Odvjetnik Mijo Jeličić objasnio je zašto je njegovo klijentu Tonću Omrčenu odbačena privremena mjera vezana za slučaj parkinga na Gripama i što to zapravo znači:

⁃ Nakon što se dogodila poznata noćna akcija, pokušali smo postići kompromis s Gradom i to riješiti na pristojan i civiliziran način. Kada smo vidjeli da neće biti dogovora jer, na sve prijedloge i na ono što smo mi isticali kao bitno, naišli smo na šutnju Grada - kazao je, te dodao:

- Doduše jedan put su me dogradonačelnik Bojan Ivošević i gradonačelnik Ivica Puljak primili na sastanak, kada sam iznio konkretan prijedlog da se postavimo na pozicijama na kojima smo danas i da se odreknemo potraživanja prema Gradu, a Grad neka zadrži svoje pravo traženja raskida ugovora itd., samo da možemo nastaviti raditi i poslovati na parkingu dok god to bude moguće - dok je ugovor na snazi. Oni su to odbili i u toj situaciji smo mi, kada smo vidjeli da nema kompromisnog rješenja, podnijeli prijedlog za privremenom mjerom, koja je sudu predložena tako da se zatvori parkiralište i spriječi ulazak osim preko rampe uz naplatu, kako bi se spriječilo to nasilje i da se spriječi daljnja šteta.

⁃ Sud je proveo postupak i utvrdio činjenicu, koju Grad nažalost prešućuje ili privremenu mjeru nisu dobro pogledali, da postoji tražbina društva “My Way” u smislu prava korištenja parkinga sukladno ugovoru. Ključna je činjenica da je "My Way" koristeći zakonski institut samopomoći postavio betonske pregrade i tako je ponovo omogućio funkcioniranje parkirališta sukladno njegovoj namjeni. Kako sad imamo mirno stanje, a Grad i Ustanova sportski objekti su izjavili pred sudom da neće nasilno mijenjati stanje niti poduzimati jednostrane akcije, osim na legalan način pred sudom, sud je zaključio da više ne prijeti nastanak štete i da više nema nasilja. Znači, razlog zbog kojeg sud odbija privremenu mjeru je taj što gospodin Omrčen sada na miran način koristi stvar koja je u zakupu, a ne zato što on i njegova firma nemaju pravo koristi parking - kazao je odvjetnik.

Znači, prema njegovim riječima, privremena mjera je postala nepotrebna nakon što je Omrčen koristeći institut samopomoći postavio betonske pregrade.

⁃ U tijeku je parnica radi smetanja posjeda. Grad je najavio parnicu radi raskida ugovora i vidjet ćemo hoće li do toga doći - za kraj će Jeličić.

Odvjetnik Mijo Jeličić objasnio je zašto je njegovo klijentu Tonću Omrčenu odbačena privremena mjera vezana za slučaj parkinga na Gripama i što to zapravo znači:

⁃ Nakon što se dogodila poznata noćna akcija, pokušali smo postići kompromis s Gradom i to riješiti na pristojan i civiliziran način. Kada smo vidjeli da neće biti dogovora jer, na sve prijedloge i na ono što smo mi isticali kao bitno, naišli smo na šutnju Grada - kazao je, te dodao:

- Doduše jedan put su me dogradonačelnik Bojan Ivošević i gradonačelnik Ivica Puljak primili na sastanak, kada sam iznio konkretan prijedlog da se postavimo na pozicijama na kojima smo danas i da se odreknemo potraživanja prema Gradu, a Grad neka zadrži svoje pravo traženja raskida ugovora itd., samo da možemo nastaviti raditi i poslovati na parkingu dok god to bude moguće - dok je ugovor na snazi. Oni su to odbili i u toj situaciji smo mi, kada smo vidjeli da nema kompromisnog rješenja, podnijeli prijedlog za privremenom mjerom, koja je sudu predložena tako da se zatvori parkiralište i spriječi ulazak osim preko rampe uz naplatu, kako bi se spriječilo to nasilje i da se spriječi daljnja šteta.

⁃ Sud je proveo postupak i utvrdio činjenicu, koju Grad nažalost prešućuje ili privremenu mjeru nisu dobro pogledali, da postoji tražbina društva “My Way” u smislu prava korištenja parkinga sukladno ugovoru. Ključna je činjenica da je "My Way" koristeći zakonski institut samopomoći postavio betonske pregrade i tako je ponovo omogućio funkcioniranje parkirališta sukladno njegovoj namjeni. Kako sad imamo mirno stanje, a Grad i Ustanova sportski objekti su izjavili pred sudom da neće nasilno mijenjati stanje niti poduzimati jednostrane akcije, osim na legalan način pred sudom, sud je zaključio da više ne prijeti nastanak štete i da više nema nasilja. Znači, razlog zbog kojeg sud odbija privremenu mjeru je taj što gospodin Omrčen sada na miran način koristi stvar koja je u zakupu, a ne zato što on i njegova firma nemaju pravo koristi parking - kazao je odvjetnik.

Znači, prema njegovim riječima, privremena mjera je postala nepotrebna nakon što je Omrčen koristeći institut samopomoći postavio betonske pregrade.

⁃ U tijeku je parnica radi smetanja posjeda. Grad je najavio parnicu radi raskida ugovora i vidjet ćemo hoće li do toga doći - za kraj će Jeličić.

Odvjetnik Mijo Jeličić objasnio je zašto je njegovo klijentu Tonću Omrčenu odbačena privremena mjera vezana za slučaj parkinga na Gripama i što to zapravo znači:

⁃ Nakon što se dogodila poznata noćna akcija, pokušali smo postići kompromis s Gradom i to riješiti na pristojan i civiliziran način. Kada smo vidjeli da neće biti dogovora jer, na sve prijedloge i na ono što smo mi isticali kao bitno, naišli smo na šutnju Grada - kazao je, te dodao:

- Doduše jedan put su me dogradonačelnik Bojan Ivošević i gradonačelnik Ivica Puljak primili na sastanak, kada sam iznio konkretan prijedlog da se postavimo na pozicijama na kojima smo danas i da se odreknemo potraživanja prema Gradu, a Grad neka zadrži svoje pravo traženja raskida ugovora itd., samo da možemo...
