Nakon jučerašnjeg uhićenja šibenske sutkinje Maje Šupe, za koju USKOK sumnja da je primila 15.000 eura mita kako bi donijela oslobađajuću presudu u slučaju kontroverznog poduzetnika Blaža Petrovića, postavlja se pitanje treba li biti doveden u pitanje njezin cjelokupni pravosudni opus koji je žustro branila na jednom drugom, medijski popraćenom suđenju, navodeći pritom samu sebe kao primjer korektnosti i poštenja, i sve to u ime Republike Hrvatske, piše Jutarnji.

Da nije tjednik Nacional prije nekoliko mjeseci objavio iscrpan razgovor sa bivšim djelatnikom MUP-a Tomasom Rajnerom, možda bi ovaj slučaj možebitnog podmićivanja ostao zauvijek pod tepihom.

Spornu presudu koja ju je koštala uhićenja Šupe je donijela 25. studenoga 2013. te ju je Županijski sud, koji se nalazi u istoj zgradi kao i Općinski, unatoč žalbi tužiteljstva, odlučio i potvrditi u rujnu 2014.

Pitali smo stoga pravnike bi li nakon ovog otkrića, trebalo preispitati sve oslobađajuće presude koje je Šupe donijela i može li se za presudu u slučaju Blaža Petrovića zatražiti revizija s obzirom na sumnje pod kojima je ista donesena, piše Jutarnji.

Zagrebački odvjetnik Milko Križanović ističe da je "izrazito porazno po vladavinu prava i pravnu sigurnost saznanje da se za počinjenje teškog kaznenog davanja mita za pogodovanje pri odlučivanju u sudskom postupku tereti sudac i odvjetnik".

- Ukoliko se pokaže da je inkriminacija točna, to svakako za sobom povlači rezolutne posljedice, a to je da sudski postupak dovršen pravomoćnom presudom temeljenom na pogodovanju suca zbog primanja mita svakako će proizvesti apsolutnu posljedicu da takva ista bude ukinuta, jer svaka sudska presuda treba biti rezultat pravilne primjene procesnih i materijalnih propisa. Samo takva presuda može egzistirati u javnom prometu i regulirati pravne odnose. Dakle, svaka ona presuda donesena u postupku u kojem je sudac dokazano primio mito radi pogodovanja okrivljeniku, biti će ukinuta zbog ozbiljnih sumnji u istinitost odlučnih činjenica koje u sebi sadrži – kaže odvjetnik Križanović. Na upit može li se zatražiti revizija postupka za koji se sumnja da je presuđen kroz mito, Križanović napominje da može!

- Protiv pravomoćne sudske odluke i protiv sudskog postupka koji je prethodio takvoj odluci DORH može podnijeti Zahtjev za zaštitu zakonitosti! DORH nije vezan nikakvim rokom u pravcu podnošenja Zahtjeva za zaštitu zakonitosti, te mu zakonodavac daje slobodno odriješene ruke da reagira kad se za to ukaže potreba, odnosno kad utvrdi da je došlo do povrede zakona. Nema sumnje da će, ukoliko se inkriminacija primanja i davanja mira dokaže, presuda (protiv Blaža Petrovića koju je donijela Šupe o.pa) biti ukinuta te će se provesti novi kazneni postupak upravo radi pogibeljnost kaznenog djela davanja i primanja mita kao korupcijskog kaznenog djela. Jer ono zaslužuje snažnu društvenu osudu zbog razvijanja svijesti kod građana o velikoj društvenoj opasnosti djela kao takvih djela i potrebi njihova suzbijanja – zaključuje Križanović s napomenom da se takvim nečasnim radnjama razara društvena težnja za vladavinom prava.

Nije za isključiti ni da će ostale oslobađajuće presude koje je sutkinja Šupe donijela završiti pod lupom.

Nakon jučerašnjeg uhićenja šibenske sutkinje Maje Šupe, za koju USKOK sumnja da je primila 15.000 eura mita kako bi donijela oslobađajuću presudu u slučaju kontroverznog poduzetnika Blaža Petrovića, postavlja se pitanje treba li biti doveden u pitanje njezin cjelokupni pravosudni opus koji je žustro branila na jednom drugom, medijski popraćenom suđenju, navodeći pritom samu sebe kao primjer korektnosti i poštenja, i sve to u ime Republike Hrvatske, piše Jutarnji.

Uhićena šibenska sutkinja Maja Šupe! Poznata je po oslobađajućoj presudi Horvatinčiću, a sumnja se da je u drugoj aferi za velike novce oslobodila optuženog, evo iznosa i imena koja se spominju

Da nije tjednik Nacional prije nekoliko mjeseci objavio iscrpan razgovor sa bivšim djelatnikom MUP-a Tomasom Rajnerom, možda bi ovaj slučaj možebitnog podmićivanja ostao zauvijek pod tepihom.

Spornu presudu koja ju je koštala uhićenja Šupe je donijela 25. studenoga 2013. te ju je Županijski sud, koji se nalazi u istoj zgradi kao i Općinski, unatoč žalbi tužiteljstva, odlučio i potvrditi u rujnu 2014.

