Županijski sud u Slavonskom Brodu presudio je 26. rujna 2020. potpuno u duhu prava EU presudom Gž-796/2020 da Addiko banka mora vratiti oko 6.000 kuna naplaćene izlazne naknade za prijevremenu otplatu kredita potrošaču, unatoč tome što je ta naknada bila ugovorena u točnom postotnom iznosu preostale glavnice. Presuda je po svojim obrazloženjima identična sličnim presudama Suda EU o transparentnosti ugovornih odredaba.

Istaknuto je to u objavi udruge Franak iz koje poručuju kako su već  izvještavali o nekoliko pravomoćnih presuda kojima je nedvojbeno utvrđeno da banka nema pravo ugovarati naknadu za prijevremenu otplatu kredita u skladu s Općim uvjetima banke, a sada imaju i pravomoćnu presudu u kojoj je utvrđeno da banka ni u kojem slučaju ne smije ugovarati izlaznu naknadu odnosno nekakvu taksu ili unaprijed utvrđenu štetu koja nastaje zbog prijevremene otplate kredita.

-Potpuno je jasno da banka nema i ne može imati štetu zbog toga što je potrošač prijevremeno otplatio kredit, i da u tome slučaju banka može tim vraćenim novcem raspolagati i ponovno ga ulagati tamo gdje je to moguće- ističu u udruzi.

U konkretnom ugovoru o kreditu odredba o izlaznoj naknadi je glasila: "U slučaju prijevremene konačne otplate kredita banka je ovlaštena zaračunati i taksu od 2,5% (dva i pol posto) od preostalog iznosa kredita".

Pojašnjavaju kako se radilo o predmetu koji je na Općinskom sudu u Zagrebu dvaput odbijen, prvi puta je Županijski sud u Slavonskome Brodu vratio predmet na ponovno suđenje s obrazloženjima zašto je to potrebno, dok je nakon druge ponovno negativne odluke brodski sud preinačio presudu, dosudio potrošaču pravo na vraćanje naplaćene izlazne naknade i naplatu pripadajućih zateznih kamata, sa sljedećim obrazloženjima:

-Ugovorena odredba sama po sebi ne bi bila ništetna, ako bi se o njoj kod ugovaranja pregovaralo. Na ništetnost ugovorne odredbe o naknadi za prijevremenu otplatu kredita presudno je koji su to pravedni i objektivni troškovi eventualno nastali kod prijevremene otplate kredita. Obračun naknade mora biti transparentan i razumljiv, i to kako u vrijeme sklapanja ugovora, tako i prilikom same prijevremene otplate. Naknada za prijevremenu otplatu ne smije se odnositi na eventualnu štetu zbog neostvarenih kamata. Kod otplate kredita nije utvrđeno na što se konkretno odnosi trošak koji je naplaćen. Budući da se o naknadi nije pregovaralo, budući da ona nije transparentna jer nije jasno na koje se konkretne troškove ona odnosi, takva odredba uzrokovala je neravnotežu prava i obveza na štetu potrošača, i zbog toga je ništetna - istaknuto je u objavi.

Nakon te nove presude  iz udruge Franak podsjećaju što je sve ništetno u hrvatskim ugovorima o kreditu:

Valutna klauzula CHF u potrošačkim kreditima, pravomoćno utvrđeno kolektivnom presudom.

Promjenjiva kamatna stopa koja se mijenja odlukom banke za sve vrste kredita i sve valute, i to kako za potrošače, tako i za pravne osobe, potvrđeno u nekoliko desetaka pravomoćnih presuda.

Izlazne naknade za prijevremenu otplatu kredita, potvrđeno u više pravomoćnih presuda.

Ulazna naknada za obradu kredita, potvrđeno ovogodišnjim presudama Suda EU C-224/19 i C-84/19.

-Zaključimo, ugovori u kojima su ništetni valutna klauzula, kamata te ulazne i izlazne naknade nikako ne mogu opstati, pa tako već imamo čitav niz prvostupanjskih presuda da su CHF ugovori ništetni, imamo i jednu pravomoćnu presudu da su dva CHF ugovora ništetna, i konačno, imamo presudu Suda EU C-118/17 koja nedvojbeno govori o tome da ugovori s ništetnom valutom trebaju biti kompletno ništetni! - ističu u udrruzi Franak.

-Svega je nekoliko stotina opljačkanih građana pravomoćnim presudama dosad obeštećeno, a deseci tisuća tek dolaze na svoj red. Velike pobjede su iza nas, ali tek dolazi vrijeme obračuna s bankama, koje zasad drže na svojim računima nekoliko desetaka milijardi kuna koje pripadaju hrvatskim ljudima opljačkanim nepoštenim kreditima! U svemu tome ogroman je grijeh Hrvatske narodne banke koja je kao regulator i nadziratelj poslovanja banaka trebala bankama uputiti u najmanju ruku preporuku da obeštete opljačkane potrošače, ali i pravne osobe kada su neodredive kamate u pitanju! - zaključuju u udruzi Franak.

Županijski sud u Slavonskom Brodu presudio je 26. rujna 2020. potpuno u duhu prava EU presudom Gž-796/2020 da Addiko banka mora vratiti oko 6.000 kuna naplaćene izlazne naknade za prijevremenu otplatu kredita potrošaču, unatoč tome što je ta naknada bila ugovorena u točnom postotnom iznosu preostale glavnice. Presuda je po svojim obrazloženjima identična sličnim presudama Suda EU o transparentnosti ugovornih odredaba.

