Visoki trgovački sud potvrdio je presudu Trgovačkog suda u Splitu, donijetu početkom rujna ove godine, a kojom je zbog povrede autorskih prava zagrebačkih arhitekata Dine Vulin Ileković i Borisa Ilekovića Gradu Šibeniku i arhitektu Zoranu Popoviću izdana mjera zabrane radova na većem dijelu Tvrđave sv. Ivana.

- Glavni projekt i njegove izmjene imaju obilježje autorskog djela, što je uostalom priznao i sam prvotuženik (Grad Šibenik, op. Z.Š.) sklapajući ugovor o izmjeni idejnog, glavnog i izvedbenog projekta s pripadajućim troškovnicima za uređenje tvrđave Sv. Ivana od 7.rujna 2017. kada je u članku 6. ugovorio da izvršitelj ima autorsko pravo nad izrađenim projektom. Navedeni glavni projekt, a osobito njegovu izmjenu napravili su tužitelji koji u kontekstu članaka 74., 75. i 76. mjerodavnog prava zadržavaju autorsko pravo na autorskom djelu stvorenog po narudžbi i u radnom odnosu ukoliko pravo iskorištavanja autorskogdjela ugovorom o radu nije preneseno na poslodavca. U nedostatku dokaza koji bi govorio suprotno, sud zaključuje da su tužitelji kao autori ex lege zadržali pravo na glavnom projektu i njegovoj izmjeni u cijelosti – napisala je u presudi sutkinja Kamelija Parać, koja inače u stručnim krugovima slovi za jedan od vodećih autoriteta u području intelektulanog vlasništva.

Posao joj je olakšao i sam Grad Šibenik, kao i arhitekt kojeg su angažirali nakon otkaza suradnje zagrebačkom dvojcu, jer su, kako je ustanovila sutkinja, u podnesku od 17. srpnja ove godine sami izrijekom naveli da je formalno izvršena izmjena i dopuna gotovo cijelog glavnog projekta. Grad i Popović branili su se tezom da su imali pravo pristupiti izmjenama arhitektonskog djela jer da su to zahtijevali sigurnosni i tehnički razlozi te da se tome izvorni autori nisu mogli protiviti jer je projekt usklađen s posebnim uvjetima Konzervatorskog odjela u Šibeniku, ali to im u konačnici nije prošlo.

Visoki trgovački sud nije donio nikakvu odluku po pitanju kršenja priremene mjere zabrane radova na većem dijelu tvrđave jer se oko toga već vodi spor. I njega su pokrenuli supružnici Ileković i predmet je dlegiran na Općinski sud u Kninu, ali nitko od tuženih u srijedu se nije pojavio na ročištu. Gradu, gradonačelniku Željku Buriću i arhitektu Zoranu Popoviću prijeti opasnost da budu kažnjeni sa 100.000 kuna (pravna osoba), odnosno s po 10 tisuća kuna (fizičke osobe).

Boris Ileković, unatoč ovakvoj presudi i činjenici da Trgovačkom sudu u Splitu ne preostaje ništa nego donijeti još jedno rješenje u njihovu korist, uvjerenja je da će Grad i dalje nastaviti s radovima i forsirati s dovršetkom projekta vrijednog 50 milijuna kuna (dvije trećine financra se iz EU-fondova).

- Prema podacima kojima mi raspolažemo, oni uvelike rade i betoniraju po izmjenama i dopunama dozvole što su ih ishodovali za vrijeme sudske zabrane. Tkave izmjene su ništave, jer nikakve korake ni Grad ni kolega Popović nisu smjeli poduzimati. Na potezu je država da ih prisile da poštuju njezine presude – komentirao nam je Popović i podcrtao jednu važnu činjenicu:

- Nama je najbitnije da smo prvi arhitekti u Hrvatskoj koji su dobili presudu jer su im ugrožena autorska prava. Ovo je lekcija da se može stai na kraj samovolji investitora koji se, kao u našem slučaju, hvali da imaju pun bunar novca!

Ileković nam je podastro i dokaze da druga strana intenzivno nastoji pribaviti dokumentaciju kojom bi legalizirali radove što su ih izvodili za vrijeme sudske zabrane.

- Definitivno na jednoj parceli ne može biti više važećih građevinskih dozvola, nego se rade izmjene i dopune osnovne građevne dozvole. Nejasno nam je kako to da je iz evidencije izbrisana izmjena i dopuna građ. dozvole od 4.5.2019., pribavljena temeljem naše zadnje dokumentacije i temeljem koje je otvoreno gradilište u 2019. godine. Prema informaciji sa službenog web portala, Grad je sam sebi izdao dozvolu 29.10.2020., znači za vrijeme sudske privremene mjere protiv sebe i Popovića. Sve to navodi na mogućnost da se može zatražiti poništenje nelegalne izdane građevne dozvole – poručuje Ileković.

Za komentar najnovije presude upit smo poslali na Ured šibenskog gradonačelnika. Inteseriralo nas je kako će se Grad sada postaviti i gdje vide izlaz iz ove, po njih, nimalo zavidne situacije. Odgovor nismo još dobili.

Visoki trgovački sud potvrdio je presudu Trgovačkog suda u Splitu, donijetu početkom rujna ove godine, a kojom je zbog povrede autorskih prava zagrebačkih arhitekata Dine Vulin Ileković i Borisa Ilekovića Gradu Šibeniku i arhitektu Zoranu Popoviću izdana mjera zabrane radova na većem dijelu Tvrđave sv. Ivana.

