Rješenjem Trgovačkog suda u Splitu, donesenim 25. siječnja ove godine, zaključen je stečaj nad "Kaštelanskim staklenicima", čime je u gospodarskom sektoru izbrisano još jedno nekada uspješno poduzeće.

Sukladno proceduri, nakon što rješenje postane pravomoćno, slijedi mu brisanje i iz sudskog registra. Da se dođe do ove točke trebalo je, pokazalo se, nepunih sedam godina, budući da je stečaj otvoren u svibnju 2015. godine.

Stečaj nad posrnulom kaštelanskom tvrtkom u državnom vlasništvu ostat će, međutim, zapamćen i po činjenici da su bivši radnici u postupku uspjeli naplatiti svoja potraživanja - neisplaćene plaće i ostala davanja od ukupno 21,8 milijuna kuna. Svrstani u prvi viši isplatni red, radnici su isplaćeni nakon razlučnih vjerovnika čija su potraživanja nastala temeljem hipoteka nad nekretninama.

Na svoje su došli i ostali vjerovnici prvog višeg isplatnog reda, potom i oni iz drugog. Računajući i podmirenje dospjelih obveza stečajne mase, dođe se do ukupnog iznosa od 125.677.728 kuna podmirenih tražbina. Sudbinu velikog broja onih koji su ostajali praznih ruku u većini stečajnih postupaka, vjerovnici ‘staklenika’ izbjegli su zahvaljujući prodaji vrijedne imovine, od koje je na račun sjelo 128.359.155 kuna.

No, kad je riječ o novcu od prodaje valja podsjetiti da je iznos dvostruko manji od 298,3 milijuna kuna na koliko je sudski vještak Mirko Duhović procijenio dugotrajnu imovinu "Kaštelanskih staklenika" 2015. godine. Nekretnine su, međutim, prodavane na javnim dražbama, pa su sa svakim novim ročištem njihove cijene padale.

Tako je Zračna luka Split zemljište u Resniku na drugom ročištu platila 87,9 milijuna kuna ili polovinu procijenjene vrijednosti, a Grad Kaštela pogon Knežine u Štafiliću na trećem ročištu 21,6 milijuna kuna što je četvrtina procijenjene vrijednosti, da spomenemo samo dvije najveće kupo-prodaje.

Premda ga sedmogodišnje trajanje ne svrstava među neslavne rekordere, ovaj stečajni postupak mogao je okončati i ranije da nije bilo sređivanja zemljišno-knjižnog stanja, bez kojeg ne bi moglo biti ni prodaje.

Prema riječima stečajnog upravitelja Vedrana Šeparovića, u trenutku otvaranja stečaja Kaštelanski staklenici su bili upisani kao vlasnici nekretnina na ukupno 85 kat. čestica, ukupne površine 583.017 kvadrata, položenih na više lokacija u Kaštel Štafiliću i Splitu. Tijekom postupka na predmetnim nekretninama je došlo do promjena u njihovom obliku i broju, pa je krajem 2018. godine poduzeće bilo vlasnik 94 kat. čestice, ali iste površine, zbog izvršenih parcelacija koje su provedene u postupcima izvlaštenja.

-Osim toga, zbog prostornih planova i upisanih razlučnih prava valjalo je pažljivo razmotriti formiranje prodajnih cjelina, jer su odredbe Stečajnog zakona vrlo striktne u pogledu načina prodaje imovine s obzirom na njihov zemljišno-knjižni status i opterećenost razlučnim pravima – naglasio je Šeparović.

U svakom slučaju postupak je okončan, poljoprivredna proizvodnja zamijenjena je novim, drugačijim sadržajima. U nekadašnjem pogonu Knežine iznad Jadranske magistrale gdje su se u 24 staklenika, svaki površine pet tisuća kvadrata, sadili zelena salata i ostalo povrće, udomila se gradska komunalna tvrtka "Zeleno i modro" sa svojim pogonom za odvoz smeća, a prema najavama uskoro će se uspostaviti i kompostana.

U Resniku je pak Zračna luka Split na dijelu kupljenog zemljišta, u urbanističkoj IS1 zoni određenoj upravo potrebama aerodroma, izgradila parking prostor za korisnike svojih usluga.

Zanimljiv spor s Gradom Splitom


Za podmirivanje predvidivih troškova stečajnog postupka koji će nastati nakon zaključenja rezerviran je iznos od 2.681.427 kuna.

Riječ je o tome da se trebaju nastaviti sporovi radi utvrđenja prava vlasništva na imovini u korist stečajne mase.

Posebno je zanimljiv spor s Gradom Splitom oko tri nekretnine površine 12.376 kvadrata, koje su u naravi tri parkirališta uz groblje Lovrinac.

U završnom računu stečajnog upravitelja navodi se da su u pitanju “značajna sredstva”.

