Norveški Vrhovni sud presudio je u ponedjeljak da brodovi EU-a ne mogu loviti snježnog raka u arhipelagu Svalbard na Arktiku u slučaju koji također odlučuje tko ima pravo istraživati naftu i minerale u toj regiji, prenosi marinelink.com.

U igri je bilo imaju li plovila EU-a pravo loviti snježnog raka, čije meso gurmani u Japanu i Južnoj Koreji smatraju delikatesom, na isti način kao što su to činila norveška plovila.

Ali ono što vrijedi za snježnog raka, sjedilačku vrstu koja živi na morskom dnu, vrijedi i za naftu, minerale i druge resurse, presudio je Vrhovni sud u slučaju iz 2019.

Latvijska ribarska tvrtka, SIA North Star, podnijela je 2019. zahtjev zemlji koja nije članica EU-a za ribolovnu dozvolu za ulov ove vrste, ali je odbijena na temelju toga što to mogu samo norveška plovila.

SIA North Star tvrdila je da ima to pravo prema Svalbardskom sporazumu iz 1920., koji Norveškoj daje suverenitet nad arktičkim otocima uz uvjet da druge potpisnice imaju pristup svojim teritorijalnim vodama.

"Tvrtka nema pravo loviti snježnog raka na kontinentalnom pojasu izvan Svalbarda", rekao je Vrhovni sud u presudi, koja je bila jednoglasna.

Da je SIA North Star dobila to pravo, to bi značilo da bi druge države osim Norveške imale pravo pristupa prirodnim resursima na epikontinentalnom pojasu oko Svalbarda.

Dok je pravni lijek za ribarsku tvrtku sada gotov, država može pokrenuti tužbu protiv Norveške, rekao je Oeystein Jensen, profesor međunarodnog prava na Institutu Fridtjof Nansen u Oslu.

"Nastavit će se kao međunarodni pravni spor u smislu da druge države to možda neće nužno prihvatiti kao konačno rješenje ovog pitanja", rekao je Jensen za Reuters.

Norveški Vrhovni sud presudio je u ponedjeljak da brodovi EU-a ne mogu loviti snježnog raka u arhipelagu Svalbard na Arktiku u slučaju koji također odlučuje tko ima pravo istraživati naftu i minerale u toj regiji, prenosi marinelink.com.

U igri je bilo imaju li plovila EU-a pravo loviti snježnog raka, čije meso gurmani u Japanu i Južnoj Koreji smatraju delikatesom, na isti način kao što su to činila norveška plovila.

Ali ono što vrijedi za snježnog raka, sjedilačku vrstu koja živi na morskom dnu, vrijedi i za naftu, minerale i druge resurse, presudio je Vrhovni sud u slučaju iz 2019.

Latvijska ribarska tvrtka, SIA North Star, podnijela je 2019. zahtjev zemlji koja nije članica EU-a za ribolovnu dozvolu za ulov ove vrste, ali je odbijena na temelju toga što to mogu samo norveška plovila.

SIA North Star tvrdila je da ima to pravo prema Svalbardskom sporazumu iz 1920., koji Norveškoj daje suverenitet nad arktičkim otocima uz uvjet da druge potpisnice imaju pristup svojim teritorijalnim vodama.

"Tvrtka nema pravo loviti snježnog raka na kontinentalnom pojasu izvan Svalbarda", rekao je Vrhovni sud u presudi, koja je bila jednoglasna.

Da je SIA North Star dobila to pravo, to bi značilo da bi druge države osim Norveške imale pravo pristupa prirodnim resursima na epikontinentalnom pojasu oko Svalbarda.

Dok je pravni lijek za ribarsku tvrtku sada gotov, država može pokrenuti tužbu protiv Norveške, rekao je Oeystein Jensen, profesor međunarodnog prava na Institutu Fridtjof Nansen u Oslu.

"Nastavit će se kao međunarodni pravni spor u smislu da druge države to možda neće nužno prihvatiti kao konačno rješenje ovog pitanja", rekao je Jensen za Reuters.

Norveški Vrhovni sud presudio je u ponedjeljak da brodovi EU-a ne mogu loviti snježnog raka u arhipelagu Svalbard na Arktiku u slučaju koji također odlučuje tko ima pravo istraživati naftu i minerale u toj regiji, prenosi marinelink.com.

U igri je bilo imaju li plovila EU-a pravo loviti snježnog raka, čije meso gurmani u Japanu i Južnoj Koreji smatraju delikatesom, na isti način kao što su to činila norveška plovila.

Ali ono što vrijedi za snježnog raka, sjedilačku vrstu koja živi na morskom dnu, vrijedi i za naftu, minerale i druge resurse, presudio je Vrhovni sud u slučaju iz 2019.

Latvijska ribarska tvrtka, SIA North Star, podnijela je 2019. zahtjev zemlji koja nije članica EU-a za ribolovnu dozvolu za ulov ove vrste, ali je odbijena na temelju toga što to mogu samo norveška plovila.

SIA North Star tvrdila je da ima to pravo prema Svalbardskom sporazumu iz 1920., koji Norveškoj daje suverenitet nad arktičkim otocima uz uvjet da druge potpisnice imaju pristup svojim teritorijalnim vodama.

"Tvrtka nema pravo loviti snježnog raka na kontinentalnom pojasu izvan Svalbarda", rekao je Vrhovni sud u presudi, koja je bila jednoglasna.

Da je SIA North Star dobila to pravo, to bi značilo da bi druge države osim Norveške imale pravo pristupa prirodnim resursima na epikontinentalnom pojasu oko Svalbarda.

Dok je pravni lijek za ribarsku tvrtku sada gotov, država može pokrenuti tužbu protiv Norveške, rekao je Oeystein Jensen, profesor međunarodnog prava na Institutu Fridtjof Nansen u Oslu.

"Nastavit će se kao međunarodni pravni spor u smislu da druge države to možda neće nužno prihvatiti kao konačno rješenje ovog pitanja", rekao je Jensen za Reuters.