Istaknuto je to u objavi udruge Franak iz koje poručuju kako su već  izvještavali o nekoliko pravomoćnih presuda kojima je nedvojbeno utvrđeno da banka nema pravo ugovarati naknadu za prijevremenu otplatu kredita u skladu s Općim uvjetima banke, a sada imaju i pravomoćnu presudu u kojoj je utvrđeno da banka ni u kojem slučaju ne smije ugovarati izlaznu naknadu odnosno nekakvu taksu ili unaprijed utvrđenu štetu koja nastaje zbog prijevremene otplate kredita.

-Potpuno je jasno da banka nema i ne može imati štetu zbog toga što je potrošač prijevremeno otplatio kredit, i da u tome slučaju banka može tim vraćenim novcem raspolagati i ponovno ga ulagati tamo gdje je to moguće- ističu u udruzi.

U konkretnom ugovoru o kreditu odredba o izlaznoj naknadi je glasila: "U slučaju prijevremene konačne otplate kredita banka je ovlaštena zaračunati i taksu od 2,5% (dva i pol posto) od preostalog iznosa kredita".

Pojašnjavaju kako se radilo o predmetu koji je na Općinskom sudu u Zagrebu dvaput odbijen, prvi puta je Županijski sud u Slavonskome Brodu vratio predmet na ponovno suđenje s obrazloženjima zašto je to potrebno, dok je nakon druge ponovno negativne odluke brodski sud preinačio presudu, dosudio potrošaču pravo na vraćanje naplaćene izlazne naknade i naplatu pripadajućih zateznih kamata, sa sljedećim obrazloženjima:

-Ugovorena odredba sama po sebi ne bi bila ništetna, ako bi se o njoj kod ugovaranja pregovaralo. Na ništetnost ugovorne odredbe o naknadi za prijevremenu otplatu kredita presudno je koji su to pravedni i objektivni troškovi eventualno nastali kod prijevremene otplate kredita. Obračun naknade mora biti transparentan i razumljiv, i to kako u vrijeme sklapanja ugovora, tako i prilikom same prijevremene otplate. Naknada za prijevremenu otplatu ne smije se odnositi na eventualnu štetu zbog neostvarenih kamata. Kod otplate kredita nije utvrđeno na što se konkretno odnosi trošak koji je naplaćen. Budući da se o naknadi nije pregovaralo, budući da ona nije transparentna jer nije jasno na koje se konkretne troškove ona odnosi, takva odredba uzrokovala je neravnotežu prava i obveza na štetu potrošača, i zbog toga je ništetna - istaknuto je u objavi.

Nakon te nove presude  iz udruge Franak podsjećaju što je sve ništetno u hrvatskim ugovorima o kreditu:

Valutna klauzula CHF u potrošačkim kreditima, pravomoćno utvrđeno kolektivnom presudom.

Promjenjiva kamatna stopa koja se mijenja odlukom banke za sve vrste kredita i sve valute, i to kako za potrošače, tako i za pravne osobe, potvrđeno u nekoliko desetaka pravomoćnih presuda.

Izlazne naknade za prijevremenu otplatu kredita, potvrđeno u više pravomoćnih presuda.

Ulazna naknada za obradu kredita, potvrđeno ovogodišnjim presudama Suda EU C-224/19 i C-84/19.

-Zaključimo, ugovori u kojima su ništetni valutna klauzula, kamata te ulazne i izlazne naknade nikako ne mogu opstati, pa tako već imamo čitav niz prvostupanjskih presuda da su CHF ugovori ništetni, imamo i jednu pravomoćnu presudu da su dva CHF ugovora ništetna, i konačno, imamo presudu Suda EU C-118/17 koja nedvojbeno govori o tome da ugovori s ništetnom valutom trebaju biti kompletno ništetni! - ističu u udrruzi Franak.

-Svega je nekoliko stotina opljačkanih građana pravomoćnim presudama dosad obeštećeno, a deseci tisuća tek dolaze na svoj red. Velike pobjede su iza nas, ali tek dolazi vrijeme obračuna s bankama, koje zasad drže na svojim računima nekoliko desetaka milijardi kuna koje pripadaju hrvatskim ljudima opljačkanim nepoštenim kreditima! U svemu tome ogroman je grijeh Hrvatske narodne banke koja je kao regulator i nadziratelj poslovanja banaka trebala bankama uputiti u najmanju ruku preporuku da obeštete opljačkane potrošače, ali i pravne osobe kada su neodredive kamate u pitanju! - zaključuju u udruzi Franak.

Udruga Franak: Banka ne smije ugovarati izlaznu naknadu ili unaprijed utvrđenu štetu koja nastaje zbog prijevremene otplate kredita

Županijski sud u Slavonskom Brodu presudio je 26. rujna 2020. potpuno u duhu prava EU presudom Gž-796/2020 da Addiko banka mora vratiti oko 6.000 kuna naplaćene izlazne naknade za prijevremenu otplatu kredita potrošaču, unatoč tome što je ta naknada bila ugovorena u točnom postotnom iznosu preostale glavnice. Presuda je po svojim obrazloženjima identična sličnim presudama Suda EU o transparentnosti ugovornih odredaba.

Istaknuto je to u objavi udruge Franak iz koje poručuju kako su već  izvještavali o nekoliko pravomoćnih presuda kojima je nedvojbeno utvrđeno da banka nema pravo ugovarati naknadu za prijevremenu otplatu kredita u skladu s Općim uvjetima banke, a sada imaju i pravomoćnu presudu u kojoj je utvrđeno da banka ni u kojem slučaju ne smije ugovarati izlaznu...
