Pet godina od prometne nesreće tijekom koje je na županijsku cestu u Bilišanima istrčala divlja svinja, Lovište Diana d.o.o. iz Obrovca, mora platiti štetu nastalu na automobilu krapinskih oznaka. Sutkinja Općinskog suda u Benkovcu Dubravka Ćurko Ventrić, donijela je tu presudu, iako je do nesreće došlo na dijelu ceste na kojem su vozači prometnim znakom „divljač na cesti“ upozoreni na opasnost. Iako je uginula divlja svinja je u ovom je slučaju označena kao 'opasna stvar? čiji je vlasnik -  Lovište!

- U konkretnom slučaju nije sporno da je šteta nastala naletom vozila u vlasništvu tužiteljice na divlju svinju, a tuženikova odgovornost za nastalu štetu temelji se na citiranoj zakonskoj odredbi čl. 1063. i čl. 1064. ZOO, te je tuženik kao vlasnik opasne stvari – divlje svinje odgovoran za nastalu štetu, osim ako se dokaže da one nisu bile uzrok štete, dakle radi se o objektivnoj odgovornosti. Tuženik se odgovornosti mogao osloboditi sukladno citiranim odredbama čl. 1067. ZOO, međutim isti do zaključenja prethodnog postupka nije predložio niti jedan dokaz kojim bi dokazao suprotno- navodi se u obrazloženju presude benkovačkog suda.

Nesreća se odigrala 22. svibnja 2016. u mjestu Bilišane kada je oštećeno vozilo marke Opel Vivaro, osigurano policom kasko osiguranja. Vozač se kretao se županijskom cestom iz smjera Žegara u smjeru Obrovca kada je dolaskom do 9,5 km stupa s desne strane kolnika, iz lovišta na kolnik ispred vozila istrčala divlja svinja. Uslijed udarca na vozilu su nastala oštećenja prednjeg branika te prednjeg lijevog blatobrana a divlja svinja je uginula na licu mjesta. Životinju su preuzeli ophodari Cesta Zadarske županije. Vozač oštećenog vozila je alkotestiran na licu mjesta, no u krvi mu nije pronađen alkohol.

Sud nije uvažio odgovor na tužbu u kojem Lovište Diana navodi kako otklanja svaku odgovornost za nastalu štetu u prometnoj nezgodi jer su poduzeli sve dopuštene zakonske mjere s ciljem sprječavanja štete od naleta na divljač. Između ostalog na navednoj su dionici ceste zatražili postavljanje znakova upozorenja koji su i postavljeni.

Pet godina od prometne nesreće tijekom koje je na županijsku cestu u Bilišanima istrčala divlja svinja, Lovište Diana d.o.o. iz Obrovca, mora platiti štetu nastalu na automobilu krapinskih oznaka. Sutkinja Općinskog suda u Benkovcu Dubravka Ćurko Ventrić, donijela je tu presudu, iako je do nesreće došlo na dijelu ceste na kojem su vozači prometnim znakom „divljač na cesti“ upozoreni na opasnost. Iako je uginula divlja svinja je u ovom je slučaju označena kao 'opasna stvar? čiji je vlasnik -  Lovište!

- U konkretnom slučaju nije sporno da je šteta nastala naletom vozila u vlasništvu tužiteljice na divlju svinju, a tuženikova odgovornost za nastalu štetu temelji se na citiranoj zakonskoj odredbi čl. 1063. i čl. 1064. ZOO, te je tuženik kao vlasnik opasne stvari – divlje svinje odgovoran za nastalu štetu, osim ako se dokaže da one nisu bile uzrok štete, dakle radi se o objektivnoj odgovornosti. Tuženik se odgovornosti mogao osloboditi sukladno citiranim odredbama čl. 1067. ZOO, međutim isti do zaključenja prethodnog postupka nije predložio niti jedan dokaz kojim bi dokazao suprotno- navodi se u obrazloženju presude benkovačkog suda.

