Ustavni sud RH utvrdio je da bivšem načelniku Općine Vir Kristijanu Kapoviću nisu povrijeđena ustavna prava presudom iz 2018. godine kojom je osuđen na šest mjeseci zatvora, uvjetno na dvije godine, zbog protupravne gradnje 650 metara duge prometnice na pomorskom dobru na lokaciji "Punta Rastovac".

Kapović je podnio ustavnu tužbu nakon pravomoćne presude Općinskog suda u Zadru kojom je osuđen jer je protivno propisima gradio građevinu u području koje je propisom proglašeno zaštićenom prirodnom vrijednosti i područjem od posebnog interesa za državu, čime je počinio kazneno djelo protiv okoliša - protupravnu gradnju.

Tom je presudom utvrđeno da je Kapović sredinom 2013. kao načelnik Općine Vir, na lokaciji "Punta Rastovac" koja je pomorsko dobro, duž obalnog pojasa, na nekoliko metara od obalne crte izgradio cestu dužine 650 metara bez građevinske dozvole, odnosno bez rješenja o uvjetima gradnje, te bez potvrde glavnog projekta.

U ustavnoj tužbi Kapović je, međutim, naveo da on nije izgradio inkriminiranu cestu, već samo uredio put koji postoji već stotinjak godina, a koji omaškom nije ucrtan u katastar.
Naglasio je da je to jedinstvena cesta koju je on prema Zakonu o cestama bio dužan održavati, te da svojim djelovanjem nije izmijenio okoliš. Prema njegovom je mišljenju ostalo sporno samo jeli presvlačenje asfaltnog sloja na put izgradnja nove građevine u kaznenopravnom smislu, te da je na tu okolnost trebalo provesti građevinsko vještačenje, što je sud odbio.

Držao je da je odbijanjem tog dokaznog prijedloga povrijeđeno njegovo pravo na pravično suđenje. Naveo je i kako je djelo za koje je osuđen beznačajno jer je postupao isključivo u javnom interesu. Tvrdio je kako je njegov stupanj krivnje iznimno nizak jer nisu nastupile nikakve posljedice za zaštićeno dobro i pravni sustav.
Ustavni sud je, međutim, utvrdio da je Kapović s pravom proglašen krivim jer je, kao načelnik Općine Vir, dakle kao čelni čovjek lokalne zajednice, protivno pravnim propisima, bez temeljnog akta za građenje izgradio cestu na pomorskom dobru, narušivši autohtoni pejzaž.

- Sporna cesta napravljena je na pomorskom dobru, na samoj obali mora. Čestica na kojoj je izgrađena i u katastru i u zemljišnim knjigama evidentirana je kao obala. S obzirom na to da su i katastar i zemljišne knjige javne evidencije, podnositelju ta činjenica nije mogla ostati nepoznata. Pomorsko dobro je Ustavom zaštićena kategorija koja je od posebnog interesa za Republiku Hrvatsku i koja uživa njezinu osobitu zaštitu – navodi se u obrazloženju rješenja Ustavnog suda.
Kako su naveli, razvidno je da je Kapović svojim radovima izvršio gradnju ceste za koju je prethodno trebao pribaviti temeljni akt za građenje, tim više, što je bio višegodišnji načelnik općine u kojoj je zaposleno stručno osoblje, te se u najmanju ruku bio dužan interesirati kod nadležnih upravnih tijela je li mu potrebna građevinska dozvola za radove na pomorskom dobru.

Ustavni sud RH utvrdio je da bivšem načelniku Općine Vir Kristijanu Kapoviću nisu povrijeđena ustavna prava presudom iz 2018. godine kojom je osuđen na šest mjeseci zatvora, uvjetno na dvije godine, zbog protupravne gradnje 650 metara duge prometnice na pomorskom dobru na lokaciji "Punta Rastovac".

Kapović je podnio ustavnu tužbu nakon pravomoćne presude Općinskog suda u Zadru kojom je osuđen jer je protivno propisima gradio građevinu u području koje je propisom proglašeno zaštićenom prirodnom vrijednosti i područjem od posebnog interesa za državu, čime je počinio kazneno djelo protiv okoliša - protupravnu gradnju.

Tom je presudom utvrđeno da je Kapović sredinom 2013. kao načelnik Općine Vir, na lokaciji "Punta Rastovac" koja je pomorsko dobro, duž obalnog pojasa, na nekoliko metara od obalne crte izgradio cestu dužine 650 metara bez građevinske dozvole, odnosno bez rješenja o uvjetima gradnje, te bez potvrde glavnog projekta.

U ustavnoj tužbi Kapović je, međutim, naveo da on nije izgradio inkriminiranu cestu, već samo uredio put koji postoji već stotinjak godina, a koji omaškom nije ucrtan u katastar.
Naglasio je da je to jedinstvena cesta koju je on prema Zakonu o cestama bio dužan održavati, te da svojim djelovanjem nije izmijenio okoliš. Prema njegovom je mišljenju ostalo sporno samo jeli presvlačenje asfaltnog sloja na put izgradnja nove građevine u kaznenopravnom smislu, te da je na tu okolnost trebalo provesti građevinsko vještačenje, što je sud odbio.

Držao je da je odbijanjem tog dokaznog prijedloga povrijeđeno njegovo pravo na pravično suđenje. Naveo je i kako je djelo za koje je osuđen beznačajno jer je postupao isključivo u javnom interesu. Tvrdio je kako je njegov stupanj krivnje iznimno nizak jer nisu nastupile nikakve posljedice za zaštićeno dobro i pravni sustav.
Ustavni sud je, međutim, utvrdio da je Kapović s pravom proglašen krivim jer je, kao načelnik Općine Vir, dakle kao čelni čovjek lokalne zajednice, protivno pravnim propisima, bez temeljnog akta za građenje izgradio cestu na pomorskom dobru, narušivši autohtoni pejzaž.

- Sporna cesta napravljena je na pomorskom dobru, na samoj obali mora. Čestica na kojoj je izgrađena i u katastru i u zemljišnim knjigama evidentirana je kao obala. S obzirom na to da su i katastar i zemljišne knjige javne evidencije, podnositelju ta činjenica nije mogla ostati nepoznata. Pomorsko dobro je Ustavom zaštićena kategorija koja je od posebnog interesa za Republiku Hrvatsku i koja uživa njezinu osobitu zaštitu – navodi se u obrazloženju rješenja Ustavnog suda.
Kako su naveli, razvidno je da je Kapović svojim radovima izvršio gradnju ceste za koju je prethodno trebao pribaviti temeljni akt za građenje, tim više, što je bio višegodišnji načelnik općine u kojoj je zaposleno stručno osoblje, te se u najmanju ruku bio dužan interesirati kod nadležnih upravnih tijela je li mu potrebna građevinska dozvola za radove na pomorskom dobru.
