplativi jer je dugovanjima "istekao rok", a na tu otužnu činjenicu nije, čini se, nimalo utjecala činjenica što je Porezna uprava uz veliku pompu još 2017. godine počela paziti na zastaru po službenoj dužnosti, a da unutar Uprave postoji i služba koju su od milja kolokvijalno nazvali "porezni Uskok". S takvom službom Al Capone bi, da slučajno uskrsne u Hrvatskoj, naprosto procvjetao...
