Iako je u siječnju ove godine nepravomoćnom sudskom presudom izgubila spor protiv Hrvatskog zavoda za zdravstveno osiguranje, policajka Marija Kulić iz Jelse na otoku Hvaru ipak se neće morati "misliti" kako će toj državnoj instituciji vratiti gotovo 24 tisuće kuna koliko su joj zbog svoje greške isplatili! Uspjela je, dakle, u sudskoj borbi pobijediti biroratski aparat.

Naime, još prije četiri godine Kulić se u Slobodnoj Dalmaciji požalila kako joj je HZZO-ova ispostava u Hvaru pogrešno obračunala naknadu plaće tijekom bolovanja na kojem je, zbog komplikacija u trudnoći, bila od 2. svibnja do 17. studenoga 2017. godine, i tijekom korištenja rodiljnog dopusta od 18. studenoga do 31. svibnja 2018.

– Nakon rođenja drugog djeteta imala sam treću uzastopnu trudnoću i tada su mi dijagnosticirane komplikacije. Bila sam u ispostavi HZZO-a u Hvaru i pitala djelatnicu koja su moja prava, na što mi je odgovorila da i dalje nastavljam koristiti punu plaću u iznosu od 4700 kuna.

Prijetnja sudom, a oni su krivi

No, s vremenom su u Regionalnom uredu u Splitu uvidjeli da sam dobila pogrešnu informaciju i pogrešan obračun, pa su pokrenuli postupak i za spomenuta razdoblja mi priznali plaću na teret HZZO-a od samo 2352,66 kuna. Dakle, netko nije osposobljen i ne zna raditi svoj posao, a onda mi roditelji zbog toga gorko ispaštamo. HZZO sve to izrijekom konstatira u svojem rješenju, ali svejedno od mene traži da im vratim 23.886,39 kuna, i to pod prijetnjom sudske tužbe i dodatnih troškova - ispričala je tada majka troje djece.

Naravno, prijetnja sudom se i obistinila te je sredinom siječnja ove godine Stalna služba Općinskog suda Split u Starom Gradu presudila da Kulić mora vratiti kune koje je od države dobila. Naravno, uz zatezne kamate od studenoga 2018. godine.

Uslijedila je žalba policijske djelatnice te je nedavno Županijski sud u Bjelovaru pravomoćno odlučio preinačiti odluku hvarskog suda, istaknuvši da je "nesporno da je do isplate nepripadne i nepravilne novčane potpore i naknade na koju tuženica nije imala pravo došlo pogreškom nadležnog tijela".

- U duhu sudske prakse EU suda za ljudska prava... zahtjev za povrat nepripadno isplaćene naknade koja je isplaćena pogreškom nadležnog tijela predstavlja prekomjeran teret za tuženicu te povredu čl. 1. Protokola I uz Konvenciju za zaštitu ljudskih prava i temeljnih sloboda, i to u situaciji kada stranka nije ni na koji način pridonijela tome da joj se isplati nepripadna potpora.

Kako je HZZO pravna osoba s javnim ovlastima nadležna za isplatu utuženih naknada i potpora, nije bilo razumno zaključiti da je tuženici bilo poznato ili moralo biti poznato da joj se isplaćuje veća naknada od one na koju je imala pravo - stoji, uz ostalo, u obrazloženju bjelovarskog suca mr. sc. Alena Goluba.

- S obzirom na to u kakvom društvu živimo, stvarno se nisam nadala ovome da ipak ima netko tko svoj posao odradi pošteno, da prati sudsku praksu i da se ne boji suditi kad mora presuditi protiv države. Pravobraniteljica Višnja Ljubičić pomogla je Mariji Kulić nakon tekstova u ‘Slobodnoj‘

Iako je u siječnju ove godine nepravomoćnom sudskom presudom izgubila spor protiv Hrvatskog zavoda za zdravstveno osiguranje, policajka Marija Kulić iz Jelse na otoku Hvaru ipak se neće morati "misliti" kako će toj državnoj instituciji vratiti gotovo 24 tisuće kuna koliko su joj zbog svoje greške isplatili! Uspjela je, dakle, u sudskoj borbi pobijediti biroratski aparat.

Naime, još prije četiri godine Kulić se u Slobodnoj Dalmaciji požalila kako joj je HZZO-ova ispostava u Hvaru pogrešno obračunala naknadu plaće tijekom bolovanja na kojem je, zbog komplikacija u trudnoći, bila od 2. svibnja do 17. studenoga 2017. godine, i tijekom korištenja rodiljnog dopusta od 18. studenoga do 31. svibnja 2018.

– Nakon rođenja drugog djeteta imala sam treću uzastopnu trudnoću i tada su mi dijagnosticirane komplikacije. Bila sam u ispostavi HZZO-a u Hvaru i pitala djelatnicu koja su moja prava, na što mi je odgovorila da i dalje nastavljam koristiti punu plaću u iznosu od 4700 kuna.

Prijetnja sudom, a oni su krivi

No, s vremenom su u Regionalnom uredu u Splitu uvidjeli da sam dobila pogrešnu informaciju i pogrešan obračun, pa su pokrenuli postupak i za spomenuta razdoblja mi priznali plaću na teret HZZO-a od samo 2352,66 kuna. Dakle, netko nije osposobljen i ne zna raditi svoj posao, a onda mi roditelji zbog toga gorko ispaštamo. HZZO sve to izrijekom konstatira u svojem rješenju, ali svejedno od mene traži da im vratim 23.886,39 kuna, i to pod prijetnjom sudske tužbe i dodatnih troškova - ispričala je tada majka troje djece.

Naravno, prijetnja sudom se i obistinila te je sredinom siječnja ove godine Stalna služba Općinskog suda Split u Starom Gradu presudila da Kulić mora vratiti kune koje je od države dobila. Naravno, uz zatezne kamate od studenoga 2018. godine.

Uslijedila je žalba policijske djelatnice te je nedavno Županijski sud u Bjelovaru pravomoćno odlučio preinačiti odluku hvarskog suda, istaknuvši da je "nesporno da je do isplate nepripadne i nepravilne novčane potpore i naknade na koju tuženica nije imala pravo došlo pogreškom nadležnog tijela".

- U duhu sudske prakse EU suda za ljudska prava... zahtjev za povrat nepripadno isplaćene naknade koja je isplaćena pogreškom nadležnog tijela predstavlja prekomjeran teret za tuženicu te povredu čl. 1. Protokola I uz Konvenciju za zaštitu ljudskih prava i temeljnih sloboda, i to u situaciji kada stranka nije ni na koji način pridonijela tome da joj se isplati nepripadna potpora.

Kako je HZZO pravna osoba s javnim ovlastima nadležna za isplatu utuženih naknada i potpora, nije bilo razumno zaključiti da je tuženici bilo poznato ili moralo biti poznato da joj se isplaćuje veća naknada od one na koju je imala pravo - stoji, uz ostalo, u obrazloženju bjelovarskog suca mr. sc. Alena Goluba.

- S obzirom na to u kakvom društvu živimo, stvarno se nisam nadala ovome da ipak ima netko tko svoj posao odradi pošteno, da prati sudsku praksu i da se ne boji suditi kad mora presuditi protiv države.