Pitali smo stoga pravnike bi li nakon ovog otkrića, trebalo preispitati sve oslobađajuće presude koje je Šupe donijela i može li se za presudu u slučaju Blaža Petrovića zatražiti revizija s obzirom na sumnje pod kojima je ista donesena, piše Jutarnji.

Zagrebački odvjetnik Milko Križanović ističe da je "izrazito porazno po vladavinu prava i pravnu sigurnost saznanje da se za počinjenje teškog kaznenog davanja mita za pogodovanje pri odlučivanju u sudskom postupku tereti sudac i odvjetnik".

- Ukoliko se pokaže da je inkriminacija točna, to svakako za sobom povlači rezolutne posljedice, a to je da sudski postupak dovršen pravomoćnom presudom temeljenom na pogodovanju suca zbog primanja mita svakako će proizvesti apsolutnu posljedicu da takva ista bude ukinuta, jer svaka sudska presuda treba biti rezultat pravilne primjene procesnih i materijalnih propisa. Samo takva presuda može egzistirati u javnom prometu i regulirati pravne odnose. Dakle, svaka ona presuda donesena u postupku u kojem je sudac dokazano primio mito radi pogodovanja okrivljeniku, biti će ukinuta zbog ozbiljnih sumnji u istinitost odlučnih činjenica koje u sebi sadrži – kaže odvjetnik Križanović. Na upit može li se zatražiti revizija postupka za koji se sumnja da je presuđen kroz mito, Križanović napominje da može!

- Protiv pravomoćne sudske odluke i protiv sudskog postupka koji je prethodio takvoj odluci DORH može podnijeti Zahtjev za zaštitu zakonitosti! DORH nije vezan nikakvim rokom u pravcu podnošenja Zahtjeva za zaštitu zakonitosti, te mu zakonodavac daje slobodno odriješene ruke da reagira kad se za to ukaže potreba, odnosno kad utvrdi da je došlo do povrede zakona. Nema sumnje da će, ukoliko se inkriminacija primanja i davanja mira dokaže, presuda (protiv Blaža Petrovića koju je donijela Šupe o.pa) biti ukinuta te će se provesti novi kazneni postupak upravo radi pogibeljnost kaznenog djela davanja i primanja mita kao korupcijskog kaznenog djela. Jer ono zaslužuje snažnu društvenu osudu zbog razvijanja svijesti kod građana o velikoj društvenoj opasnosti djela kao takvih djela i potrebi njihova suzbijanja – zaključuje Križanović s napomenom da se takvim nečasnim radnjama razara društvena težnja za vladavinom prava.

Nije za isključiti ni da će ostale oslobađajuće presude koje je sutkinja Šupe donijela završiti pod lupom.

Nakon jučerašnjeg uhićenja šibenske sutkinje Maje Šupe, za koju USKOK sumnja da je primila 15.000 eura mita kako bi donijela oslobađajuću presudu u slučaju kontroverznog poduzetnika Blaža Petrovića, postavlja se pitanje treba li biti doveden u pitanje njezin cjelokupni pravosudni opus koji je žustro branila na jednom drugom, medijski popraćenom suđenju, navodeći pritom samu sebe kao primjer korektnosti i poštenja, i sve to u ime Republike Hrvatske, piše Jutarnji.

Uhićena šibenska sutkinja Maja Šupe! Poznata je po oslobađajućoj presudi Horvatinčiću, a sumnja se da je u drugoj aferi za velike novce oslobodila optuženog, evo iznosa i imena koja se spominju

Da nije tjednik Nacional prije nekoliko mjeseci objavio iscrpan razgovor sa bivšim djelatnikom MUP-a Tomasom Rajnerom, možda bi ovaj slučaj možebitnog podmićivanja ostao zauvijek pod tepihom.

Spornu presudu koja ju je koštala uhićenja Šupe je donijela 25. studenoga 2013. te ju je Županijski sud, koji se nalazi u istoj zgradi kao i Općinski, unatoč žalbi tužiteljstva, odlučio i potvrditi u rujnu 2014.

Pitali smo stoga pravnike bi li nakon ovog otkrića, trebalo preispitati sve oslobađajuće presude koje je Šupe donijela i može li se za presudu u slučaju Blaža Petrovića zatražiti revizija s obzirom na sumnje pod kojima je ista donesena, piše Jutarnji.

Zagrebački odvjetnik Milko Križanović ističe da je "izrazito porazno po vladavinu prava i pravnu sigurnost saznanje da se za počinjenje teškog kaznenog davanja mita za pogodovanje pri odlučivanju u sudskom postupku tereti sudac i odvjetnik".

- Ukoliko se pokaže da je inkriminacija točna, to svakako za sobom povlači rezolutne posljedice, a to je da sudski postupak dovršen pravomoćnom presudom temeljenom na pogodovanju suca zbog primanja mita svakako će proizvesti apsolutnu posljedicu da takva ista bude ukinuta, jer svaka sudska presuda treba biti rezultat pravilne primjene procesnih i materijalnih propisa. Samo takva presuda može egzistirati u javnom prometu i regulirati pravne odnose. Dakle, svaka ona presuda donesena u postupku u kojem je sudac dokazano primio mito radi pogodovanja okrivljeniku, biti će ukinuta zbog ozbiljnih sumnji u istinitost odlučnih činjenica koje u sebi sadrži – kaže odvjetnik Križanović.
