Nekadašnji šef Službe državne sigurnosti Srbije Franko Simatović, koji je pred sudom u Haagu osuđen na 15 godina zatvora, pušten je na privremenu slobodu i stiže u Srbiju, prenosi B92.

Razlog za ovu odluku suda je to što u zatvorskim uvjetima ne može primati terapiju koja mu je neophodna.

Simatović je zajedno sa bivšim šefom Službe državne sigurnosti Srbije Jovicom Stanišićem uhićen 2003. kada je i podignuta optužnica. Nakon prvog suđenja 2013. godine obojica su oslobođeni, ali se tužiteljstvo žalilo.

Kako piše B92, Simatović je u zatvoru proveo više od osam godina, a Stanišić više od sedam.

Stanišić i Simatović 2021. proglašeni su odgovornima za pomaganje i podržavanje kaznenih djela ubojstava kao kršenja zakona i običaja ratovanja i zločina protiv čovječnosti te kaznenih djela deportacije, prisilnog premještanja i progona muslimanskog i hrvatskog stanovništva kao zločina protiv čovječnosti koje su počinile srpske snage nakon zauzimanja Bosanskog Šamca u travnju 1992. Za to su dobili svaki po 12 godina zatvora.

Na presudu su se žalili i obrana i tužiteljstvo koje je osporilo zaključke prvostupanjskog vijeća da nije dokazano sudjelovanje dvojice u udruženom zločinačkom pothvatu kao i njihova odgovornost za zločine u Hrvatskoj koje su počinile jedinice koje su oni uspostavili, obučavali i financirali.

Žalbeno vijeće Rezidualnog mehanizma za međunarodne kaznene sudove (MICT) u Haagu proglasilo je 31. svibnja 2023. bivše čelnike Službe državne sigurnosti Srbije Jovicu Stanišića i Frenkija Simatovića krivima i za ubojstvo počinjeno u lipnju 1992. u Hrvatskoj u Daljskoj Planini.

Žalbeno vijeće Rezidualnog mehanizma povećalo im je kazne zatvora na 15 godina za zločine koje su počinile srpske snage na području bivše Jugoslavije.

Podsjetimo, Raspravno je vijeće u svojoj presudi 2021. zaključilo da je postojao udruženi zločinački pothvat i da mu je zajednički zločinački cilj bio prisilno i trajno uklanjanje većine nesrba iz velikih dijelova Hrvatske i Bosne i Hercegovine počinjenjem ubojstava, deportacije, prisilnog premještanja i progona. No, utvrdilo je da su Stanišić i Simatović doprinijeli zajedničkom zločinačkom cilju jedino u vezi sa zločinima u Bosanskom Šamcu, te ih je oslobodilo odgovornosti za udruženi zločinački pothvat na osnovu toga da nije dokazano da je netko od njih dvojice dijelio zajedničku namjeru da se ostvari zajednički zločinački cilj.

Tužiteljstvo je u svojoj žalbi tvrdilo da se Stanišiću i Simatoviću mogu pripisati brojni zločini u Hrvatskoj - u Kijevu, Vrliki, Drnišu, Hrvatskoj Kostajnici, Saborskom, Škabrnji, Bruškoj, Marnovićima, Dalju, Erdutu, Vukovaru jer su ih počinile jedinice koje su bile pod njihovom kontrolom ili kontrolom drugih članova udruženog zločinačkog pothvata, no žalbeno vijeće te osnove žalbe nije prihvatilo.

Sam proces Stanišiću i Simatoviću trajao je punih 20 godina. 2013. Stanišić i Simatović su oslobođeni krivnje, ali Žalbeno vijeće je 2015. naložilo ponavljanje postupka koji opet kreće ispočetka 2017. godine. Potom su 2021. Stanišić i Simatović proglašeni odgovornima za sudjelovanje u ratnim zločinima u Bosanskom Šamcu. Za to su dobili svaki po 12 godina zatvora. No, tada nije bilo utvrđeno da su bili dio udruženog zločinačkog pothvata.

Nekadašnji šef Službe državne sigurnosti Srbije Franko Simatović, koji je pred sudom u Haagu osuđen na 15 godina zatvora, pušten je na privremenu slobodu i stiže u Srbiju, prenosi B92.

Razlog za ovu odluku suda je to što u zatvorskim uvjetima ne može primati terapiju koja mu je neophodna.

Simatović je zajedno sa bivšim šefom Službe državne sigurnosti Srbije Jovicom Stanišićem uhićen 2003. kada je i podignuta optužnica. Nakon prvog suđenja 2013. godine obojica su oslobođeni, ali se tužiteljstvo žalilo.

Kako piše B92, Simatović je u zatvoru proveo više od osam godina, a Stanišić više od sedam.

Stanišić i Simatović 2021. proglašeni su odgovornima za pomaganje i podržavanje kaznenih djela ubojstava kao kršenja zakona i običaja ratovanja i zločina protiv čovječnosti te kaznenih djela deportacije, prisilnog premještanja i progona muslimanskog i hrvatskog stanovništva kao zločina protiv čovječnosti koje su počinile srpske snage nakon zauzimanja Bosanskog Šamca u travnju 1992. Za to su dobili svaki po 12 godina zatvora.

