Tri od četiri amandmana koja su u proračun Grada Zadra za 2024. godinu predložili vijećnici Akcije mladih i Nezavisne liste Enija Meštrovića su nezakonita, potvrdilo je Ministarstvo financija koje je u ponedjeljak Gradu Zadru dostavilo svoju odluku o zakonitosti najvažnijeg gradskog dokumenta. 

Odluku o obustavi proračuna koju je donio gradonačelnik Branko Dukić ocijenili su osnovanom, odnosno valjanom, jer su u proračun uvršteni amandmani čiji su izvori financiranja nezakoniti. Ministarstvo je tako potvrdilo stav gradonačelnika o nezakonitim amandmanima, ali ne za njih četiri, koliko ih je Dukić izdvojio, nego za tri. Za četvrti amandman u Ministarstvu nisu ništa napisali, očito su ga ili zaboravili ili predvidjeli, što znači da će za konačan pravorijek o (ne)zakonitostima u proračunu trebati pričekati još neko vrijeme.

Podsjetimo, nakon glasanja o proračunu, iz Grada su rekli kako su dva amandmana Akcije mladih - povećanje iznosa stipendija i izrada prostorno planske dokumentacije za izgradnju OŠ Jurja Dalmatinca - te dva amandmana nezavisne liste Enija Meštrovića - izgradnja krematorija i povećanje sredstva za sportsku zajednicu – nezakoniti.

U obrazloženju Ministarstvo financija međutim Meštrovićev amandman za sportsku zajednicu uopće se ne spominje, niti kao zakonit niti kao nezakonit, naprotiv, izgleda kao da su ga potpuno zaboravili ocijeniti.

Zato je nezakonitim ocijenjen Meštrovićev amandman za krematorij u iznosu od 5,2 milijuna eura. Nezavisni vijećnici su novac u iznosu od 4,6 milijuna eura za izgradnju krematorija htjeli uzeti iz programa za izgradnju i uređenje komunalne infrastrukture. Međutim ta stavka proračuna u sebi sadrži brojne već otprije ugovorene obveze, kao što je gradnja infrastrukture na Vitrenjaku, rekonstrukcija Krešimirove obale, rekonstrukcija dijela ulice Admirala Jakova Šubića od Cezana, rekonstrukcija raskrižja ulica Put Biliga i Put Pudarice, izgradnja spojne ceste Ulice Miroslava Krleže s Obalom kneza Trpimira te izgradnje prometnice u Crnom u svrhu stambenog zbrinjavanja mladih.

Ostatak novaca za izgradnju krematorija također su htjeli uzeti iz izgradnje javnih površina, iako su ta sredstava već odavno "rezervirana" za izgradnju parternog uređenja rive.

- Utvrđeno je da su usvojenim amandmanom smanjeni rashodi koji se odnose na već ranije preuzete obveze Grada Zadra što je protivno članku 41. stavku 3. Zakona o proračunu, navodi se u obrazloženju Ministarstva.

Amandman Akcije mladih vezan uz povećanje sredstava za stipendije od 30 tisuća eura također nije u skladu s zakonom. Novac za stipendija htjeli su uzeti iz rashoda, međutim, u proračunu se stipendije definiraju kao izdaci.

- Smanjenje proračunskih rashoda dopušteno je samo na račun povećanja proračunskih rashoda, a ne na teret proračunskih izdataka, objašnjavaju iz Ministarstva financija.

Izvori financiranja za amandman koji se tiče izrade prostorno planske dokumentacije za OŠ Jurja Dalmatinca u iznosu od 13 tisuća eura također je nezakoniti jer se novac za takav projekt ne može uzimati sa stavke namijenjene za ŠC Višnjik.

Amandman na koji je Ministarstvo zaboravilo jest povećanje sredstava za sportsku zajednicu u iznosu od 1.809.509,31 euro.

Nezavisni su htjeli za taj amandman uzeti novac iz komunalne naknade u iznosu od 1,3 milijuna eura. Međutim to nije moguće jer se sredstva prikupljena od komunalne naknade smiju trošiti samo za održavanje i građenje komunalne infrastrukture, a temeljem odluke Gradskog vijeća i za građenje i održavanje predškolskih, školskih, zdravstvenih ustanova, objekata sportske ili kulturne namjene ili za poboljšanje energetske učinkovitosti zgrada u vlasništvu jedinica lokalne samouprave. Novac koji su nezavisni htjeli preusmjeriti Sportskoj zajednici trošio bi se na plaćanje članarina i terena te za plaće trenerima, što nije u skladu sa Zakonom. Za ovaj amandman su htjeli uzeti 500 tisuća eura od ŠC Višnjik te 9.509 eura iz aktivnosti za zaštitu okoliša.

