Stolar iz Gospića pravomoćno je osuđen na uvjetnu kaznu od osam mjeseci zatvora s rokom kušnje od dvije godine jer je u šumskom predjelu Oštarijski dolovi prije osam godina posjekao i pripremio za odvoz 56 stabala bukve.

Prvostupanjski sud je na temelju zapisnika o očevidu sa pripadajućim kartama i izvješća Pukovnije vojne policije, Oružanih snaga Ministarstva obrane RH, utvrdio da je u šumskom predjelu Oštarijski dolovi, jasenje-rebar koje pripada Vojnom poligonu "Eugen Kvaternik" Ministarstva obrane utvrđeno da je posječeno 56 stabala bukve,

Stolar se teretio da je najprije posjekao 56 stabala bukve u vlasništvu Ministarstva obrane Republike Hrvatske, a onda ih i iscijepao i pripremio za odvoz.

Iako je na sudu opovrgnuo kazneno djelo, nije porekao da je na mjestu sječe zatečen njegov traktor na kojem je bio postavljen cjepač za drva, te da je u neposrednoj blizini tog traktora iscijepano i pripremljeno za odvoz osam prostornih metara drva.

Pojasnio je kako je čuo da se u predjelu gdje njegova tetka Milka ima šumu ruše drva, te je traktorom taj dan pošao obići šumu. Kako je ostao bez goriva ostavio je traktor na kojem je bio sjekač za drva i otišao kući pješice. Naveo je da je na mjestu gdje je ostao njegov traktor vidio "iscijepana drva, a ne i porezana stabla".

Nakon osmogodišnjeg postupka na sudu je, međutim, utvrđeno kako je šuma koja je u vlasništvu tetke optuženika od mjesta događaja udaljena 411 metara zračne linije.

dužan naknaditi ošt. Ministarstvu obrane RH imovinskopravni zahtjev u iznosu od 5.000,00 kuna, u roku od 15 dana od pravomoćnosti presude.

Nakon pravomoćnosti presude dužan je Ministarstvu obrane RH platiti odštetu u iznosu od pet tisuća kuna, a morat će platiti i troškove kaznenog postupka.

Stolar iz Gospića pravomoćno je osuđen na uvjetnu kaznu od osam mjeseci zatvora s rokom kušnje od dvije godine jer je u šumskom predjelu Oštarijski dolovi prije osam godina posjekao i pripremio za odvoz 56 stabala bukve.

Prvostupanjski sud je na temelju zapisnika o očevidu sa pripadajućim kartama i izvješća Pukovnije vojne policije, Oružanih snaga Ministarstva obrane RH, utvrdio da je u šumskom predjelu Oštarijski dolovi, jasenje-rebar koje pripada Vojnom poligonu "Eugen Kvaternik" Ministarstva obrane utvrđeno da je posječeno 56 stabala bukve,

Stolar se teretio da je najprije posjekao 56 stabala bukve u vlasništvu Ministarstva obrane Republike Hrvatske, a onda ih i iscijepao i pripremio za odvoz.

Iako je na sudu opovrgnuo kazneno djelo, nije porekao da je na mjestu sječe zatečen njegov traktor na kojem je bio postavljen cjepač za drva, te da je u neposrednoj blizini tog traktora iscijepano i pripremljeno za odvoz osam prostornih metara drva.

Pojasnio je kako je čuo da se u predjelu gdje njegova tetka Milka ima šumu ruše drva, te je traktorom taj dan pošao obići šumu. Kako je ostao bez goriva ostavio je traktor na kojem je bio sjekač za drva i otišao kući pješice. Naveo je da je na mjestu gdje je ostao njegov traktor vidio "iscijepana drva, a ne i porezana stabla".

Nakon osmogodišnjeg postupka na sudu je, međutim, utvrđeno kako je šuma koja je u vlasništvu tetke optuženika od mjesta događaja udaljena 411 metara zračne linije.

dužan naknaditi ošt. Ministarstvu obrane RH imovinskopravni zahtjev u iznosu od 5.000,00 kuna, u roku od 15 dana od pravomoćnosti presude.

Nakon pravomoćnosti presude dužan je Ministarstvu obrane RH platiti odštetu u iznosu od pet tisuća kuna, a morat će platiti i troškove kaznenog postupka.

Stolar iz Gospića pravomoćno je osuđen na uvjetnu kaznu od osam mjeseci zatvora s rokom kušnje od dvije godine jer je u šumskom predjelu Oštarijski dolovi prije osam godina posjekao i pripremio za odvoz 56 stabala bukve.

Prvostupanjski sud je na temelju zapisnika o očevidu sa pripadajućim kartama i izvješća Pukovnije vojne policije, Oružanih snaga Ministarstva obrane RH, utvrdio da je u šumskom predjelu Oštarijski dolovi, jasenje-rebar koje pripada Vojnom poligonu "Eugen Kvaternik" Ministarstva obrane utvrđeno da je posječeno 56 stabala bukve,

Stolar se teretio da je najprije posjekao 56 stabala bukve u vlasništvu Ministarstva obrane Republike Hrvatske, a onda ih i iscijepao i pripremio za odvoz.

Iako je na sudu opovrgnuo kazneno djelo, nije porekao da je na mjestu sječe zatečen njegov traktor na kojem je bio postavljen cjepač za drva, te da je u neposrednoj blizini tog traktora iscijepano i pripremljeno za odvoz osam prostornih metara drva.

Pojasnio je kako je čuo da se u predjelu gdje njegova tetka Milka ima šumu ruše drva, te je traktorom taj dan pošao obići šumu. Kako je ostao bez goriva ostavio je traktor na kojem je bio sjekač za drva i otišao kući pješice. Naveo je da je na mjestu gdje je ostao njegov traktor vidio "iscijepana drva, a ne i porezana stabla".

Nakon osmogodišnjeg postupka na sudu je, međutim, utvrđeno kako je šuma koja je u vlasništvu tetke optuženika od mjesta događaja udaljena 411 metara zračne linije.

dužan naknaditi ošt. Ministarstvu obrane RH imovinskopravni zahtjev u iznosu od 5.000,00 kuna, u roku od 15 dana od pravomoćnosti presude.

Nakon pravomoćnosti presude dužan je Ministarstvu obrane RH platiti odštetu u iznosu od pet tisuća kuna, a morat će platiti i troškove kaznenog postupka.
