Odvjetnici Tomislava Tolušića i Josipa Aladrovića zatražili su od Državnog odvjetništva i MUP-a da utvrde kako su u medije "iscurili" detalji iskaza te dvojice bivših HDZ-ovih ministara iz istrage koju je do nedavno protiv njih provodio Uskok i očekuje se podizanje optužnice.
"Činjene dostupnima sadržaja dokaznih radnji iz istrage javnosti predstavlja narušavanje legitimiteta, nepristranosti te uopće podriva zakonsku poziciju samog tijela kaznenog progona koje istragu provodi", istaknuli su u dopisu DORH-u i MUP-u odvjetnici Nikola Mandić i Ivan Stanić.
Dodaju da pritom dolazi do teškog narušavanja Ustavom zajamčene presumpcije nevinosti okrivljene osobe, a dovodi se u sumnju i postupanja tijela kaznenog progona.
"Proizlazi iz ovakvih spornih objava, da postoji mogućnost da je netko iz samog tijela kaznenog progona učinio dostupnim trećim osobama sadržaje dokaznih radnji koje su pribavljeni u toj istrazi. Tada više stožerna točka razmatranja ove problematike nije nejavnost istrage, već moguće počinjenje kaznenog djela odavanja službene tajne ili pak kojeg drugog kaznenog djela koje u sebi objedinjuje zlouporabu položaja ili danih ovlasti".
Odvjetnici ističu i da se iznošenjem konkretnog sadržaja dokazne radnje potpuno onemogućava pravično suđenje osobama protiv koje se vodi kazneni postupak.
"Ovim putem ne želimo dovoditi u pitanje interes javnosti za provođenje ovog kaznenog postupka u kojem se nalaze navedeni okrivljenici kao niti interes novinarske profesije da dođu u posjed sadržaja dokazne radnje, već krajnje opasnim i institucionalno destabilizirajućim smatramo činjenicu da je netko sadržaj dokazne radnje iz istrage učinio dostupnim trećoj osobi”.
Navode i da je problematika tzv. curenja informacija iz predmeta koji se vode u DORH-u ili Uskoku povremena, ali i vječna tematika s kojom se susreću osobe uključene u kaznene postupke u RH.
"Tzv. curenje informacija iz istrage u kaznenom postupku predstavlja koruptivnu opasnost koja ima za posljedicu narušavanje svih ranije navedenih prava okrivljenika u kaznenom postupku kao i narušavanje ugleda institucije koja provodi istragu. Shodno tome, a vezano za ovaj konkretan slučaj, kao branitelji u ovom kaznenom postupku, najprije molimo da nadležne redarstvene vlasti kao i nadležno Državno odvjetništvo točnije Uskok pokrenu istraživanje u svezi mogućeg počinjenja kaznenog djela odavanjem podataka iz ovog kaznenog predmeta”, zaključuju.
Nije prošlo dugo, stigao je i odgovor prozvanih tijel. Državno odvjetništvo i Uskok priopćili su da nisu izvor informacija objavljenih u medijima, nakon što je Jutarnji list objavio dio sadržaja obrana četvorice Uskokovih okrivljenika, bivših ministara Darka Horvata, Tomislava Tolušića, Borisa Miloševića i Josipa Aladrovića.
"Napominjemo kako prema Zakonu o kaznenom postupku istraga nije tajna nego je nejavna, zbog čega ponovno naglašavamo da ni Uskok, kao nadležno državno odvjetništvo niti DORH nisu izvor informacija za navedeni dnevni list, budući da je poznat i u više navrata istican državnoodvjetnički stav - objavljivanje sadržaja dokaznih radnji provedenih tijekom istrage šteti probicima kaznenog postupka", objavilo je tužiteljstvo.
Odmah nakon ispitivanja okrivljenika, ističu, svaki okrivljenik i njegov branitelj preuzimaju originalnu snimku tog ispitivanja, a tako je bilo i u ovom slučaju.
Ujedno, nakon donošenja rješenja o provođenju istrage svi okrivljenici i njihovi branitelji imaju pravo uvida u spis i pravo razgledavanja, prepisivanja, preslikavanja i snimanja spisa. U ovom predmetu uvid u spis izvršili su branitelji sedmero okrivljenika, kao i vježbenici nekih od navedenih odvjetničkih ureda, stoji u priopćenju.