Na presudu su se žalili i obrana i tužiteljstvo koje je osporilo zaključke prvostupanjskog vijeća da nije dokazano sudjelovanje dvojice u udruženom zločinačkom pothvatu kao i njihova odgovornost za zločine u Hrvatskoj koje su počinile jedinice koje su oni uspostavili, obučavali i financirali.

Žalbeno vijeće Rezidualnog mehanizma za međunarodne kaznene sudove (MICT) u Haagu proglasilo je 31. svibnja 2023. bivše čelnike Službe državne sigurnosti Srbije Jovicu Stanišića i Frenkija Simatovića krivima i za ubojstvo počinjeno u lipnju 1992. u Hrvatskoj u Daljskoj Planini.

Žalbeno vijeće Rezidualnog mehanizma povećalo im je kazne zatvora na 15 godina za zločine koje su počinile srpske snage na području bivše Jugoslavije.

Podsjetimo, Raspravno je vijeće u svojoj presudi 2021. zaključilo da je postojao udruženi zločinački pothvat i da mu je zajednički zločinački cilj bio prisilno i trajno uklanjanje većine nesrba iz velikih dijelova Hrvatske i Bosne i Hercegovine počinjenjem ubojstava, deportacije, prisilnog premještanja i progona. No, utvrdilo je da su Stanišić i Simatović doprinijeli zajedničkom zločinačkom cilju jedino u vezi sa zločinima u Bosanskom Šamcu, te ih je oslobodilo odgovornosti za udruženi zločinački pothvat na osnovu toga da nije dokazano da je netko od njih dvojice dijelio zajedničku namjeru da se ostvari zajednički zločinački cilj.

Tužiteljstvo je u svojoj žalbi tvrdilo da se Stanišiću i Simatoviću mogu pripisati brojni zločini u Hrvatskoj - u Kijevu, Vrliki, Drnišu, Hrvatskoj Kostajnici, Saborskom, Škabrnji, Bruškoj, Marnovićima, Dalju, Erdutu, Vukovaru jer su ih počinile jedinice koje su bile pod njihovom kontrolom ili kontrolom drugih članova udruženog zločinačkog pothvata, no žalbeno vijeće te osnove žalbe nije prihvatilo.

Sam proces Stanišiću i Simatoviću trajao je punih 20 godina. 2013. Stanišić i Simatović su oslobođeni krivnje, ali Žalbeno vijeće je 2015. naložilo ponavljanje postupka koji opet kreće ispočetka 2017. godine. Potom su 2021. Stanišić i Simatović proglašeni odgovornima za sudjelovanje u ratnim zločinima u Bosanskom Šamcu. Za to su dobili svaki po 12 godina zatvora. No, tada nije bilo utvrđeno da su bili dio udruženog zločinačkog pothvata.

Na presudu su se žalili i obrana i tužiteljstvo koje je osporilo zaključke prvostupanjskog vijeća da nije dokazano sudjelovanje dvojice u udruženom zločinačkom pothvatu kao i njihova odgovornost za zločine u Hrvatskoj koje su počinile jedinice koje su oni uspostavili, obučavali i financirali.

Žalbeno vijeće Rezidualnog mehanizma za međunarodne kaznene sudove (MICT) u Haagu proglasilo je 31. svibnja 2023. bivše čelnike Službe državne sigurnosti Srbije Jovicu Stanišića i Frenkija Simatovića krivima i za ubojstvo počinjeno u lipnju 1992. u Hrvatskoj u Daljskoj Planini.

Žalbeno vijeće Rezidualnog mehanizma povećalo im je kazne zatvora na 15 godina za zločine koje su počinile srpske snage na području bivše Jugoslavije.

Podsjetimo, Raspravno je vijeće u svojoj presudi 2021. zaključilo da je postojao udruženi zločinački pothvat i da mu je zajednički zločinački cilj bio prisilno i trajno uklanjanje većine nesrba iz velikih dijelova Hrvatske i Bosne i Hercegovine počinjenjem ubojstava, deportacije, prisilnog premještanja i progona. No, utvrdilo je da su Stanišić i Simatović doprinijeli zajedničkom zločinačkom cilju jedino u vezi sa zločinima u Bosanskom Šamcu, te ih je oslobodilo odgovornosti za udruženi zločinački pothvat na osnovu toga da nije dokazano da je netko od njih dvojice dijelio zajedničku namjeru da se ostvari zajednički zločinački cilj.

Tužiteljstvo je u svojoj žalbi tvrdilo da se Stanišiću i Simatoviću mogu pripisati brojni zločini u Hrvatskoj - u Kijevu, Vrliki, Drnišu, Hrvatskoj Kostajnici, Saborskom, Škabrnji, Bruškoj, Marnovićima, Dalju, Erdutu, Vukovaru jer su ih počinile jedinice koje su bile pod njihovom kontrolom ili kontrolom drugih članova udruženog zločinačkog pothvata, no žalbeno vijeće te osnove žalbe nije prihvatilo.

Sam proces Stanišiću i Simatoviću trajao je punih 20 godina. 2013. Stanišić i Simatović su oslobođeni krivnje, ali Žalbeno vijeće je 2015. naložilo ponavljanje postupka koji opet kreće ispočetka 2017. godine. Potom su 2021. Stanišić i Simatović proglašeni odgovornima za sudjelovanje u ratnim zločinima u Bosanskom Šamcu. Za to su dobili svaki po 12 godina zatvora. No, tada nije bilo utvrđeno da su bili dio udruženog zločinačkog pothvata.