Nesreća se odigrala 22. svibnja 2016. u mjestu Bilišane kada je oštećeno vozilo marke Opel Vivaro, osigurano policom kasko osiguranja. Vozač se kretao se županijskom cestom iz smjera Žegara u smjeru Obrovca kada je dolaskom do 9,5 km stupa s desne strane kolnika, iz lovišta na kolnik ispred vozila istrčala divlja svinja. Uslijed udarca na vozilu su nastala oštećenja prednjeg branika te prednjeg lijevog blatobrana a divlja svinja je uginula na licu mjesta. Životinju su preuzeli ophodari Cesta Zadarske županije. Vozač oštećenog vozila je alkotestiran na licu mjesta, no u krvi mu nije pronađen alkohol.

Sud nije uvažio odgovor na tužbu u kojem Lovište Diana navodi kako otklanja svaku odgovornost za nastalu štetu u prometnoj nezgodi jer su poduzeli sve dopuštene zakonske mjere s ciljem sprječavanja štete od naleta na divljač. Između ostalog na navednoj su dionici ceste zatražili postavljanje znakova upozorenja koji su i postavljeni.

Životinja uginula, a Lovište ‘Diana‘ mora platiti vozaču odštetu jer je divlja svinja njihova - ‘opasna stvar‘!

Pet godina od prometne nesreće tijekom koje je na županijsku cestu u Bilišanima istrčala divlja svinja, Lovište Diana d.o.o. iz Obrovca, mora platiti štetu nastalu na automobilu krapinskih oznaka. Sutkinja Općinskog suda u Benkovcu Dubravka Ćurko Ventrić, donijela je tu presudu, iako je do nesreće došlo na dijelu ceste na kojem su vozači prometnim znakom „divljač na cesti“ upozoreni na opasnost. Iako je uginula divlja svinja je u ovom je slučaju označena kao 'opasna stvar? čiji je vlasnik -  Lovište!

- U konkretnom slučaju nije sporno da je šteta nastala naletom vozila u vlasništvu tužiteljice na divlju svinju, a tuženikova odgovornost za nastalu štetu temelji se na citiranoj zakonskoj odredbi čl. 1063. i čl. 1064. ZOO, te je tuženik kao vlasnik opasne stvari – divlje svinje odgovoran za nastalu štetu, osim ako se dokaže da one nisu bile uzrok štete, dakle radi se o objektivnoj odgovornosti. Tuženik se odgovornosti mogao osloboditi sukladno citiranim odredbama čl. 1067. ZOO, međutim isti do zaključenja prethodnog postupka nije predložio niti jedan dokaz kojim bi dokazao suprotno- navodi se u obrazloženju presude benkovačkog suda.

Nesreća se odigrala 22. svibnja 2016. u mjestu Bilišane kada je oštećeno vozilo marke Opel Vivaro, osigurano policom kasko osiguranja. Vozač se kretao se županijskom cestom iz smjera Žegara u smjeru Obrovca kada je dolaskom do 9,5 km stupa s desne strane kolnika, iz lovišta na kolnik ispred vozila istrčala divlja svinja. Uslijed udarca na vozilu su nastala oštećenja prednjeg branika te prednjeg lijevog blatobrana a divlja svinja je uginula na licu mjesta. Životinju su preuzeli ophodari Cesta Zadarske županije. Vozač oštećenog vozila je alkotestiran na licu mjesta, no u krvi mu nije pronađen alkohol.

Sud nije uvažio odgovor na tužbu u kojem Lovište Diana navodi kako otklanja svaku odgovornost za nastalu štetu u prometnoj nezgodi jer su poduzeli sve dopuštene zakonske mjere s ciljem sprječavanja štete od naleta na divljač. Između ostalog na navednoj su dionici ceste zatražili postavljanje znakova upozorenja koji su i postavljeni.
