Općinski sud u Koprivnici ovih se dana bavio pravnom ostavštinom nastalom nakon velike tragedije koja se dogodila u Pitomači krajem 2009. godine kada je u prometnoj nesreći vozač teretnjaka križevačkih oznaka skrivio nesreću u kojoj je poginula vozačica audija.

Nesretna je vozačica zadobila ozljede glave od kojih je na mjestu preminula, a teretnjak kojim je nesreća prouzročena zbog neprilagođene brzine bio je osiguran kod Croatia osiguranja.

Zbog toga je Hrvatski zavod za mirovinsko osiguranje tužbom potražio i nepravomoćno dobio od Croatia osiguranja 39.000 kuna, koliko su isplatili obiteljske mirovine udovcu i djeci nesretno stradale žene, piše Podravski list.

Hrvatski zavod za mirovinsko osiguranje prvotno je tužbom od osiguravajuće kuće potraživao 79.000 kuna, no tijekom postupka su zbog zastare potraživanja odustali od 40.000 kuna i ostali na iznosu od 39.000 kuna, koliko im je na kraju sutkinja Marijana Jurenec i dosudila.

U odgovoru na tužbu iz osiguravajuće kuće su prigovorili kako se ne može primijeniti zakon koji je bio na snazi u trenutku isplate, već onaj koji je bio na snazi kada se ‘štetni događaj’, odnosno prometna nesreća s poginulom osobom dogodila.

Kako se radilo o različitim zakonima o mirovinskom osiguranju, iz Croatije su tvrdili kako u zakonu na koji se poziva HZMO nije propisano da bi se odredbe primjenjivale i na događaje koji su se dogodili prije. No, sutkinja je na kraju dosudila u korist HZMO-a zato što je bilo evidentno da su isplatili članovima obitelji taj iznos priznate im obiteljske mirovine za pokojnu majku, odnosno suprugu.

Sutkinja je u obrazloženju presude utvrdila kako prema odredbi Zakona o mirovinskom osiguranju Zavod ima pravo zahtijevati naknadu štete koju predstavljaju novčana davanja na teret mirovinskog osiguranja, a u ovom slučaju stvarna šteta nanesena Zavodu je obiteljska mirovina koju su morali isplaćivati na osnovi priznatoga prava.

Prema tom istom zakonu HZMO “ima pravo potraživati naknadu od društva za osiguranje kod kojeg su vlasnici, odnosno korisnici motornog vozila osigurani od odgovornosti za štetu”, navela je sutkinja.

Iako su iz Croatia osiguranja osporili visinu tužbenog zahtjeva HZMO-a, u Zavodu tijekom postupka nisu pokušali dokazati da su u javnoj ispravi koja pokazuje iznose isplaćene mirovine članovima obitelji uvedeni neistiniti podaci.

Za dio tužbenog zahtjeva, sutkinja je doista primijenila rok zastare, no tijekom postupka HZMO je tužbeni zahtjev svejedno umanjio za iznos koji bi otišao u zastaru. Stoga je odlučila u punom tužbenom zahtjevu od 39.000 kuna dosuditi u korist tužitelja, Hrvatskog zavoda za mirovinsko osiguranje, piše Podravski list.

Općinski sud u Koprivnici ovih se dana bavio pravnom ostavštinom nastalom nakon velike tragedije koja se dogodila u Pitomači krajem 2009. godine kada je u prometnoj nesreći vozač teretnjaka križevačkih oznaka skrivio nesreću u kojoj je poginula vozačica audija.

Nesretna je vozačica zadobila ozljede glave od kojih je na mjestu preminula, a teretnjak kojim je nesreća prouzročena zbog neprilagođene brzine bio je osiguran kod Croatia osiguranja.

Zbog toga je Hrvatski zavod za mirovinsko osiguranje tužbom potražio i nepravomoćno dobio od Croatia osiguranja 39.000 kuna, koliko su isplatili obiteljske mirovine udovcu i djeci nesretno stradale žene, piše Podravski list.

Hrvatski zavod za mirovinsko osiguranje prvotno je tužbom od osiguravajuće kuće potraživao 79.000 kuna, no tijekom postupka su zbog zastare potraživanja odustali od 40.000 kuna i ostali na iznosu od 39.000 kuna, koliko im je na kraju sutkinja Marijana Jurenec i dosudila.

U odgovoru na tužbu iz osiguravajuće kuće su prigovorili kako se ne može primijeniti zakon koji je bio na snazi u trenutku isplate, već onaj koji je bio na snazi kada se ‘štetni događaj’, odnosno prometna nesreća s poginulom osobom dogodila.

Kako se radilo o različitim zakonima o mirovinskom osiguranju, iz Croatije su tvrdili kako u zakonu na koji se poziva HZMO nije propisano da bi se odredbe primjenjivale i na događaje koji su se dogodili prije. No, sutkinja je na kraju dosudila u korist HZMO-a zato što je bilo evidentno da su isplatili članovima obitelji taj iznos priznate im obiteljske mirovine za pokojnu majku, odnosno suprugu.

Sutkinja je u obrazloženju presude utvrdila kako prema odredbi Zakona o mirovinskom osiguranju Zavod ima pravo zahtijevati naknadu štete koju predstavljaju novčana davanja na teret mirovinskog osiguranja, a u ovom slučaju stvarna šteta nanesena Zavodu je obiteljska mirovina koju su morali isplaćivati na osnovi priznatoga prava.

Prema tom istom zakonu HZMO “ima pravo potraživati naknadu od društva za osiguranje kod kojeg su vlasnici, odnosno korisnici motornog vozila osigurani od odgovornosti za štetu”, navela je sutkinja.

Iako su iz Croatia osiguranja osporili visinu tužbenog zahtjeva HZMO-a, u Zavodu tijekom postupka nisu pokušali dokazati da su u javnoj ispravi koja pokazuje iznose isplaćene mirovine članovima obitelji uvedeni neistiniti podaci.

Za dio tužbenog zahtjeva, sutkinja je doista primijenila rok zastare, no tijekom postupka HZMO je tužbeni zahtjev svejedno umanjio za iznos koji bi otišao u zastaru. Stoga je odlučila u punom tužbenom zahtjevu od 39.000 kuna dosuditi u korist tužitelja, Hrvatskog zavoda za mirovinsko osiguranje, piše Podravski list.