Tri od četiri amandmana koja su u proračun Grada Zadra za 2024. godinu predložili vijećnici Akcije mladih i Nezavisne liste Enija Meštrovića su nezakonita, potvrdilo je Ministarstvo financija koje je u ponedjeljak Gradu Zadru dostavilo svoju odluku o zakonitosti najvažnijeg gradskog dokumenta. 

Odluku o obustavi proračuna koju je donio gradonačelnik Branko Dukić ocijenili su osnovanom, odnosno valjanom, jer su u proračun uvršteni amandmani čiji su izvori financiranja nezakoniti. Ministarstvo je tako potvrdilo stav gradonačelnika o nezakonitim amandmanima, ali ne za njih četiri, koliko ih je Dukić izdvojio, nego za tri. Za četvrti amandman u Ministarstvu nisu ništa napisali, očito su ga ili zaboravili ili predvidjeli, što znači da će za konačan pravorijek o (ne)zakonitostima u proračunu trebati pričekati još neko vrijeme.

Podsjetimo, nakon glasanja o proračunu, iz Grada su rekli kako su dva amandmana Akcije mladih - povećanje iznosa stipendija i izrada prostorno planske dokumentacije za izgradnju OŠ Jurja Dalmatinca - te dva amandmana nezavisne liste Enija Meštrovića - izgradnja krematorija i povećanje sredstva za sportsku zajednicu – nezakoniti.

U obrazloženju Ministarstvo financija međutim Meštrovićev amandman za sportsku zajednicu uopće se ne spominje, niti kao zakonit niti kao nezakonit, naprotiv, izgleda kao da su ga potpuno zaboravili ocijeniti.

Zato je nezakonitim ocijenjen Meštrovićev amandman za krematorij u iznosu od 5,2 milijuna eura. Nezavisni vijećnici su novac u iznosu od 4,6 milijuna eura za izgradnju krematorija htjeli uzeti iz programa za izgradnju i uređenje komunalne infrastrukture. Međutim ta stavka proračuna u sebi sadrži brojne već otprije ugovorene obveze, kao što je gradnja infrastrukture na Vitrenjaku, rekonstrukcija Krešimirove obale, rekonstrukcija dijela ulice Admirala Jakova Šubića od Cezana, rekonstrukcija raskrižja ulica Put Biliga i Put Pudarice, izgradnja spojne ceste Ulice Miroslava Krleže s Obalom kneza Trpimira te izgradnje prometnice u Crnom u svrhu stambenog zbrinjavanja mladih.

Ostatak novaca za izgradnju krematorija također su htjeli uzeti iz izgradnje javnih površina, iako su ta sredstava već odavno "rezervirana" za izgradnju parternog uređenja rive.

- Utvrđeno je da su usvojenim amandmanom smanjeni rashodi koji se odnose na već ranije preuzete obveze Grada Zadra što je protivno članku 41. stavku 3. Zakona o proračunu, navodi se u obrazloženju Ministarstva.

Amandman Akcije mladih vezan uz povećanje sredstava za stipendije od 30 tisuća eura također nije u skladu s zakonom. Novac za stipendija htjeli su uzeti iz rashoda, međutim, u proračunu se stipendije definiraju kao izdaci.

- Smanjenje proračunskih rashoda dopušteno je samo na račun povećanja proračunskih rashoda, a ne na teret proračunskih izdataka, objašnjavaju iz Ministarstva financija.

Izvori financiranja za amandman koji se tiče izrade prostorno planske dokumentacije za OŠ Jurja Dalmatinca u iznosu od 13 tisuća eura također je nezakoniti jer se novac za takav projekt ne može uzimati sa stavke namijenjene za ŠC Višnjik.

Amandman na koji je Ministarstvo zaboravilo jest povećanje sredstava za sportsku zajednicu u iznosu od 1.809.509,31 euro.

Nezavisni su htjeli za taj amandman uzeti novac iz komunalne naknade u iznosu od 1,3 milijuna eura. Međutim to nije moguće jer se sredstva prikupljena od komunalne naknade smiju trošiti samo za održavanje i građenje komunalne infrastrukture, a temeljem odluke Gradskog vijeća i za građenje i održavanje predškolskih, školskih, zdravstvenih ustanova, objekata sportske ili kulturne namjene ili za poboljšanje energetske učinkovitosti zgrada u vlasništvu jedinica lokalne samouprave. Novac koji su nezavisni htjeli preusmjeriti Sportskoj zajednici trošio bi se na plaćanje članarina i terena te za plaće trenerima, što nije u skladu sa Zakonom. Za ovaj amandman su htjeli uzeti 500 tisuća eura od ŠC Višnjik te 9.509 eura iz aktivnosti za zaštitu okoliša.
