Prešutni minusi koji su banke do sada odobravale klijentima ubuduće će biti ograničeni, kako u iznosu tako i pogledu visine kamatne stope koju banke naplaćuju na te iznose.
HNB pokreće inicijativu za izmjenu i dopunu Zakona o potrošačkom kreditiranju, kojima se bankama propisuju nova pravila za prešutno "kreditiranje" putem tekućih računa, piše Jutarnji.
Kod postojećih ugovora ograničava se efektivna kamatna stopa na iznose koji premašuju dogovoreno prekoračenje, a znali su biti do 30 posto skuplji i dosezati iznos nekoliko puta veći od redovitih primanja.
Također, ako dođe do njegova smanjenja ili ukidanja, banke će klijentima morati ponuditi otplatu duga u 12 rata.
Praksa banaka
Prilikom ugovaranja novih ugovora kredita, maksimalan iznos prešutnog prekoračenja bit će 1.500 kuna. Ako njegovo trajanje bude "značajno", duže od 90 dana, te u "značajnom" iznosu, banka mora klijentu ponuditi odgovarajući kreditni proizvod, dopušteno prekoračenje ili kredit, kojim će zamijeniti prešutno prekoračenje.
HNB ocjenjuje da će se tim izmjenama odmah ostvariti “djelomično unapređenje zaštite potrošača u odnosu na postojeće stanje”, te da će se postupno uspostaviti okružje za funkcioniranje oba proizvoda u onoj ulozi za koju su namijenjeni.
Inicijativu je podržalo i Ministarstvo financija, formalni podnositelj izmjena zakona, a HNB očekuje da će njegove preporuke uzeti u obzir pri prvoj sljedećoj izmjeni Zakona o potrošačkom kreditiranju. U međuvremenu, očekuje “da banke bez odgode započnu s odgovarajućim aktivnostima kako bi svoje prakse uskladile s najavljenim izmjenama i dopunama" zakona.
Podloga za ovu inicijativu je provedeno istraživanje prakse banaka kojim je utvrđeno da 70 posto potrošača s otvorenim tekućim računima na koje primaju redovna primanja ima odobreno prekoračenje.
Pri tome 95 posto svih prekoračenja čine prešutna prekoračenja, koja su u prosjeku 30 posto skuplja od dopuštenih prekoračenja “i nerijetko iznose do 300 posto prosječnih mjesečnih primanja”.
Manji iznosi
Dok su dopuštena prekoračenja predstavljala ugovor o kreditu, uz punu zaštitu potrošača, prešutno prekoračenje, objašnjava HNB, je poslovni odnos reguliran ugovorom o tekućem računu i banka ima samo obvezu pružiti informacije o kamatnoj stopi i naknadama, nije bilo potrebne procjene kreditne sposobnosti, ograničenja visine kamate niti obročne otplate u slučaju smanjenja ili ukidanja prekoračenja.
Početak većeg odobravanja prešutnih prekoračenja uslijedio je nakon donošenja Odluke o efektivnoj kamatnoj stopi krajem 2017. godine i dva proizvoda su se stopila u jedan, ali uz značajno višu cijenu koju su potrošači plaćali za istu uslugu, s obzirom na to da su dva proizvoda izjednačena u svojim funkcionalnostima.
Osim toga, oni kojima je odobreno prešutno prekoračenje bez zahtjeva, pretpostavlja se da nisu ni svjesni kreditnog odnosa u koji ulaze korištenjem tog prekoračenja.
HNB smatra da bi ono trebalo biti iznimka, a ne pravilo, a banke ga odobravati u manjim iznosima.

Prešutni minusi koji su banke do sada odobravale klijentima ubuduće će biti ograničeni, kako u iznosu tako i pogledu visine kamatne stope koju banke naplaćuju na te iznose.
HNB pokreće inicijativu za izmjenu i dopunu Zakona o potrošačkom kreditiranju, kojima se bankama propisuju nova pravila za prešutno "kreditiranje" putem tekućih računa, piše Jutarnji.
Kod postojećih ugovora ograničava se efektivna kamatna stopa na iznose koji premašuju dogovoreno prekoračenje, a znali su biti do 30 posto skuplji i dosezati iznos nekoliko puta veći od redovitih primanja.
Također, ako dođe do njegova smanjenja ili ukidanja, banke će klijentima morati ponuditi otplatu duga u 12 rata.
Praksa banaka
Prilikom ugovaranja novih ugovora kredita, maksimalan iznos prešutnog prekoračenja bit će 1.500 kuna. Ako njegovo trajanje bude "značajno", duže od 90 dana, te u "značajnom" iznosu, banka mora klijentu ponuditi odgovarajući kreditni proizvod, dopušteno prekoračenje ili kredit, kojim će zamijeniti prešutno prekoračenje.
HNB ocjenjuje da će se tim izmjenama odmah ostvariti “djelomično unapređenje zaštite potrošača u odnosu na postojeće stanje”, te da će se postupno uspostaviti okružje za funkcioniranje oba proizvoda u onoj ulozi za koju su namijenjeni.
Inicijativu je podržalo i Ministarstvo financija, formalni podnositelj izmjena zakona, a HNB očekuje da će njegove preporuke uzeti u obzir pri prvoj sljedećoj izmjeni Zakona o potrošačkom kreditiranju. U međuvremenu, očekuje “da banke bez odgode započnu s odgovarajućim aktivnostima kako bi svoje prakse uskladile s najavljenim izmjenama i dopunama" zakona.
Podloga za ovu inicijativu je provedeno istraživanje prakse banaka kojim je utvrđeno da 70 posto potrošača s otvorenim tekućim računima na koje primaju redovna primanja ima odobreno prekoračenje.
Pri tome 95 posto svih prekoračenja čine prešutna prekoračenja, koja su u prosjeku 30 posto skuplja od dopuštenih prekoračenja “i nerijetko iznose do 300 posto prosječnih mjesečnih primanja”.
Manji iznosi
Dok su dopuštena prekoračenja predstavljala ugovor o kreditu, uz punu zaštitu potrošača, prešutno prekoračenje, objašnjava HNB, je poslovni odnos reguliran ugovorom o tekućem računu i banka ima samo obvezu pružiti informacije o kamatnoj stopi i naknadama, nije bilo potrebne procjene kreditne sposobnosti, ograničenja visine kamate niti obročne otplate u slučaju smanjenja ili ukidanja prekoračenja.
Početak većeg odobravanja prešutnih prekoračenja uslijedio je nakon donošenja Odluke o efektivnoj kamatnoj stopi krajem 2017. godine i dva proizvoda su se stopila u jedan, ali uz značajno višu cijenu koju su potrošači plaćali za istu uslugu, s obzirom na to da su dva proizvoda izjednačena u svojim funkcionalnostima.
Osim toga, oni kojima je odobreno prešutno prekoračenje bez zahtjeva, pretpostavlja se da nisu ni svjesni kreditnog odnosa u koji ulaze korištenjem tog prekoračenja.
HNB smatra da bi ono trebalo biti iznimka, a ne pravilo, a banke ga odobravati u manjim iznosima.