Rješenjem Trgovačkog suda u Splitu, donesenim 25. siječnja ove godine, zaključen je stečaj nad "Kaštelanskim staklenicima", čime je u gospodarskom sektoru izbrisano još jedno nekada uspješno poduzeće.

Sukladno proceduri, nakon što rješenje postane pravomoćno, slijedi mu brisanje i iz sudskog registra. Da se dođe do ove točke trebalo je, pokazalo se, nepunih sedam godina, budući da je stečaj otvoren u svibnju 2015. godine.

Stečaj nad posrnulom kaštelanskom tvrtkom u državnom vlasništvu ostat će, međutim, zapamćen i po činjenici da su bivši radnici u postupku uspjeli naplatiti svoja potraživanja - neisplaćene plaće i ostala davanja od ukupno 21,8 milijuna kuna. Svrstani u prvi viši isplatni red, radnici su isplaćeni nakon razlučnih vjerovnika čija su potraživanja nastala temeljem hipoteka nad nekretninama.

Na svoje su došli i ostali vjerovnici prvog višeg isplatnog reda, potom i oni iz drugog. Računajući i podmirenje dospjelih obveza stečajne mase, dođe se do ukupnog iznosa od 125.677.728 kuna podmirenih tražbina. Sudbinu velikog broja onih koji su ostajali praznih ruku u većini stečajnih postupaka, vjerovnici ‘staklenika’ izbjegli su zahvaljujući prodaji vrijedne imovine, od koje je na račun sjelo 128.359.155 kuna.

No, kad je riječ o novcu od prodaje valja podsjetiti da je iznos dvostruko manji od 298,3 milijuna kuna na koliko je sudski vještak Mirko Duhović procijenio dugotrajnu imovinu "Kaštelanskih staklenika" 2015. godine. Nekretnine su, međutim, prodavane na javnim dražbama, pa su sa svakim novim ročištem njihove cijene padale.

Tako je Zračna luka Split zemljište u Resniku na drugom ročištu platila 87,9 milijuna kuna ili polovinu procijenjene vrijednosti, a Grad Kaštela pogon Knežine u Štafiliću na trećem ročištu 21,6 milijuna kuna što je četvrtina procijenjene vrijednosti, da spomenemo samo dvije najveće kupo-prodaje.

Premda ga sedmogodišnje trajanje ne svrstava među neslavne rekordere, ovaj stečajni postupak mogao je okončati i ranije da nije bilo sređivanja zemljišno-knjižnog stanja, bez kojeg ne bi moglo biti ni prodaje.

Prema riječima stečajnog upravitelja Vedrana Šeparovića, u trenutku otvaranja stečaja Kaštelanski staklenici su bili upisani kao vlasnici nekretnina na ukupno 85 kat. čestica, ukupne površine 583.017 kvadrata, položenih na više lokacija u Kaštel Štafiliću i Splitu. Tijekom postupka na predmetnim nekretninama je došlo do promjena u njihovom obliku i broju, pa je krajem 2018. godine poduzeće bilo vlasnik 94 kat. čestice, ali iste površine, zbog izvršenih parcelacija koje su provedene u postupcima izvlaštenja.

-Osim toga, zbog prostornih planova i upisanih razlučnih prava valjalo je pažljivo razmotriti formiranje prodajnih cjelina, jer su odredbe Stečajnog zakona vrlo striktne u pogledu načina prodaje imovine s obzirom na njihov zemljišno-knjižni status i opterećenost razlučnim pravima – naglasio je Šeparović.

U svakom slučaju postupak je okončan, poljoprivredna proizvodnja zamijenjena je novim, drugačijim sadržajima. U nekadašnjem pogonu Knežine iznad Jadranske magistrale gdje su se u 24 staklenika, svaki površine pet tisuća kvadrata, sadili zelena salata i ostalo povrće, udomila se gradska komunalna tvrtka "Zeleno i modro" sa svojim pogonom za odvoz smeća, a prema najavama uskoro će se uspostaviti i kompostana.

U Resniku je pak Zračna luka Split na dijelu kupljenog zemljišta, u urbanističkoj IS1 zoni određenoj upravo potrebama aerodroma, izgradila parking prostor za korisnike svojih usluga.

Zanimljiv spor s Gradom Splitom


Za podmirivanje predvidivih troškova stečajnog postupka koji će nastati nakon zaključenja rezerviran je iznos od 2.681.427 kuna.

Riječ je o tome da se trebaju nastaviti sporovi radi utvrđenja prava vlasništva na imovini u korist stečajne mase.

Posebno je zanimljiv spor s Gradom Splitom oko tri nekretnine površine 12.376 kvadrata, koje su u naravi tri parkirališta uz groblje Lovrinac.

U završnom računu stečajnog upravitelja navodi se da su u pitanju “značajna sredstva”.