Odvjetnici Tomislava Tolušića i Josipa Aladrovića zatražili su od Državnog odvjetništva i MUP-a da utvrde kako su u medije "iscurili" detalji iskaza te dvojice bivših HDZ-ovih ministara iz istrage koju je do nedavno protiv njih provodio Uskok i očekuje se podizanje optužnice.
"Činjene dostupnima sadržaja dokaznih radnji iz istrage javnosti predstavlja narušavanje legitimiteta, nepristranosti te uopće podriva zakonsku poziciju samog tijela kaznenog progona koje istragu provodi", istaknuli su u dopisu DORH-u i MUP-u odvjetnici Nikola Mandić i Ivan Stanić.
Dodaju da pritom dolazi do teškog narušavanja Ustavom zajamčene presumpcije nevinosti okrivljene osobe, a dovodi se u sumnju i postupanja tijela kaznenog progona.
"Proizlazi iz ovakvih spornih objava, da postoji mogućnost da je netko iz samog tijela kaznenog progona učinio dostupnim trećim osobama sadržaje dokaznih radnji koje su pribavljeni u toj istrazi. Tada više stožerna točka razmatranja ove problematike nije nejavnost istrage, već moguće počinjenje kaznenog djela odavanja službene tajne ili pak kojeg drugog kaznenog djela koje u sebi objedinjuje zlouporabu položaja ili danih ovlasti".
Odvjetnici ističu i da se iznošenjem konkretnog sadržaja dokazne radnje potpuno onemogućava pravično suđenje osobama protiv koje se vodi kazneni postupak.
"Ovim putem ne želimo dovoditi u pitanje interes javnosti za provođenje ovog kaznenog postupka u kojem se nalaze navedeni okrivljenici kao niti interes novinarske profesije da dođu u posjed sadržaja dokazne radnje, već krajnje opasnim i institucionalno destabilizirajućim smatramo činjenicu da je netko sadržaj dokazne radnje iz istrage učinio dostupnim trećoj osobi”.
Navode i da je problematika tzv. curenja informacija iz predmeta koji se vode u DORH-u ili Uskoku povremena, ali i vječna tematika s kojom se susreću osobe uključene u kaznene postupke u RH.
"Tzv. curenje informacija iz istrage u kaznenom postupku predstavlja koruptivnu opasnost koja ima za posljedicu narušavanje svih ranije navedenih prava okrivljenika u kaznenom postupku kao i narušavanje ugleda institucije koja provodi istragu. Shodno tome, a vezano za ovaj konkretan slučaj, kao branitelji u ovom kaznenom postupku, najprije molimo da nadležne redarstvene vlasti kao i nadležno Državno odvjetništvo točnije Uskok pokrenu istraživanje u svezi mogućeg počinjenja kaznenog djela odavanjem podataka iz ovog kaznenog predmeta”, zaključuju.
Nije prošlo dugo, stigao je i odgovor prozvanih tijel. Državno odvjetništvo i Uskok priopćili su da nisu izvor informacija objavljenih u medijima, nakon što je Jutarnji list objavio dio sadržaja obrana četvorice Uskokovih okrivljenika, bivših ministara Darka Horvata, Tomislava Tolušića, Borisa Miloševića i Josipa Aladrovića.
"Napominjemo kako prema Zakonu o kaznenom postupku istraga nije tajna nego je nejavna, zbog čega ponovno naglašavamo da ni Uskok, kao nadležno državno odvjetništvo niti DORH nisu izvor informacija za navedeni dnevni list, budući da je poznat i u više navrata istican državnoodvjetnički stav - objavljivanje sadržaja dokaznih radnji provedenih tijekom istrage šteti probicima kaznenog postupka", objavilo je tužiteljstvo.
Odmah nakon ispitivanja okrivljenika, ističu, svaki okrivljenik i njegov branitelj preuzimaju originalnu snimku tog ispitivanja, a tako je bilo i u ovom slučaju.
Ujedno, nakon donošenja rješenja o provođenju istrage svi okrivljenici i njihovi branitelji imaju pravo uvida u spis i pravo razgledavanja, prepisivanja, preslikavanja i snimanja spisa. U ovom predmetu uvid u spis izvršili su branitelji sedmero okrivljenika, kao i vježbenici nekih od navedenih odvjetničkih ureda, stoji u priopćenju.