- Glavni projekt i njegove izmjene imaju obilježje autorskog djela, što je uostalom priznao i sam prvotuženik (Grad Šibenik, op. Z.Š.) sklapajući ugovor o izmjeni idejnog, glavnog i izvedbenog projekta s pripadajućim troškovnicima za uređenje tvrđave Sv. Ivana od 7.rujna 2017. kada je u članku 6. ugovorio da izvršitelj ima autorsko pravo nad izrađenim projektom. Navedeni glavni projekt, a osobito njegovu izmjenu napravili su tužitelji koji u kontekstu članaka 74., 75. i 76. mjerodavnog prava zadržavaju autorsko pravo na autorskom djelu stvorenog po narudžbi i u radnom odnosu ukoliko pravo iskorištavanja autorskogdjela ugovorom o radu nije preneseno na poslodavca. U nedostatku dokaza koji bi govorio suprotno, sud zaključuje da su tužitelji kao autori ex lege zadržali pravo na glavnom projektu i njegovoj izmjeni u cijelosti – napisala je u presudi sutkinja Kamelija Parać, koja inače u stručnim krugovima slovi za jedan od vodećih autoriteta u području intelektulanog vlasništva.

Posao joj je olakšao i sam Grad Šibenik, kao i arhitekt kojeg su angažirali nakon otkaza suradnje zagrebačkom dvojcu, jer su, kako je ustanovila sutkinja, u podnesku od 17. srpnja ove godine sami izrijekom naveli da je formalno izvršena izmjena i dopuna gotovo cijelog glavnog projekta. Grad i Popović branili su se tezom da su imali pravo pristupiti izmjenama arhitektonskog djela jer da su to zahtijevali sigurnosni i tehnički razlozi te da se tome izvorni autori nisu mogli protiviti jer je projekt usklađen s posebnim uvjetima Konzervatorskog odjela u Šibeniku, ali to im u konačnici nije prošlo.

Visoki trgovački sud nije donio nikakvu odluku po pitanju kršenja priremene mjere zabrane radova na većem dijelu tvrđave jer se oko toga već vodi spor. I njega su pokrenuli supružnici Ileković i predmet je dlegiran na Općinski sud u Kninu, ali nitko od tuženih u srijedu se nije pojavio na ročištu. Gradu, gradonačelniku Željku Buriću i arhitektu Zoranu Popoviću prijeti opasnost da budu kažnjeni sa 100.000 kuna (pravna osoba), odnosno s po 10 tisuća kuna (fizičke osobe).

Boris Ileković, unatoč ovakvoj presudi i činjenici da Trgovačkom sudu u Splitu ne preostaje ništa nego donijeti još jedno rješenje u njihovu korist, uvjerenja je da će Grad i dalje nastaviti s radovima i forsirati s dovršetkom projekta vrijednog 50 milijuna kuna (dvije trećine financra se iz EU-fondova).

- Prema podacima kojima mi raspolažemo, oni uvelike rade i betoniraju po izmjenama i dopunama dozvole što su ih ishodovali za vrijeme sudske zabrane. Tkave izmjene su ništave, jer nikakve korake ni Grad ni kolega Popović nisu smjeli poduzimati. Na potezu je država da ih prisile da poštuju njezine presude – komentirao nam je Popović i podcrtao jednu važnu činjenicu:

- Nama je najbitnije da smo prvi arhitekti u Hrvatskoj koji su dobili presudu jer su im ugrožena autorska prava. Ovo je lekcija da se može stai na kraj samovolji investitora koji se, kao u našem slučaju, hvali da imaju pun bunar novca!

Ileković nam je podastro i dokaze da druga strana intenzivno nastoji pribaviti dokumentaciju kojom bi legalizirali radove što su ih izvodili za vrijeme sudske zabrane.

- Definitivno na jednoj parceli ne može biti više važećih građevinskih dozvola, nego se rade izmjene i dopune osnovne građevne dozvole. Nejasno nam je kako to da je iz evidencije izbrisana izmjena i dopuna građ. dozvole od 4.5.2019., pribavljena temeljem naše zadnje dokumentacije i temeljem koje je otvoreno gradilište u 2019. godine. Prema informaciji sa službenog web portala, Grad je sam sebi izdao dozvolu 29.10.2020., znači za vrijeme sudske privremene mjere protiv sebe i Popovića. Sve to navodi na mogućnost da se može zatražiti poništenje nelegalne izdane građevne dozvole – poručuje Ileković.

Za komentar najnovije presude upit smo poslali na Ured šibenskog gradonačelnika. Inteseriralo nas je kako će se Grad sada postaviti i gdje vide izlaz iz ove, po njih, nimalo zavidne situacije. Odgovor nismo još dobili.

Grad Šibenik izgubio i na Visokom trgovačkom sudu: u slučaju obnove Tvrđave sv. Ivana prvi put u RH donesena presuda zbog povrede prava arhitekata

Visoki trgovački sud potvrdio je presudu Trgovačkog suda u Splitu, donijetu početkom rujna ove godine, a kojom je zbog povrede autorskih prava zagrebačkih arhitekata Dine Vulin Ileković i Borisa Ilekovića Gradu Šibeniku i arhitektu Zoranu Popoviću izdana mjera zabrane radova na većem dijelu Tvrđave sv. Ivana.

- Glavni projekt i njegove izmjene imaju obilježje autorskog djela, što je uostalom priznao i sam prvotuženik (Grad Šibenik, op. Z.Š.) sklapajući ugovor o izmjeni idejnog, glavnog i izvedbenog projekta s pripadajućim troškovnicima za uređenje tvrđave Sv. Ivana od 7.rujna 2017. kada je u članku 6. ugovorio da izvršitelj ima autorsko pravo nad izrađenim projektom. Navedeni glavni projekt, a osobito njegovu izmjenu napravili su tužitelji koji u kontekstu...
